You have to make another complain pointing out the six months rule.
Involve your MP and AIRE.

It gives advice on EU citizen's rights. They also advised me to use Solvit, which I think would be your best bet if they exceed the six months. Don't wait to launch your case as it takes them time to process too. If you need any info on that I'll try and help.

In terms of complaints to HO. I sent four complaints in total (e-mail and post) once the 6 months were exceeded. I received only one reply and only after Solvit got involved. I'm not saying don't complain, do; you have every right to just be aware that they might ignore it. Getting outside help will certainly boost your chances.

Thanks jajanna for the phone number. My husband tried calling this morning, and still, automated service then they hung up on him. But I don't understand, how come he got hung up on, and some other people on this forum managed to talk to someone? What options should we be choosing? Thanks...

Hi Sillycrab,
I would advice you to call them and ask for when are you going to receive the FMRS, I don't think they will issue you with COA but please keep your royalmail tracking number for future reference.

Hi Sillycrab,
I would advice you to call them and ask for when are you going to receive the FMRS, I don't think they will issue you with COA but please keep your royalmail tracking number for future reference.
alright, thanks for the advice, i will ring them =)

instead of sending individual complaint to the customer service or letters to MP, all of us should really do something TOGETHER, such as a petition against the slow processing time of the HO, or flood them with loads of complaints EACH DAY.

The UKBA don't want us here, the EU law is what is breaking their backs. They are trying not to give too much power to EUROPE, there is no way all the EEA2 applicants can come together and make complain as one voice.
The way you make your complain really matter for there to reply, the two l have made really break them into peace.

Which of the Solvit centre did you used during your complaint perid?
We first submitted the case to Solvit in my partner's home country (Finland), they then passed it to Solvit UK. It took them only ten days to get in touch with us saying that due to their intervention our case was now given urgent consideration and to keep them posted. The following week received apology/explanation letter from HO. A little over a month later RC was issued. In the letter they said I would be notified when the decision was made but nothing like that happened. The documents just arrived unexpectedly one morning. I guess they like to 'surprise' people.

I can not state this as fact but in my case Solvit seemed to help.

Also agree with you about UKBA not wanting people here, especially after recent elections.

you r right . I just write to my local mp about delaying our application. and my wife also write to them.

I m not complaining to UKBA till 6 months finished..

Now I am planning to write to deputy Prime minister Nick Clegg..

we should all of us write to him & home minster .. saying that homeoffice r delaying us without any reason... we dont need to give the reference number , DOB etc.. just complain to them to speed up the process..

please spend 5 min to write them....... that will save our time & future applicant's time.

Hello everyone.

I'm happy to read this thread,as it's more active and constantly up-to date information about the EEA2 related topics, comparing to other individual threads.So, I'd like to hear your opinions,suggestions and advices.

I've read that a topic about wordings in the COA was discussed sometime ago,and I've got a question about it.
I've received the COA,but it doesn't mention about my rights to live and work in the UK.I've found the wordings in my COA are actually the ones for an unmarried partner of an EEA citizen, according to some posts in this thread, and because a similar topic came up in my post in another thread.
I'm married to an EEA citizen,so I really wonder why I've received the one for an unmarried partner :( Or did an office staff who typed/printed my COA forget to place the wordings about the rights to live and work while waiting for the RC??

Fortunately, I've got a job just explaining that I've applied for the RC and I'm eligible to live and work as I'm married to an EEA citizen while waiting for it, and handing in a copy of my COA,although the rights to work and live aren't mentioned. But, certainly I'm not happy that it confirms only their acceptance of my application, and informs not to make any travel plans :x Has anyone who's married to any EEA nationals received the COA as mine?

And one more question.
I've sent my EEA2 form and my husband's EEA1 form together in a same envelope. Do applicants receive the COA, confirming only EEA2 applicants, or are there any separated confirmation for EEA1 applicants?

Finally, here are my details;
Non EEA citizen from a non visa country,EEA FP expired on 17/05/2010.
Husband : A8 national, liveing and working in the UK more than 2 years.
EEA1&2 application arrived to the UKBA:17/02/2010.
COA issued : 01/03/2010
Request to return my passport(travel purpose) : Middle of March 2010.
My passport arrived at home : Around 25/3/2010

I haven't heard anything since I received my passport back for a trip in March, though it's written 'please do not return your passport to the Home Office until it has been requested by a caseworker' in a letter I've received with my passport. It's been already June....

I couldnt find any rules or regulations under the EEA caseworker instructions that clearly state out how long it takes to process FMRS. everything I saw was about EEA2. FMRS is different from EEA2, isnt it? please could anyone send me links to FMRS caseworker instructions or something similar so that I could quote something in my complaint or letter to the SOLVIT? many thanks =)

well, i dont expect the UKBA to process my application within 1 month of receiving it. but they should at least have the decency to send me an acknowledgment / confirmation letter or COA to provide me with the HO reference ASAP. it's gonna be 5th week this friday and im gonna submit my case to SOLVIT end of next week. I guess the UKBA wouldn't like every applicant to go to SOLVIT, so they should really brush up on their services.

I can't really say about the other stuff but if they request your passport back it means they are ready to make a decision. If this doesn't happen before six months are up go through the three steps (complaint to HO, case with Solvit, letter to MP) right away.

As far as the COA, it sounds like a typical mistake, (and not the worst they make too) I know other people who had this. Its good you got a job regardless but I advice you call them up about this if you're still concerned.

:roll: :shock: The COA is really important to prove the eligibility to work/live here and secure the status for us(applicants for the EEA2).....

There is no way you will write to anyone i.e MP, UKBA or Nick Clegg etc. and get any positive result if you fail to include these relevant information.

How do yo expect anyone to help resolve your application? My MP resolved my EEA application. within 3 weeks of writing to him. My application took 4 months and 3 weeks from date of submission to UKBA.
