As a joining family member who applied for facilitation before the end of the transitional period, you clearly ought to qualify.

They are simply saying rubbish.

You are entitled to challenge them under the withdrawal agreement itself.

I really appreciate your reply obie thanks for that. I will surely challenge them

Hi Everyone,

Here is my time line:
Applied pre-settled on 30/6/2021 (Literally on deadline)
Biometrics given on 24/7/2021
CoA - Nothing
Decision - No yet

I know it might take much longer but I was really worried about my application will be refused because the date on my civil partnership certificate. On GOV website I can see the relationship should starts before 31 Dec 2020. We have been together for more than 2 years but we don't have any official documents to prove we are living together. The only proof of our relationship is the civil partnership certificate issued on 24 June 2021.

We are both in the UK before 31 Dec 2020 and my EEA Spouse has been granted pre-settled about 2 years ago.

Anyone had a similar case and could you give me some advice please xxx

This is my mum’s EUSS Settlement application timeline.
Date of application: 12/05/2021 (3 days after arriving on the EUSS Family Permit visa).
Eligibility: Dependent parent of a spouse of an eligible person of Northern Ireland.
Nationality: NON EU
Biometrics: 02/06/2021
COA: 8/06/2021.
And we have heard nothing since then 😟. Not even request of any additional documents should they need any.
I’ve provided all documents except for the one proving my mum’s residence in the UK since her arrival as we simply had to gather some).
As soon as she arrived we registered her with the GP, open her a bank account and now she’s got quite a bit of evidences proving her residency here. There’s still an option opened to upload more documents but I’m scared to do something without Case worker first asking for it.
What would you suggest ? Shall I add more now or just wait for them to contact us first?
I sent an application status update to the EU Resolution centre yesterday , let’s hope they’ll come back with something 🤞.

Hi,

Can anyone help with getting insight if my visa application could be granted status?

Current visa type : ICT long term ending in first week of September (5 Years total)
New visa type applied : EU settlement scheme under non married durable partner 9 June
BRP done on 5 July
Certificate of Application received 28 July
Waiting on decision..

My partner is non-EU/non-UK too however he has got his EU settled status last year 2020 and went through divorce start of this year 2021

Our relationship is durable for past 4 years and I have submitted joint back account statement and all other address proof to prove our relationship. Do I have retained or derived rights in this case and could be granted a status under EU settlement scheme I have applied?

My work visa is expiring start of next month September and have very less time to decide what to do. Appreciate all help in this forum. Many Thanks xx

A non EU partner cannot sponsor a non EU partner under the EU settlement scheme. Only an EU citizen can sponsor a partner.

Your application is highly likely to be refused as you don't qualify for pre-settled status as the partner of a non EU citizen.

You have to apply for the more expensive unmarried partner visa under Appendix FM of the immigration rules.

Thanks for your reply.

Can I check one more thing if I go with expensive unmarried partner visa option under appendix FM.

My partner got divorce with ex-partner start of this year however we have been living together since past 4 years. Does period of stay together for 2 years will be counted only after his divorce or since we living together for past 4 years should be sufficient?

Hi Everyone,
I'm about to apply for the settlement scheme after having received the Family Permit in my passport as a non-EU. Has anyone applied for pre-settled status recently, and if so, have you been asked to send in your passport by post for verification, or bring your document directly to the biometrics appointment to be scanned?

Hi,
We applied for my mom’s pre settled status back in May 2021 after she arrived on EUSS FP too.
Since you’re a NON-EU national they will require that you attend a biometrics appointment again where you’ll provide all your documents including a passport in person. So, you won’t get an option of sending anything by post.
We weren’t sure ourselves either before her application but once you’ve done your online application it’ll tell you exactly what you need to do.
Hope it helps.

No problem at all! It took 3 weeks between the submission and her biometrics appointment but it all depends whether there’s availability in your area for biometrics to be booked quicker. And we also had to pay for it as there were no free appointments available. I waited for a couple of days hoping I could get one but at the end I just paid for it. It was around £70 and it was the cheapest one I could get.
You might be luckier than us to get a free one 🤞 .

Anyone else who applied in the last few days before the deadline has got the COA please??
