EUSS Family Permit for my mother (non-EU) need advice

Hello everyone,

I am dual British/EU citizen. We experience a delay with my mother's EUSS Family Permit application and getting anxious because we are running against a deadline to apply for pre-settled status for in the UK in time before 30.06.2021. I need your advice on what to do next, perhaps someone already had similar experience?

Our time-line in nutshell:

Biometrics: 19/01/2021 (TLS Russia)
"Not straightforward" e-mail from Home Office: 26/01/2021
E-mail from Home Office to me to provde EEA passport: 05/02/2021
EEA Passport delivered to Home Office in Liverpool: 08/02/2021

We asked via UKVI online paid service on 26/02/2021 about the status of application and received following reply the same day:

"Thank you for contacting UK Visas and Immigration International Contact Centre.
With regards to your enquiry about the status of your application, I can confirm that your application is being considered and is currently awaiting a decision.
 We escalated your case to the relevant department on 26/02/2021 to report the delay. You should be contacted regarding your case within 15 working days from the date of escalation. 
Your patience is highly appreciated."

Now I am thinking that 15 working days is going to be the week of 22nd March and the response from UKVI does not say that a decision will be made by then. I guess there is no way to find more now from UKVI, isn't there?

I heard that writing a complaint to a local MP helps. Do you think I should wait 15 working days or just complain to MP and ask to speed up the process straight-away?

Would appreciate your replies!

Hi,
We are in the exact same situation with my mom’s EUSS FP application process. I’m a NON EU with the settled status and my husband is a Dual national British/Irish (Relevant person of Northern Ireland).
Our timeline is: Biometrics on the 21/12/2020 (TLS outside of the UK).
Also received a “not straightforward” email on the 29/12/2021.
A case worker’s last correspondence via email was on the 19/01/2021 asking for my husband’s residency evidences which were submitted straight away.
Since then we’ve heard nothing. We also beginning to worry as the deadline for pre-settled applications is nearing.

You have mentioned that you contacted a paid UKVI service. Could you please tell me what exactly that was? I need to escalate it ASAP as well.

Hey, just to let you know,I’ve just received an email from UKVI stating that my mom’s application is going through the final stages of the decision and we should be notified of the outcome shortly 🤞.
At least we have something today.
I hope yours will be soon too x

There hasn’t been communication yet but yesterday I tracked it through TLS and it showed that application was transferred to VAC (it was on “received my DMC” for ages) ,so I’m assuming that the decision has already been made though we have no idea what the outcome is and it’s just a matter of time before VAC writes to us with the passport pick up details 🤞.
I’ll keep you posted...

Hi! My mom has received her passport this morning with the visa in it!!! Hopefully your mom’s visa decision won’t take long either 🤞.
It’s been quite a wait,4 months from the date of application 😖 but it’s a positive outcome and that all matters.

Hi! My mom has received her passport this morning with the visa in it!!! Hopefully your mom’s visa decision won’t take long either 🤞.
It’s been quite a wait,4 months from the date of application 😖 but it’s a positive outcome and that all matters.

Hi All,

Does anyone have an idea what kinds of checks and reviews UKVI is conducting when considering EUSS Family Permit applications?
Having read the caseworker guidance it seems that the main criteria to check are suitability and eligibility. Basically it means UKVI needs to check a family relationship on the basis of submitted documents and also check the sponsor‘s residence in UK status. It should not take long in theory, so why it is taking months and months of wait?

In one of the e-mails I received from UKVI they say that they routinely conduct enquiries with other government departments and external agencies when considering FP applications. I wonder what they are checking there?

Do they check all things like criminal convictions, immigration history, taxes paid by sponsor etc. ? - if that is the case, this can in theory take very long indeed.

To the best of my knowledge, that information is not in the public domain. An intelligent guess would be that they verify the information you have submitted with other agencies. So, for instance, if you have stated that you are working in the UK, your tax records will be checked against the information that you have submitted. The EEA citizen's travel history in and out of the UK will be checked to verify that they retain pre-settled status or settled status as the case may be, etc. Discrepancy between information submitted by you and the government records can lead to a refusal on the grounds of deception.

And of course, keep in mind that these checks are quite likely done manually (i.e. by the caseworker writing to other departments by email requesting information or verification, etc) and may take time to get processed (the person it was addressed to is on leave, the mailbox is not checked over the weekends or long weekends, etc).

We did. the MP was useful and their communication with a dedicated line with UKVI was more speedy. I highly recommend going through your MP.
