Help regarding retained right of stay

fist of all thank you a lot for the support you providing here .

I have few questions please regarding retained right of stay if someone can clarify .
1- Im planning to apply for retained right of stay on December. My question if the U.K. will crash out of eu without deal , will I still be able to apply ?
2- one of the requirements is need to be married for at least 3 years before the legal proceedings of divorce , does this mean 3 year will count before I apply for the divorce or till I get Decree absolute ?

And last question , if I will not provide the original id of my ex it will be problem ?
but I can provide a copy .

If I would be you I would go with settlement scheme instead as Old system does require original passport plus waiting time is killing on that
