Latest published information on EEA documentation

Post by kamoe » Mon Jan 04, 2021 11:14 am

I thought I'd compile the latest published information regarding EEA documentation as of January 2021, from Home Office official pages:

EEA Family permits:
https://www.gov.uk/family-permit/eea-family-permit
1. Applications still open and permits valid until June 30th 2021
2. It is still possible to apply for these, provided:
  • The relevant EEA national is a qualified person or has permanent residence
  • The applicant is a close family member or unmarried partner
This seems to remove eligibility when the EEA national is not/has not exercised treaty rights (e.g. has just arrived in the UK and can only demonstrate physical presence); and when the applicant is an extended family member other than an unmarried partner.

EEA Residence Cards:
https://www.gov.uk/uk-residence-card
1. Applications have now closed
2. Any existing EEA RCs will be valid until June 30th 2021 (this is an update, end of validity was previously stated to be Dec 31st 2020)
3. Applications submitted before December 31st 2020 at 11:00 PM, will continue to be processed normally
My posts express what I believe are the facts, based on the best of my knowledge, about the topics discussed in this forum. They do not constitute immigration advice.

I believe that is consistent with the withdrawal agreement.

Unmarried partner of a Qualified person can still continue to apply .

How about the EEA FP to accompany (EU sponsor outside the UK) ?

The application form has not changed compared to 2020 version.. it is still possible to select "EU sponsor not in the UK" and provide flights itinerary /hotel booking as evidence instead of qualified person evidence.

If it is going to make any sense I think they should set the deadline to apply until May 1st otherwise family permits granted in June will have just a few days validity and those issued in July will have zero validity.

Bearing in mind processing times those who apply after June 1st will have little chance of coming to the UK even for 1 week.

Strangely enough these changes are not reflected in a new, updated EEA family permits: guidance for entry clearance officers (pdf).
The latest version of EEA-family-permit-for-ECOs-v2_0EXT is dated .. March 2017 !

Also, as I mentioned earlier the online application form doesn't accommodate these changes as well.

P.S.
Sorry for adding posts, but for some reason EDIT doesn't work (some php error pops out)
