travelling when EEA2 application is still under process

hi all,
my husband is an EU citizen and my eea2 application is still under process. i urgently needs to travel out of the country as i have lost my dad. my work permit is now expired, it then means that i currently do not have a valid visa.
Please i really do need an advice on how i can return back to the uk as my work permit has ran out, I read on another forum that if i apply for a family permit abroad to come back in that it will cancel my eea2 application.
Also i need advice on the best way to ask for the return of my passport.
I would appreciate anyone's advice.

hello all..
i applied for eea resident card as unmarried partners,
after 6months of recieving my passports and other documents, after several calls to HO, i got my passport and my partners passport back but we were shocked to find out that mine has no resident card issued or endorsed on it. no refusal wording or approval wording. simply no letter from them. all the documents we sent were sent back to us except our pictures was missing dat we sent initially with d application,

pls is this normal?

HELLO EVERYONE,

I just received my RC (eea2) and residence card(eea1) for my wife today. Woohoo!!!

21 JANUARY - Applications sent
22 january- received by home office
18 FEBRUAY - COA received with spelling mistake in my name

24 february: requested to correct my name by fax to homeoffice

06 march: received another coa in correct name

04th april: send a fax to home office to change my address & also telphone them


7th april: called to home office they update my address or not, they confirmed yes..


21-07-2010 : called homeoffice to update my application...they said its still under consideration
22-07-2010: complain to UKBA NWST and local MP

01-08-2010: checked the return special delivery number in royalmail.. that is saying item were trying to delivered

03-08-2010: went to royal mail, they said item was delivered to address.. the address royal mail said to me was my old one.

i collected parcel from old address , it came in my wife name.. (though they r not supposed to send to old address)

home office send all our document back..

this took 6 months 2 weeks. rc issued on 21 juy,2010

anyway thank you all in this forum.. this forum is really helpfull

Iam sorry for ur lost. Im afraid that u dont have many options wich is make new application back home as it is an emergency u should just buy ur ticket and call them to get ur passport asap try to persuade them by any way, Or u can use ur id or any id to get into ur home country as u know u dont realy need passport to exit uk GOOD LUCK

-Applying for a Family Permit won't cancel your EEA2 application. Some EEA2 applicants were able to come back to the UK without a FP. But it doesn't mean that you will be able to do the same thing.
-The best way to ask for your passport back is by phone.

Also sorry for the news from bazi but hope everything works out -- maybe better to contact HO to ask the passport back and also tells them why it is urgent, seek advice from them directly -- maybe they would be nice to tell you what to do.

-The best way to ask for your passport back is by phone.
Yes call Home Office immediately to request return of your passport. Did you receive the Certificate of Application for your EEA2 application and it states that you're free to live and work in the UK while your application is being considered? If so, you don't need to apply for a Family Permit to return to the UK. It is better if you apply for it becase then they must allow you in, but if you have CoA and travelling with your EEA partner then the CoA is also sufficient. I requested my passport back to go to France with my husband, I didn't have time to apply for a Family Permit in France before returning to the UK, at the border I showed the Immigration officier our marriage certificate, the CoA (that states I am free to live and work in the UK) and my husband was with me and they didn't ask any questions just let me in. Had to fill in landing card though as I didn't have the Residence Card/Family Permit.

The most important thing at the border is to be able to prove you're a family member of an EEA national i.e. marriage certificate or other documents you have, and the CoA. CoA shows them you have an active applicaiton with the Home Office, the immigration officer at the border will be able to see this in his computer, so will be fine.

But if you're an unmarried partner i.e. applying as an extended family member then I don't think you will be able to return without a Famiy Permit

If you are the family member of an EU citizen who is working in the UK, the you can do basically anything a British citizen could do.

So if a British citizen can study, then so can you.

If a British citizen can buy property, then so can you.

meg thanks for your advice.. I currently have my coa that states my rights to live and work, but will not be travelling with my husband for the burial..so what is the best thing to do

Hello there,

I wouldn't worry that much, at the end of the day, they can't prevent you to enter the UK, as long your husband is in the UK and you are meant to join him and you have an ongoing application and your COA.

in the visa uk website, it says somewhere in family permit, when you are going to visit your husband for 3 months, they don't require the family permit visa. obviously they do what they consider right for them

But you have everything, your ongoing application, your COA, and your husband is in UK. and you have a real urgency to travel and to probe when you are come back.

once you are in your country then you could apply for the family permit if it gives you time to, so I would take all the necessary documents just in case, but I think it can be prescindible.

It depends somewhat on your citizenship. If you do not require a visa to travel to the UK, e.g. if you are a citizen of Japan or Canada, then it is pretty straight forward.

If you are travelling with your EU citizen spouse in Europe then there are also options outlined in https://eumovement.wordpress.com/2010/0 ... to-travel/ The problem is that this can be a stressful way to travel and getting past the airline is often the hardest part.

i will be travelling from london to ghana and back by air. my husband will be here in london

The problem will be in convincing the airline in Ghana to let you on without the visa. I would probably not risk it.

How about yours? am not sure about allocating to case worker, maybe they serve on first comes first served basis am not sure
I applied on 5th of January 2010 and received the COA on 19th of January. On my COA, there is no Case ID number. There is only "our Ref:..."

I have been a following disciple on this board:
EE1/EE2 submitted 11th March
Received by HO on 12th March
COA issued dated 28th March
Case ID No on COA
No other Ref No
Now we're on count down mode

The question is; What are the differences in a COA given the following scenarios I have observed here:
1. COA with a Ref No (No Case ID)
2. COA with a Case ID (No Ref No)
3. COA with a Ref No & Case ID

Does any of the above have any meaning to issuance of RC?

Need new passport - must I reapply for EEA2?

I am the lucky holder of an Residence Card, issued in August 2009 following a nine-month wait and extended wrangling with the UKBA.

However, my passport is now almost full and I need a new one. I had wanted to submit a brand new passport to the UKBA last year to avoid this problem, but seeing as they were literally about to throw out my application and throw me out of the country, I had no option but to urgently submit my almost full passport.

Over the last 18 months I have settled into life in the UK with my EU husband, and I have a nice full time job. However I have to travel a lot with work, and this is going to create some problems for me as I have an important combined work and personal trip overseas in two months' time. I just got back from O/S and have this 2-month window to try and get a new passport and new RC. The passport should take only a few days; the RC is the big problem.

I really really do not want to go through the long, drawn out and nerve wracking EEA2 process again, and especially not with only two months before going O/S again. (I'm planning on submitting passports and then almost immediately requesting them back again for urgent travel). Can anyone advise:

1) Does it take just as long to reapply for a new RC on a new passport as it does to get the original RC?

2) If I arrive at the airport with my husband, on a new passport that does not contain the RC, but carrying my outdated (and now invalid) passport with my previous RC, our marriage certificate and current work contracts, will this in anyway convince the UKBA officials to let me in? I will not have time to apply for a Family Permit while overseas and will be travelling from Australia, so I will not have any form of Entry Clearance in my passport.

Hi, aussiegirl -- I haven't got my RC yet but with my previous working visa, I was in a similar scenario: my working visa was on my expired passport and not transferred to my new passport -- I carried both of my passports to travel every time and didn't meet any problem. When I applied a schegen visa, I also provided both of my passports. So for the Residence card, I presume it would be the same.

I read a posted story about transferring a residence card to the new passport, it took around 4 months. But I don't know whether it would be fine to give both passports when they are requested like when applying a residence card.

Hi all, just for the statistics:

EE1/EE2 submitted 19/07/10. Together with the form we also sent a letter to request our passports back because we needed to travel in September.
Received by HO 20/07/10
Passports arrived back 06/08/10
COA arrived 07/08/10, dated 03/08/10
No ref number, only Case ID number in the COA
