Congratulations commonwealth.I phoned ukba today and been told my application is completed and awaiting dispatch from finalization dept.They didnot disclose outcome.Fingers cross

Thanks everybody, l waited for 7 months and 6 days. The worst part of it is that all l have been told were lies by the advisors. I was told that my app was decided on the 7/07/10 and imagine it was issued on the 28/06/10. So, do not believe everything they tell you. Make sure you call them always to get fact from them. If you are waiting too much consult solvit because they pressed the UKBA. And they wrote to me twice about it that l will get it soon. My MP was useless he never replied back to me.
Do not give up keep callingthem. Thanks all

Congrats!! But it's strange why it took them 1 month to post your RC to you if it was issued on 28 Jun!! I called HO today and was told my documents were sent out to me today and was given a Post Office tracking number, they said the decision was made on 23 July... so hopefuly will receive everything soon in the next few days because I need to travel on 13 Aug.

Anyway happy for you....!

British with non-eu spouse.

EEA2 submitted 25 Feb (next day delivery).
COA received 20 Mar after we requested it.
Apr 9 passport received from UKBA. Needed for NINO interview.
May 17 letter to UKBA informing them that upon request passport is available for return to UKBA
Now more than 5 months and passport has not been asked for by UKBA.
At 5 month point decided to involve MP and Solvit.
On Monday I phoned UKBA. They have written to my MP but case is still under consideration.
Reminded the person that RC is to be issued within 6 months and all he would say is that it remains under consideration.
Very frustrating because we came from another country within the EU and COA gives permission to live and work in UK, so no apparent reason for delay.
Since we still have the passport there is no way we will get RC within the 6 months specified.

Grrrrr!!!

Kenc, I applied in the same month 12th Feb and the case is also still under consideration. And I got the same feeling after calling HO on Tuesday. :(

I contacted SOLVIT, but they told me not to contact them until the 6 months deadline has passed!
And it's weird as the reply is from the SOLVIT in France the country that my husband is from but not in the UK. May I ask those ones who have contacted SOLVIT if they receive an answer from SOLVIT in where the EEA family member is from or is from SOLVIT UK?

I also got my RC today...!! Yay!!!!!!

Application sent to HO: 27 April
Received by HO: 28 April
COA sent out on 15 May
Received COA on 18 May
Requested passport back to travel
Received a letter from HO asking me to return my passport: 28 Jun
Someone from UKBA called and said they're just waiting for my passport to stick the RC in it: 28 Jun
Returned my passport to HO: 12 Jul
Received by HO: 13 Jul
RC issued on 22 Jul
Received RC and all documents 29 Jul

so totally it took 3 months for me to get my RC, although it could have been shorter if I hadn't had to return my passport. I have to say though I was quite impressed with their service. Everytime I emailed NWCSU they answered my email within a few hours or next day. When I told them about the urgency to get my passport back for travelling they did give urgent attention to my application and speed it up. When I called their helpline sometimes I got a guy called Danny who was just unhelpful and rude and so everytime I got hiim I just hung up. But I sometimes got some ladies called Sarah and Cheryl they're lovely and very helpful and updated me on the progress of my application and everything they told me was true. I did at one point panic a little bit as I needed my passport back and was not sure if they were going to return it in time so I sent a complain to NWCSU but now that I got my passport back so soon I have to say I was actualy quite satisfied with their service.

For those who haven't yet got their RC, don't give up!!! Am sure they will come soon (or in due course). If you have any queries about your application, send an email to NWCSU they do seem to respond quite quickly.

Babie_meg, congratulations!

May I ask how you contacted NWCSU? Coz I emailed them twice, once it was an automatic reply saying if the case was over 6 months, they would reply and give you a reference number; the other time which is on Tuesday, they didn't reply to me.

I just emailed to the email address I found on the Home Office website NWCSU@homeoffice.gsi.gov.uk. The very first time I emailed them to complain I did get an auto response saying they would respond to all complaints within 20 working days and then on about the 15th day I received a letter in the post apologising and saying my passport was already returned to me etc (I complained about not knowing whether my passport was returned to me to travel). And since then I had emailed them regulary for updates on my application (to the same email address) and never got any auto replies again. and then usually in a few hours or next day I would get a reply from them saying my application was with a caseworker, or saying someone would contact me soon (and then someone did call me).

I was also given a fax number for the relevant team (they said relevant team, I'm guessing it's the casework team) it's 01512 131 699. I tried sending them a few faxes explaining to them i really wanted to get my RC soon as I had an upcoming trip in August and since I had already withdrawn my passport once and returned it to them I didn't want to have to withdraw it again to travel so would rather they decide my application and return my passport and all docs to me, and they did action my request. Everytime I emailed/faxed them I included my case ID, and in the cases of faxing I addressed to my caseworker.

When ever I ring HO, they keep telling me that COA will take 6 weeks before I get it... is it same with you guys or are they just telling me in other to stop me from disturbing them. Any clue?

Usually Solvit gets involved when EEA immigration rules have been breached (i.e. HO exceeding the 6 month deadline) They will always contact you from the office of the country your partner is from first. If they take on your case they pass all the details to the UK office which then deals with HO and contacts you.

In my case we had contact from both UK and Finland Solvit and they got in touch later to see if the case was successful. Overall they were very good and I recommend submitting your case again if you don't receive the RC before 6 months.

Hello there,

I have a question, you all seem to know so much things regarding those applications. So i thought i should ask
I am EU citizen, i have been married 3 months with my husband, and together for 2 years, who is Saudi. He studied here for his education on student visa, he has a tourist visa now for 2 years. I want to apply for residence card for him to work and live with me.
I just graduated from Uni and i am doing my Masters this years. HE is paying for that, and financially we do not have a problem, also i have been employed for the 4 years, on various position and self-employed.

1 First i am wondering that application is on mine behalf or his? who is suppose to apply i found it confusing.
2 Shall i apply as student, self employed, employed or all the above.
3 Whqat evidence they need, cause apparently they want more than they ask in the form
4 Can he travel to Saudi, as he need to be there once a month?? or they will keep his passport there.
5 Can i give my ID instead of my passport?

Of course i have many more questions and i tried to call them but they are very rude.

Shall i apply as student, self employed, employed or all the above. You would apply in the current circumstance you are in during the application. If you are a student during at the point of application then include evidence as required by eea regulations of how you are exercising your treaty rights as a worker, self sufficient or student. I would assume if you work and study at the same time then you would include evidence of both aspects

What evidence they need, cause apparently they want more than they ask in the form. You have to provide proof you are exercising treaty rights, you are legally married, original ID's for both of you(passports), photos, bills proving you live together e.g council tax etc.

Can he travel to Saudi, as he need to be there once a month?? or they will keep his passport there. Once you apply it takes a minimum of 6 months for the application to be decided and your husband can request his passport back to travel without affecting the application. The h/o would write back to you and tell you when to return the passport for endorsement.

Can i give my ID instead of my passport? Yes as long it's valid and accepted in the UK as proof of identification.

Remember the application can only be successful if you show what you the EEA national has been doing since you got married to the non eu national.

it saying on 03/08/10 i should get delivery...

so waiting for post, don't know the decision,, very excited.......

We've sent EEA2/EEA3 joint application (I'm a Polish citizen who has lived in the UK more than 5 years, my husband in non-EEA).
The application was sent 27 April 2010. Called the Liverpool office today and was told that the application is still waiting to be allocated to the caseworker.
We've been waiting 3 month!
I'm highly frustrated!

I have just called the Home Office again asking for the certificate of application and they said that they sent it on the 12 May.
Apparently it was lost in the post. Will send a new one in 2 weeks.
