Hanaali wrote:Hi all,

I am very new to this forum and will appreciate positive feedbacks please. Below are the recap of my journey;

Came to UK in 2006 after my EEA Uncle who arrived in 2005.
I am an Extended Family Member of an EEA National and lived with him before moved
Both myself and wife applied for EEA 2 in 2008 and RCs were granted in 2009
I have being in work since 2008 till date I.e. Registered Self Employments (2008-till date) for myself and Wife with Tax Returns completed every year, PAYE Employment for myself and I am on a good salary since 2009 when RCs were received till date.
I now have 3 Children all born in UK, own over £200,000 Property
Since August this year, I have been unable to contact my uncle because he has moved out of UK
Solicitor advised that EEA4 (Retained Right of Residence) due to departure of my a Uncle from UK
EEA4 submitted on Nov.5th 2014
HO received EEA4 on the 6th Nov.2014
CC debited with full money for the family on 7th Nov.2014 & receipt received on 14/11/2014.
COA dated 25th Nov.2014 was received on 27th Nov.2014. (My COA and that of my wife read 'Employment can not be confirmed because we did not submit all original documents of evidence of my sponsor exercising Treaty rights' while my children COAs mentioned insufficient original Treaty rights documents and proof of their relationship with EEA sponsor were not submitted despite that they are my children and long and short birth certificates were submitted.
Email was also sent to me on the 26th Nov.2014 confirmed that our applications are being considered and that it may take upto 6 months.

Followings were some of the documents submitted with EEA4 Form;
Sworn Affidavit in reference to Reg.10 (5c and 5d(iv); 6a and 6b), Reg.15 (1 f(i) and f(ii) having satisfied Reg.7(3), Reg.6(1b,c and e) and Reg.8(4 and 6); EC Work Instruction Chapter 2 (s.7.1a and 7.1c) and Chapter 6 (s.2 and 6.2 Completion of 5 Years Residence after ror).
5 Years a Employment Payslips, P60s, HMRC Tax Returns, NI Contribution were submitted
UK Land Registry Documents, Mortgage Statement and Bank Statements
5 Years Council Tax Bills, TV Licence, Utility Bills, Education Records (children and my OU Degree Results Statement, Pension Documents, EHIC Cards for all the family
Birth Certificates, Marriage Certificates including those of my children and that of my late mother who was related to Uncle.

My Questions are;
Although I am an Extended Family Member of EEA, Why COA with unconfirmed right to work and does it have any implication on my current work?
Can I request for a revised COA? Please note that they said that they will not revisit the term of the COA while my Application is being considered.
Having applied through ROR where my 5 Years Employment should be regarded as Treaty Rights, why quoted in the COA that I have not submitted all original Treaty Exercise Documents of my Sponsor who I have already informed that he has left UK
Having submitted all my children's BCs (Long and Short), why quoted in their COAs that proof of their relationship with EEA National were not all submitted.
How Long can it take HO before issuing PR please?
In 2012, I appealed against refusal to grant my mother in law a visiting visa and the appeal was granted and Visa issued. Could this have any impact?

Please advise

Thanks

Just an update regarding our EEA3/4 application

We were called for an interview after requesting to prioritise
PR applications.
Were invited for interview which was held today.
About 90 questions asked from both of us, got couple of questions mixed up but everything else went smoothly.
Got the interview printed once we were done and noticed a couple of typing mistakes, a lots of spelling errors etc.

For example earning I told them 700/800 per month and she typed 700/800 per week and then 180/200 per week!!
But obviously interview was audio recorded so I hope caseworker may hear the tape to rectify/clear the misunderstanding.
Overall very confident. May hear something in a week or two.
Special thanks to Chaoclive who answered every query.

Will keep you lot updated.

Hi there,

Lady said she called to ask if she could issue little one Registration Certificate as he did not qualify for PR yet and will qualify in jan 2015 when he tirns five.
We said thats fine and asked about our applications which she said were granted and sending a these to mail room.
We should recieve those by next week.
Hopefully I understood her good!!! Still can't believe
it.will update you once post comes through.

Hi everyone
We applied EEA4 &EEA3 on 22th Sept 2014 and received a call this morning from HO.
My husband was sleeping and his phone was off. They called from my mobile and asked for my husband.
I woke him up and at the same time my little one started crying really loudly :x :x
We couldn't hear anything and what i understand they refused my husband EEA3 application and gave me 5years visa again but i am not sure :!: i called the HO again and asked what was phone call about. The officer said there was no recorded phone call and the application is still in progress. I don't know what to do :(

P.S something wrong with private messages , i can not read them, sorry..

Out of curiosity - what did the process of applying for priority treatment look like in your case? Did you phone them, send them a letter, email? How did they let you know it was granted?

Hi,

Thanks. My mother in law was poorly so sent an email to Linda Bateman asking for priority treatment quoting sections from :
https://www.gov.uk/government/uploads/s ... pter10.pdf

She asked for doctor's letter which we provided.
After a week were informed that they will give application on priority treatment but we could be invited for interview.
After few days received invitation for interview which was conducted on 02 Dec 2014.
Last week Thu. recieved phone call from case worker informing of decision and documents would be posted.

Today recieved everything.

Thanks

good luck to all who got their PR.
does it take 2 months after requesting priority ??!!!!!
how slow HO can get, they for sure require more staff

I applied in August and still waiting, max is 6 months but it feels like forever especially if you want to travel during holiday period
very frustrating and annoying

Hi there,

I could not tell you whether it would take 2 momths after requesting priority.
I guess it would depend on your personal circumstances.

Have a read here https://www.gov.uk/government/uploads/s ... pter10.pdf

Hi everyone,

I'm really new at this, this is my very first time to join and post something in a forum. Have been reading most of the messages on this thread and I felt hopeful that maybe someone can shed some light on my situation.

I've submitted my eea4 application just last nov 29, and checking on royal mail tracking its said to be received last dec 2. I've seen some posts saying they've received a reference letter/COA regarding their application, but up to today I have not received anything about my application. I am a little worried as my previous residence document is going to run out soon. I know I should have applied maybe a month earlier but due to unforseen circumstances I wasn't able to do so. I don't really know what to do, kept trying to look online for a contact number to call or email regarding my application but cannot seem to find one. It might be too early but I'd rather find out now than later if maybe I've some documents lacking or I made a mistake on the application.

Can anyone please advise me on what should I do next. Many thanks in advance.

Thank you so much newuser2 & uk2005 for the reassurance.

I think I will have to try and call them. I dont really have the luxury of time to wait until Feb for the new residence permit. I thought it was 15 working days for the processing. My permit is going to run out this month, my work had even said they might have to let me go if the new one does not come before expiration of my current one. I dont know what my status would be if my current one runs out and I haven't received my new one soon.

Sorry different topic but if anyone knows how it works with keeping work please help. Thanks.

I am in the same position as you, my employer said that if I don't produce new valid visa they will terminate my contract immediately. But after 1 week I received COA letter which proves that you are legally allowed to work or do a business in the UK.
You should receive a acknowledgement letter first and followed by COA - Certificate of Application.
I applied on 28th August and still waiting, I called them twice and they said my application is under consideration !
