But EEA FP for extended fam members, if that is the correct category, you will be only able to apply until 31st Dec

For parents you could have applied euss if you have pre-settled status, there is then no need to proof financial dependency..... although if you have applied for EEA family permit, that is also correct.

For brother in law, the correct category is EEA Family permit....and not euss

The decision is correct. You should have applied for EEA family permit first.

Hi

See here the refusal letter which i mentioned previously. Its refused because birth cert is just of recently (late reg after 26 years)
If that’s the case with your bro in law, then you might can also submit DNA to proof his relation to his brother (your husband), and your relation as sis in law can be a proof through your and your husbands marriage documents.

But the EEA permit needs to be applied before 31st DEC.... (check this to be sure, as i can be incorrect)

Qualifying as an ‘extended’ family member or unmarried partner
Extended family members must apply before 11pm on 31 December 2020. After this, only close family members and unmarried partners will be able to apply.

Hey Saima
If your husband has settled status, he is able to apply for his brother....?
Look into this option....
Others are maybe able to advise you better on this??

Hi I have just checked the link you sent me

It says

Use this form from outside the UK if you are a non-European Economic Area (EEA) national, to apply for permission to travel with or join a family member who is:

an EEA national
a Swiss national
a relevant naturalised British citizen
You can also use this form to request a travel permit to enter the UK if you have lost, damaged or had stolen your biometric residence card (BRC).

But my husband is non Eu national with settle status

Kindly reply

This form also says

Apply for the EEA Family Permit if you’re a close or extended family member of an EEA or Swiss national. Your family member does not have to hold a UK immigration status under the EU Settlement Scheme. For more information, read the EEA Family Permit guidance.

This permit would allow you to remain in the UK for 6 months from the grant date. You can leave and enter the UK as many times as you want within that time.

So I am confused

I am unsure about this, as i havent a reference to if someone non-eu with settled status can apply for extended family members.

I hope other senior members can comment on this please or others with same circumstances? Kamoe/Obie?

A non EU citizen cannot sponsor family under the EU family permit or the EU settlement scheme. Only an EU citizen can sponsor someone.
