Actually, yes, that's the case. Background here, where she already had a clear answer of why she could not count years pre-marriage and during non-EEA RC cohabitation towards the 5 years for Settled Status.

Hi guys,

Thank you for boldly sharing the information. The RC and FP your guys are talking about seem like a warning sign on my case.

At a glance at my process timeline:

· Application submitted: 06 March 2021
· Biometric submitted: 12 March 2021
· Certificate of Application received: 19 May 2021
· Decision: awaiting

About the evidence I submitted, I used the tenancy agreement, correspondence, bills, and flight tickets.

A little bit about me, I am a non-EEA and entered the UK by holding a Tier 2 on 12 December 2020. Also, my Irish partner came with me on the same date. We have been living together for approximately 15 months in the Republic of Ireland by 31 December 2020 and we are still living together in the UK. Then what happened in January this year completely changed my situation, what happened was my employer was no longer in a position to sponsor my visa and I was told to leave and my visa will be curtailed. Since then both myself and my partner explored possibilities to help me stay and one day we were told to apply for EUSS. We both applied for EUSS in March 2021. In short, I am waiting for my EUSS pre-settled decision and curtailment letter from HO.

Here is my concern: For the applicants who applied for EU Settlement Scheme (EUSS) this year, is it compulsory to provide EEA documents should their application rely on the relationship with the unmarried (durable) partner? In other words, does the RC/FP required for my application? The RC can no longer apply for and the only option I have is the EUSS FP if I am required to do so.

Any thoughts on my situation are much appreciated.

As far as I have been able to tell, there does not seem to be a clear-cut answer to this. Read this post.

Obviously, as soon as you have an outcome on your application, your input will be much appreciated in this post, were I am trying to collect first-hand experiences of your exact situation.

In future, please start your own topic. Do not tag alone someone else's. It will not only stop deviating from the OP's original question, but it will also be more effective for yourself: it will be easier for people to pick up your particular question and address it quicker, instead of having to find it buried at the end of another topic's subject line.

My Irish partner just got his approval decision on pre-settled status this morning and I am still waiting for my decision though. May I ask if he truly needs to maintain his pre-settled status even his nationality is Irish? The main reason why he applied for EUSS is to help the caseworker track my application.

He does not need to have Status of any kind, no.

But keep in mind that if you guys are planning on leaving the UK in a way that he would "break" his continuous residence (more than 6 months absence), or lose his status (more than 2 years absence for Pre-Settled; more than 5 years for Settled), then your own status as non-EU Family member will be compromised. See this post.

Him being Irish, there will always be a way for you to come back to the UK; but probably not with the advantages of the EU Settlement Scheme. Hence why it is not unwise to think twice before "not maintaining his pre-settled status".
The main reason why he applied for EUSS is to help the caseworker track my application.
Reasonable course of action, advised by the Home Office itself.
