Yes it does say that if you do not hold a valid BRC, you should receive one within 10 days of the date of the decision letter.
I'm still waiting for mine

As you know the HO will treat all cases in individual bases!
What I can tell you is that from my experience, chasing your case up is always a good idea.
I have been chasing my case almost from the get go with many many calls to the resolution centre, MP letters and finally a written complaint. Perhaps the complaint provoked the HO to look into my case and grant me my status, which I am entitled to.

Perhaps it might be a good idea to complain to the HO if you have been waiting for long.

Just remember that they have kept me waiting for 1.5 years!!!
Hopefully they wont do this to you

I got my Settled Status decision letter on 20th October 2020. In the decision letter it says that I should receive my BRP within 10 days. I have not received it yet.

Thanks that’s odd cause it doesn’t say anything in my letter about 10 days only section that mentions anything related to this is:

“If you have EU law rights, until 30 June 2021 you can continue to demonstrate your eligibility to work and access benefits and services as you do now using your existing valid biometric residence card, or with the new card you will receive if you do not already have one. There is no requirement to demonstrate your settled status until 1 July 2021.
If you do not have EU law rights, you can demonstrate your eligibility to work and access benefits and services using your new biometric residence card.”

Will need to wait I guess for 10 working days if not will need to contact Home office to ask why no card for me.

I just got my pre-settled status today and I am sharing my timeline to give some hope to everyone worried about the long waiting times.
I arrived in the UK in September on EUSS Family Permit.

Applied for pre-settled: 29 September 2020
Biometric appointment: 22 October 2020
COA: 22 October 2020
Pre-settled status granted: 29 October 2020
BRC: Waiting for it

Refusal for Online Application: 16 March 2020
Applied "Chen" Paper Application: 3rd January 2020
Settled status letter: 20th October 2020
BRC Arrived: 29th October 2020.

Officially they will reply in 20 working days but I got my decision exactly after 3 weeks of complaint .i also make phone call the day I got decision and make humble request to the person who answered my phone . I told her to pass my message to the case worker that I am extremely worried and stressed because of the whole situation.if he can make any decision I will appreciate.
Believe me after 2 hours I had email from case worker with good news.
I think my phone call also help me !!

Thank you very much for the link! I have just submitted my complaint, hopefully they will finally review my application. As I was planning to travel this winter, but apparently the existing card won't be valid from January after Brexit.

Do you guys know, whether I can apply for citizenship after Brexit? I am non eu family member living here for more than 6 years, my husband has got his British citizenship last year.

I believe you can apply for citizenship once you get your card on the basis that your husband is British citizen. I also think you don’t need to wait another year after getting your settle status and you can apply for British Citizenship.
But better to consult with someone else to get another opinion.

Background: NZ citizend with EU (Republic of Ireland) husband. Applied for pre-settled status for my parents (both NZ citizens). Both husband and I had pre-settled status.

Application submitted for both: 19/09/2020
Biometrics submitted for both: 20/10/2020
COA for both: 21/10/2020
Pre-Settled Status approved: 23/10/2020 (mum)
Dad's pre-settled status: pending

Our experience is that, if you have a straight forward case it's generally quite quick. However, it does depend on which case worker your application gets allocated to. For example I had given the official English version of my Birth Certificate (original copy issued by the issuing authority). This was good enough as it was for my mother's application. However, the case worker dealing with my dad's application wanted to see the original Sinhalese version because the English version had a "Translation" stamp on it. This was not easy for me to come by so an explanation and the fact that my mother's application was approved was enough for their QA team to waive the application through based on the English version.

SETTLED RECEIVED 10.11.2020
it was retain rights application no additional documents. this form was very help from making my first application for eea residence card to Seattle status .

Hi , did you apply for retention rights online or you had previously and applied for Pre-settle ?

i had pre settle before which i got last year.never applied for retain rights. my pre settle was was as family member of eu national
