Hi all,

US citizen having been resident here since 2009. First non-biometric residence card expired in 2014, but had to apply for another 5-year non-biometric card since I had been in France for a year with my partner. My partner is an Irish citizen and we're living in Northern Ireland (yes he's from the RoI exercising EU rights in the UK technically). He isn't required to register with the EU settlement scheme so I don't have an application to tie mine to, but here's my timeline so far:

21 November - applied for settled status based on 5+ years of continuous residence. They needed a few extra proofs of residence from a number of years (oddly they needed 2013?) and submitted those. Completed the application and immediately booked a biometrics appointment for 25 November

25 November - biometrics completed and submitted.

As of today, still waiting to hear anything. No correspondence whatsoever yet after two weeks.
And as if the Home Office were watching this board, I received an email with my CoA this morning :P
Now just to wait for my biometric card!

Hi all,

Still no updates on my end:

Application 4th of November
Biometrics 5th of November
COA 6th of November
Decision: Still waiting...

It's over a month now, any suggestions if you can escalate this?

Non EU family member. My partner is eu but has not applied. We got married in 2014 and got my RC 5 years in March 2015.

Timeline
Application on 21st Oct
Biometric 23rd Oct
CoA 24th Oct

Evidence of five year provided during application for both myself and partner together with partner’s ID and marriage certificate plus my RC copy, I also provided additional ( council tax of 5 years) after one month of waiting without any news . Called them on the same day in November and they said a caseworker who has been assigned to my case will look at the information provided. Note that I provided the additional info on my own without any request from H O.

Have called the EU centre a total of 3 times from 22nd Nov and they said everything looks fine that I should wait for my decision. Been waiting since then and no news. Keep checking my email every minute and nothing yet.. guess I just have to keep hoping

Will be interesting to see if you get Settled Status as your 5 year anniversary of your RC would be in March 2020. Did you have a family permit before March 2015?

I guess if you were living in the UK with another (non-EAA visa) the automated checks of NiNo would have confirmed your residency over 5 years but caseworkers will check if this was 'relevant' time.

Hope you hear soon.

@Magus1984, was on a student visa from 2010 to September 2014 and applied for EU family member prior to the expiration of the student visa. The actual RC was issued in March 2015. My marriage is already more than 5years, so going by the time of marriage, I already have the 5 years. I’ve seen a lot of people say it’s either 5years of marriage or RC.

If they are dealing with applications around 19th Oct to 25th Oct, then I believe my should be in line too. Unless non eu members are facing much delay. The Oct backlog should include me, hopefully I receive good news soon

Can members please refrain from posting low value posts such as "any updates". When members have an update, I am sure they will post one. It is not necessary to post "any updates" on a daily basis.

Just out of curiosity, will the scenario below qualify for settled status?

Non EU family member
Married 2012
RC granted 2016 after a long battle with the HO.
Pre settled status granted June 2019

Since I’ve been married since 2012 and been living with my EU wife all this time (7 years) don’t I qualify for settled status although I’ve not fully covered 5 years on the RC?

Thanks
It's incorrect .. You should ask for ADMINISTRATIVE REVIEW

https://www.gov.uk/guidance/eu-settleme ... ive-review

I re-applied and got Settled status 2 weeks after. This is almost 4 weeks ago ... Thanks

RSL LAW WEBSITE STATES THAT

Paragraph EU16(a) of Appendix EU to the Immigration Rules states that an application for settled or pre-settled status can be refused where:

In relation to the application and whether or not to the applicant’s knowledge, false or misleading information, representations or documents have been submitted (including false or misleading information submitted to any person to obtain a document used in support of the application); and the information, representation or documentation is material to the decision whether or not to grant the applicant indefinite leave to remain or limited leave to remain under this Appendix.

Failure to disclose criminal offending would therefore potentially trigger a refusal on the grounds of deception. It is far from clear whether accidental non-disclosure would trigger a refusal but it is likely it would depend on the circumstances. For example, failure to disclose an old driving conviction whether there was no sentence of imprisonment might be accepted as accidental but failure to disclose an assault conviction might not be.

Where a refusal on this basis is contemplated, official policy is to make further inquiries of the applicant and/or relevant third parties or to invite them to an interview.

A proportionality assessment is also to be made prior to a refusal, including consideration of the seriousness of the deception, whether the applicant was aware and the impact on the applicant and family members of a refusal.

My two siblings applied for Pre EUSS on 01/12/2019. They are both none eu under 21.

They received their COA yesterday there is no mention of work permitted or not, can some one tell me where and how to check if they have been granted right to work?

We tried to check it online where you get a code and share with employer but it’s not working.

Thanks

I can be wront but I don't think COA issued under the EU Settlement scheme give you the right to work as other COAs under other type of immigration applications.

Mine stated this:

This certificate of application confirms receipt of your valid application under the EU Settlement Scheme. You will receive a decision shortly.

You can continue to rely on any rights you have as an EEA or Swiss citizen, or as the family member of an EEA or Swiss citizen.

Which means I can rely on rights I had (such as my current residence card as family member of an EEA citizen)

I am non EU and my partner is EU. We have live together for two years and done civil partnership in France.
But he has got his decision within two weeks and I have been waiting for more than a month.
I have just got an offer from my dream job but without this I can't process my job application and I might need to turn it down due to this. I am currently under Tier 4 student visa and I don't know if I should continue with this or just give up hope with EU Settlement Scheme and try other ways.

This is my timeline:

Application 25th of October
Biometrics 4th of November
COA 6th of November
Case escalated: 9th of December (not sure if it's true though)

Your application is likely to take longer than a month to process as you’re a non-EEA citizen and applied based on a relationship you haven’t relied on in a previous application to the Home Office. (As you have a Tier 4 student visa)

Your other option would be to apply for a residence card as family member of a EEA citizen exercising treaty rights in the UK but those applications can take up to 6 months. Your best bet is probably to wait for the settlement scheme...

The guru kamoe summarized the key differences of these two routes here: eea-route-applications/eea-rc-pr-vs-pre ... 81827.html

Have they asked you to provide any more information? In your view is your case complicated? What visa did you have when you applied? waiting that long is not the norm

It has been four months for me today since I had biometrics. Got COA after 6 weeks of submission Called the resolution centre this week for the second time and I was told the case worker is making manual checks as my NI didnt read automatically on the documents I submitted that I have nothing to worry about. I really wonder how long it takes to do these checks as every document i submitted is from UK. My COA states I can continue to rely on my previous status being my resident card. So fingers crossed, I hear from them soon. The waiting game is ridiculous.

Congrats! I suppose she applied as the Non-EU family member (spouse) of your son?
Rather than applying as your Daughter in law?

Out of curiosity which status was she granted settled or pre-settled?

I got my COA on 31st Oct and still waiting.
