MY CURIOUS CASE

I applied for EEA 2 in mid-October 2012 and got my COA four days after with right to work , And today I have just receive an email from the ukba asking my wife and I to attend an interview in Liverpool next month.

Here's the complication , we got married in August , a day before the wedding I receive a call from someone claiming to be from the ukba saying they are aware I am about to enter into a sham marriage bla bla bla , that I should come to the ukba office in london bridge with my partner that failure to do so that they will turn up the next day at my wedding and arrest my wife and me for sham marriage etc . I told him I didnt know what sham marriage he was talking about that my partner and i are getting married that they should come to the registry if they wish and arrest us for loving each other.

The next day we went to the registry , we got married and everything went well and the people we invited turned up and there was no sign of ukba staffs none of their people turned up at the wedding or anything.

Few days after my wedding I receive a letter asking us to come to London bridge again but this time I decided to show my lawyer the letter and told him about the call before the wedding , he told me to ignore the letter that the particular branch of ukba they are asking me to come mostly deal with asylums cases etc .So I haven't heard from them since after receiving my COA until the email today.

I applied on basis of economic self-sufficient because my wife is not working or permanently living here yet because she completing her university degree in Germany and only come here when she get holiday from University to be with me but will be moving here finally after she complete it later this year.

I doubt if anyone on this forum have for him/herself in this kind of situation before but any advice and contribution is welcomed and very much appreciated . What should we expect from the interview in Liverpool , what do we need to do etc ... advice please.

We received my husband's passport on 18 Jan after requesting it repeatedly from 19 Dec. My application has now exceeded 6 months on 10 Feb. S'pose you can take it as a UKBA doesn't give a shit.

Hello thefly, sorry to hear about your delay. I confirm that even the family permit has expired, with your marriage certificate and your company, your husband should be able to enter UK. I did it in Brussels. The procedure for the staff is pretty standard. They will give you a stamp on the passport valid for 6 month.

I share the same experience that I just want to move on. The UK Liverpool is quite arbitrary to grant RC. The problem is that UK didn't put enough staffs for EEA application as it's free of charge. This makes the process extremely long. We ourselves are not responsible for that! Actually I would rather pay some money to quickly get my RC but the EU treaty does not approve it.

H everyone.
we applied for RC on 11th February and so far got no response back from HO. No post, no emails, no phone calls. Am I supposed to get worried as we have not been contacted yet? My husband says we should request our passports back but I'm not sure whether or not that would be clever decision? Is RC issued on paper as valid as one issued in passport?
The other thing we would like to know is, in case we ask for passports back and we get them, would we be able to travel to France? My EEA huband and I planned to fly to France (I can travel within Schengen zone with no restrictions) but are a bit worried that we might not be able to board on plane from France?
Ive been hanging a lot on this forum lately, reading posts and kind help shared amongst its members. What i've realised is that more i read more stressed i get with nonsense from HO.

Tweenty0211,,,you applied on 12th feb and today is 22nd feb,how you expecting any reply from ukba in just 10 days?this is 6 month process.You can expect that your COA will arrive may be in march/April..RC on paper is valid as on passport.

What UKBA do sometimes they issue residence card but they just keep it at their offices for couple months!!

MP involved and ask for passport will force them to look into your file and if ur card is ready it will be sent through..

I know how desperate to wait for the RC, so I am sharing my timeline. I hope it helps people who applied at the end of October 2012.

Document sent: 25th Oct 2012
UKBA Received: 27th Oct 2012
COA sent: 5th November 2012
RC issue: 11th Feb 2013
RC Received: 22nd Feb 2013

PLEASE HELP!

Received the envelope from UKBA today with a refusal to issue a residence card and no further basis of stay in the UK.
They've returned all the documents except my passport. (My spouse's passport was returned upon the request last month)
The reason they refused is that my EEA family member has failed to provide evidence that they are a qualified person.
I am asked to leave, and also entitled to appeal.

Now, they say in the refusal letter that on 9 January they wrote to my address requesting evidence. (I HAVE NOT RECEIVED IT). And to them I had time until 30 January to submit the evidence. Which I was not aware of.
Basically, they require a UK bank account funds details. (My spouse is from Cyprus, and with my application I have submitted bank statements from his home bank account as he didn't have a UK one) Also, his student letter was dated end of September, so while the application was in process he graduated and now they want his residency confirmation.

Now, two things, PLEASE.
1) As I have not received their initial request letter from 9 January can I ask to have that time? If they made the refusal based on me failing to provide documents, request for which I have never received.
2) They also inclosed pages with information on appeal.
And... I'm really stressed and scared right now, and it would really help to have a free legal help in London.

Please help me with what should I do now.

I have e-mailed now LiverpoolEuro.PassportReturns@UKBA.gsi.gov.uk asking to send me their initial request letter as I have never been given a chance to receive, nor to answer it. ...

Fatefull....where is your wife now at the moment?in uk or in abroad?if she is in uk then as soon as possible open a new bank account and re apply as soon as possible.if she s a qualified person at the moment in the uk then there will be no problem.

Is there any other ways to exercising treaty rights?

My spouse has officially ended studies in the end of September, but was still working of graduation projects for the next month or so. He's not officially employed, he's a filmmaker and at the moment is on location outside of UK.

Just starting the fight to receive the RC lol.

I've sent my application on 28th January and I'm still waiting for my letter. My husband is going to travel on April, so I'm kind of worried about asking for his passport. I really hope they don't take to long to send it back.

Hey,

You must go to your local MP. When the situation is very urgent and complicated they will help you quickly!

I went today to my MP, as I need my RC urgently due to my employment. and they told me they will contact them on Monday or Tuesday.

So hope for that!

Find your local MP and go there! No appointment needed!

COA received: 23rd February 2013 (dated 20th February) with right to work
RC: still waiting

The following documents were sent to support our application:
-ID card of my husband (EEA national)
-my current passport (non EEA)
-my previous passport which had my visa stamped in
Proof that my husbans is exercising his threaty rights
-letter from my husbans employer cofirming his employment
-2 payslips
-contract of employment
All peoofs of employments are addressed to our home address
Proof of address:
-utility bill in my name
-council tax bill in both names
-my busbands bank statement
-tenancy agreement in both names
Proof of relationship:
- Marriage certificate

I have been watching this forum for over 6 months. Its supported me throughout my RC process. The least I can do is post my experience.
Applied 9/8/2012. Received 10/8/2012. COA received 15/10/2012. RC received 20/2/2013.

I am going bonkers and i would like to know what is happening with rc timeline.done everything necessary,written to homeoffice,contacted mp(very useless),contacted solvit(extremely unresponsive),sent email to all available email contacts of ukba and there is still absolutely no resonse from them.Where do i go from here people.It will be 7month next week.Hellllllp!!!

I am sorry to hear that. I feel, that i will have the same situation. Contacted my MP last week, so far he didnt send anything to the HO.
I think you should go to your MP again and ask him to call the immidiately!
because my MP told me that HO responds only to MPs, and it takes them up to 6 weeks to do that...

Please help me with what should I do now.
I strongly suggest you get in touch with immigration Lawyer.I believe your case needs a Lawyer who can guide you properly.I also think that you can resolve the issue without appealing because if your case is because of insufficient documentation which you never recieved the request from UKBA,Then the Lawyer would explain this and then you can re-apply without appealing or appeal in the presence of the Lawyer during the hearing.Goodluck!

Wife received her RC card today (25 Feb 2013)

Applied: 19 Sept 2012
CoA: 15 Oct 2012 (received probably end-Oct)
RC: 13 Feb-2013 (received 25 Feb 2013)
