Got COA on 15/10/10.
Heard nothing since. Tried to call them but can never get through on the number ending 5200. Most of you seem to have managed to speak to someone. Any other number you guys have been calling?! please advise.
Many thanks

Hi, called HO yesterday and was told still with a case worker, I then told them abt my employer asking for my PR and was told still within the time limit as I applied 04/08/10 (second application), so I insisted that a note be put on their system saying my employer urgently needs a confirmation of my status asap as this application has been on for more than 2 yrs, so do not want it to exceed the time limit for any reason. This was done, I even called later to confirm from another adviser. So the waiting continues.......

Try just after 9am or 4:45pm. Apart from these times it is just impossible to speak with the HO. Good luck!

@ Lisus -Congrats! Must feel great after all this time. By the way, what's the exp. date on your PR (if any)?
@ easy77- if you got them to put a note on your file that should get things moving. They might speed up the process just so that you don't call them any more. Just try not to let the whole waiting thing bring you down, you are getting there.

Hi ChelseaM,Thanks. The expire date in all PR are 10 years but of course I wont wait for this as I'm already planning to apply for BC. So we all can meet in the forum of BC and suffer a little bit more together (lol). Best of luck!

Hi Guys! Called HO today at 11.45 am,waited 15 min on hold but got through, spoke to a nice lady who told me application is in the final stage, decision made today. Should receive it in up to 4 weeks. Told to call back in 2 weeks if not received. Thus:
Application made:01/10/10
COA received on 15/10/10
Decision made +final stage:13/01/11
Many thanks for the priceless info guys, very happy I've called.
Looks like they really did improve the processing times.
I never enclosed a prepaid postage envelope. Will this delay the process? or should I just send it now? Many thanks to all of you and good luck!

@ noble72uk , Mary1, Lisus, easy77
Thanks guys and Congratulations to those of you who got your PR soon. It’s a bit of relief…Looking for holidays
@ easy77
Don’t wory; you will get your PR soon .Sometimes when HO says your case is with a case worker, there were people in this forum, who had the PR already stamped.
@chelseaM,
I enclosed a prepaid postage envelope, but HO never used it; they sent the parcel with 2nd class stamp.

Next step BC…

EEA4 Application for Residence Permit

Post by lourrans » Fri Jan 14, 2011 10:23 am

Hi All

I am new to the site and could really use some help.

my wife is portuguese and we have been married for 5 years now.
i intend to apply for Residence Permit ( EEA4 form ) next month.
we have a 4 year old kid
just realised that she gets tax credits ( i think as a single mom ).
would that affect my application based on the fact that she is my sponsor?
and if it does, how bad is it? and how can i fix it?

really appreciate all help with this matter..

Form EEA4 is for a permanent residence card.

Tax credits must be applied for jointly. If she is really receiving money as a single mum that may actually be benefit fraud. I guess you will have to resolve this issue first with HMRC.

EEA4 Application for Residence Permit

Post by lourrans » Fri Jan 14, 2011 12:24 pm

hi

Thank you for your repply.

whats the worst that could happen regarding the tax credits, she didnt do it intentionally. because i am not entitled to public funds ( i think ) she dind put me in the application.

whats the best way to sort it out? and how could it affect my application for residency?

thanks

You really have to read what I have written above. The application form for tax credits clearly asks for the partner's data and their immigration status. By not putting you in she declared that she is a single mother which is obviously wrong (and may be construed as fraud, I think). You both are actually entitled to tax credits. The worst that obviously could happen is that she ends up in front of a judge. Contact HMRC as soon as possible and see how you can work that out with them.

I suggest to be a little bit more careful giving such advice. They would have been perfectly ok applying for tax credits (and receiving them under certain conditions) if it had been a joint application. The problem is that the wife has claimed as a single mum which probably means that she has received more money than what she was actually entitled to. Whether that could be construed as unreasonable burden to the state or not I do not know but I still think that the falsely made claim should be first sorted out with HMRC.

Hi lourrans,
Your situation is complicated...You might be in need of professional advise. If I were you I'd go and see a good immigration advisor, probably even 2 to get a 2nd oppinion. Most of them don't charge you for advice, you only need to pay if they file an application on your behalf. At least you'll know what to do next.Best of luck!

[quote="easy77"]Hi,easy77! Sorry to hear that. do you have any special circomstances that might delay your application processing? An immigration advisor told me that sometimes if the documents submitted as evidence are not clear enough(for example, they don't cover the complete period of 5 years, or there are other 'gaps' in the them, such as dates don't match with employer refferences or you have a record of offence which may effect your application etc) they need to verify and check with 3rd parties and this can take a while. And they can't proceed until they've verified. Also if you have previously made an application which has been denied they might look at this too. Have you applied more than 6 month ago? if not, and they are still within their time frame, they might not give you any updates untill you get to the final stage. I know how stressful this is but all you can do is wait. Best of luck and keep us updated!

Hi, its less than 6 mths as I applied in august 2010, had a complicated previous application as did not have proof that ex spuse exercised treaty rights, but she now cooperates with me and gave me the needed document which I included in the application.
