I am an Indian living with my husband in UK with EEA family permit as my husband is a French National.

I applied for my residence permit EEA2 (Family member residence stamp) in Sept 2008 at Home Office - UK. And its now nealry six months, we have Certificate of Application from Home Office.

I have requested Home Office to send our passport back as we have to make an urgent travel to India. Home Office confirmed our application for EEA2 is not canceled, they will demand our passport after our travel when they need to process the application further.

My problem is that my original Visa expired in NOV 2008. As my initial EEA Family Permit valid for 6 months, issued at Chennai. We have applied for EEA2 Residence Stamp when my visa was valid. And i have Home Office COA (Certificate of Application).

So, to enter into UK from India. do i need to get Spouse Visa (EEA Family Permit) again in India from British Embassy?

Can i apply for EEA Family Permit when my EEA2 is pending in UK?

or do i need to cancel the EEA2 when i receive my passport from HO?

Hi ,

we are still waiting for contact . But even that i feel better becuase we get some sight from HO after 9 months -:) If nothing happen during the next 2 weeks im gonna complain again. I will let u know if HO contact us.

hi guys
i just recieved a call from my solicitor that i shouldn't complain now, she said that by law i should allow the home office for 3 monthes from the last time they have asked for more decuments, which means i have to wait untie 14march when it's going to be 9 months and 2 weeks from first application.
i don't believe it, but i'm not sure ,even she doesn't know about the law well but she still a"solicitor".
anybody has an idea about that?

the laws that I know (http://www.opsi.gov.uk/si/si2006/20061003.htm#17 and the European Casework Instructions) don't mention anything that the HO should get a three months extra by asking for more documents. A residence card should be issued not later than six months from the date of application (which is confirmed in your Certificate of Application). Furthermore the Home Office have a habit of asking for lots of documents that are not required by law.
It is outrageous to expect people to be without passport for more than a month anyway!

you're right, i'm going to complain by my self as the solicitor refuses to do it . thanks

To pdykid - You need to travel to India and apply for a new EEA Permit. This should be the same as your first EEA permit application. Don't thik that it will be easier this time so you can afford to make a weaker application.

Your EEA2 Residence Card application will still continue to be active and when its your turn, someone from Home Office will write to you and ask for your passport (and updated other info) back. Remember you should NOT send your passport to home office unless someone from home office asks and keep in minnd that it could be a few months before that happens.

Hello, I am new joinner of this forum.
Just wanted to inform everybody that my application has now been activated after 10months! My EEA2 history is below:

We applied EEA1 and EEA2, 28 May 2008.
Got COA, 24 Jul 2008.
My husband got EEA1, 26 Nov 2008.
I got my passport back for traveling, 7 Dec 2008.
Came back to the UK without EEA family permit, 2 Jan 2009.
Emailed complain letter, 24 Feb 2009.
Got a reply via email, 25 Feb 2009.
Got a letter from HO which apologises the delay, 2 Mar 2009.
Got a letter form HO to send my passport and additional documents, 6 Mar 2009.

I haven't sent my passport yet as a letter from my husband company is not ready. Anyway, please let me take this oppotunity to say THANK YOU ALL on this forum as if I didn't read your post I wouldn't complain and I would have been still waiting a contact from HO.

Finally, do not give up complaining, it will definitely work!

Hi , we are in same situation as yours . I am indian married to french , applied for eea2 end sept 2008 still no news of RC . We want to travel to india while our EEA2 is waiting consideration . Can you please confirm the documents and procedures required to apply for eea family visa from india , many thanks in advance

Congratulation edro and Basia!!

Now at the same time it makes me a bit worried, as I applied the 19th of May, we recieved a letter asking for more documents after 9 months and sent those documents, and now it's more than 10 months and havetn heard anything form them.

d HO r crazy, my appl is over 11 months they have nt even requested 4 add docs. i complain just told me day will get in touch.

Hi nav_007

applying Family permit in India, its always easy thru VFS global service. With all required documents.

http://vfs-uk.co.in/
get a appointment with vfs for submitting application. you can do it by mail by sending your passport number and preferred date and time and center.

download VAF5 application form

in covering letter tell them that you have applied for EEA2.
marriage certificate, if any
salary slips of last few months
letter from employer
bank statements last few months
if the the EU national not traveling with you, have a copy of his/her passport or national id card
Biometrics will be done at VFS center itself immediately after submitting application.
In case the applicant is female, ask her not to cover both hand palm with henna/mehndi (the red color design). VFS will not accept as it affects fingerprint.


VFS may ask 200/rupees for currier charge and FP is free of cost.
or you can collect from the center itself.
you may receive within 4 to 5 days... if its a clean application.

so no worries in applying FP...from India
