Some of the answers I and my wife gave mismatched though not complelty.
The question was when the relationship started .. .. .. please give your views .
Though my barrister say in almost all cases this sort of thing happen

Hearing was 28 June. No reply so far . I mean decsuin.

marriage genuine. Marrge done English law. EU wife working. ..

But very concerned with the outcome of hearing.

Ukforever, gurei, please reply.

Every one on this forum is great.

Will the judge also look that I have been in UK fir 11 years...

Marriage regstested under English law.. Now what are the chances judge can refuse my application

My marriage register under English law. Wife working, paying taxes. Every thing genuine. Culture, religin of me my wife same... But the judge refused application.

How does the uper tribunal process work, court process.

Because some of the answers mismatched, she dismissed the appeal under regulation 26 of the EEA REGULATIONS

Appeal dismissed under article 8.

But my marriage genuine, marriage registered under English law. Wife EU citrzen working. Every thing up to standard... She still refused it.

Have been in UK for 11 years from the age of 13... She said go back to pakistain, speak to your family via technology. Skype.

Your wife can come and visit you there....

What do you make of judge decsion.

I am going to uper tribunal what are the chance for success. a. Aapplied for resident card in April 2012. So nearly 14 months now.... What are the chanced to succede via durable patnet route. Please advise

Don't know why the judge did not consider article 8. You seem to have a strong Article 8 claim.

You have been here nearly half of your life, came in as a teenager, no criminal conviction, in a durable relationship.

These are all very strong factors.

Rushing into a marriage during an appeal could raise suspicion.

However you should appeal to the Upper Tribunal, if the decision, but this will incur further cost.

Now that the court has said the marriage is one of convenience, it will be difficult to now make a application, without first challenging that credibility finding. Also now that they claim marriage of convenience, it makes an article 8 case a little less stronger, as they will claim you are seeking to circumvent immigration control, and this will affect the proportionality balance.

This makes absolutely no difference. The question is whether the Judge made an error of law in his/her approach to your application.

If the inconsistency in your evidence was such that , it will be inconceivable for any judge to accept that you are a genuine couple, then your case is a bit tricky.

If it was minor, then you may be entitled to a right to appeal.

You just have to wait an see what the Upper Tribunal decides.

If you don't succeed, this will be the end of the journey, except you can show the second appeals test is met, you will not be able to Judicial Review the Upper Tribunal decision, if they refuse you permission.

Your marriage may be valid under English Law, but you need to also show it is genuine, and not marriage of convenience.

Simply holding a valid marriage certificate is not enough.

You need to wait for the decision on permission to appeal. No one can tell you about this. It is unique to an individual case.

Only thing is, things are much faster at Field house these days and slow at the first tier tribunal.

The problem you have is the judge is not satisfied about your marriage.

They thinking it's a marriage of convenience or sham marriage. Can you prove that it was genuine relationship ? If you can prove that then you will lucky

There are no tips unfortunately, not that it will have any effect anyway, as your file will be before the judge.

If you can deal with inconsistencies in your evidence, which led the judge to conclude your marriage is one of convenience, then you have a decent change of getting permission and winning your appeal.

At this present time, only if there is an arguable error in law, will the judge grant permission for you to appeal, and only if there is an actual error of law, will you have the right to proceed with s full appeal.
