Finally they made a decision on my mom’s visa, after a month!
They sent an email saying that her passport was sent to her.
Does anyone know when they don’t send an email with the refusal means it has been approved?

Hello does anyone know if you need to apply for the EU Settlement Scheme Family Permit for both Parents in-law separately?

Thank you, one more thing, I am also in the same case, I just applied to the EU Settlement Scheme as a non-EU Citizen Spouse, and I also want to have my non-EU citizen parents join our family, do you think it is better to wait until I obtain Pre-Settled Status (my EU Spouse has already obtained pre-settled Status), and then have my parents apply for the EUSS Family Permit or have them apply now?

in this particular case, your EU spouse will be sponsor of her/his in laws (your parents). Your parents can apply for eu settlement scheme family permit straight away ,they don't need to wait for your settled status outcome.

For this type of permit you don't need to provide financial evidence for them being dependent, right? Because I have seen that there are 2 choices between EEA Family Permit and this one but this looks easier to obtain in my opinion.

That is true. In this type of applications dependency is assumed. You don't need to provide proof of financial support.

What about my family’s financial circumstances, is it required to post any bank statement or a payslip just like the EEA Family Permit requires to?

And will having the EUSS Family Permit lead to a successful application to the EU Settlement Scheme for Pre-Settled Status just like I am obtaining right now? Because I read on the gov website about it but I am not sure if that also applies to EU Nationals who don’t have permanent residence and have Pre-Settled.

You can send any documentary proof to HO which can be helpful in your parents applications included any remittances sent to them. If they are granted eu settlement scheme family permit in their country of origin and they come to UK they will be able to apply for pre settlement straight away.

Thanks guys for the great info provided so far. So guys does it mean I only provide copies of my passport as non eu and my partner's passport who is the EU citizen and proof relationship and no other document since dependency is assumed? Does she need to supply any document on her own? Please guys I'd be glad if someone helps with this question.

Thanks everyone

The mother in law is not a dependent parent.

Under the EU Scheme, the EEA card is a must unless the person is dispensed from having it in first place.

A family member of an EEA citizen (such as non-EEA wife) are not required to get an EEA card. As long as they live with and/or are depend of an EEA citizen exercising Treaty Right, they are - at least in theory - not even required to apply for an EEA card. The application for that card is not compulsory but recommended to demonstrate their rights under EEA.

For extended family members, the EEA card is compulsory. Their rights start when this card is delivered only.

Mother in law is EFM under EEA route. It means without her obtaining first an EEA card by EFM application, she doesn't have any right under EEA regulations. That means she cannot go through the EU Settlement Scheme.
Hi with due respect im disagreed with your reply because my mother in law got family permit from Pakistan under EU settlement scheme in September 2019 and she came and got the 5 years pre settled residence card (BRC). So it is assumed parents from both side are dependent. Thanks
please I am trying to apply for my father . please can you list the requirements and the list of documents you provided. I am an eu citizen trying to apply for a non eu father. thanks

Hey,

My partner and I were granted with pre status through the eu settlement scheme(I’m holding a italian passport and he is brazilian).
I will try to get a family permit visa to my mother in law via EU Settlement Scheme, but I’m worried that they will ask for prove of dependency, which we don’t have it.
Some people are saying that through EU Settlement Scheme we are not required to prove that we are sending money, because dependency is assumed.
Have anyone applied and got it without sending prove of dependency or the home office still asking for it?
Many thanks 🙏

U didn't tell us what was the outcome for your parent application thank you
