EEA Family permit objection withdrawn

Hi all,

I sponsored my brother who is an non EU national in December 2020 and case went back and forth and eventually we submitted for the appeal and we got the response from HO saying "I am writing with regard the above named who has/have an outstanding Appeal before the First-tier Tribunal (Immigration and Asylum Chamber).

This matter has been reviewed ahead of the scheduled hearing.

The review has considered:

· the grounds of appeal
· the evidence submitted
· any material changes since the date of the decision under appeal

Please be advised that new evidence from the Appellants Representatives was received by the Home Office on 05-May-2022.

In the light of the review, it has been concluded that the decision to refuse is no longer appropriate and the immigration decision is therefore withdrawn. It is anticipated that a family permit will be granted, subject to any further
checks that are required and the appellant providing any documents requested. If a family permit is not granted a new decision will be made.


This letter has been sent to the HMCTS Hearing Centre where the Appeal is due to be heard. The request is for HMCTS to accept this decision as withdrawn and to vacate the appeal hearing"

following week we got letter from HMCTS

"You have a direction for this case.
Here are the direction instructions:
The Respondent has informed the Tribunal that they would like to withdraw their refusal decision. The Respondent’s withdrawal request was uploaded on myHMCTS on 11 June 2022 and can be accessed under the “Documents” tab on myHMCTS.
To the Appellant:
Please confirm, no later than the date indicated below, whether you consent to the Respondent’s request to withdraw, or provide any reasons as to why you believe the appeal should proceed.
Failure to respond by the date indicated below will result in the Respondent’s request to withdraw being granted, and the appeal being treated as ended".



Has anyone withdrawn their appeal based on something like this ?
