Just relax man, if not this time then next time, you will eventually get married and manage your visa, but I will advice you not to work illegally even though you desperate because if they catch you then you will have a bad record for future as you not yet got a visa, besides you say your spouse works so.
Good luck with your court.
Applied for EEA4 on 24/02/2012.
HO received on 27/02/2012.
Refusal received on 16/08/2012 dated 11/08/2012
At the court, the HO REP withdrawn the decision and asked me to send the DOC for the time before marriage.

I will let every one know about the update after court hearing.

at work I am treated like a donkey, but what can I do, I have to take it, because I know I am visa less. I have every single document orginal from this country. 11 years in this country. Without family support I could have killed my self by now

. I thought I should share my experince with every one. After registering marriage, sending application, how long it can take maximum before I get a work permission or visa. Please advise.
No convinced it was.

Solicitors and barrister, are either seeking to get more cash from you, and prolonging your appeal.

The private live you have accrued in the UK, the family life you have built with your wife, the durable nature of your relationship, your intention to get married, all could well demonstrate the durable nature of your relationship.

In those circumstance, it could be reasonable said, that discretion should be exercised in your favour under regulation 17(4), and a residence card issued to you.

In any event, you could qualify under the private life provision in the immigration rules.

Why are your lawyers not addressing or exploring those points, is clearly beyond my understanding.

What else I can do apart from believing my solictor. I know my case is in final round. Once I register my marriage under English law, I will be ok. My solictor has taken so much money from me, but I think all solictors are like this. What do U think... I will keep every one update what is happening with my immigration issue

At momment, I am waiting for my new passport from pakistain embassy, urgent fees paid but still no sign of passport. 2 weeks have gone.

Second, I an waiting if ukbs send my old, experief passport copy to marraige registary. Then I go there and get a date and get married under English law.

Please guide me if my strategy id right.. And please do not trust your solictor blindly, I have no choice no w, but to trust my solictor.pleade advise thanks

Post by pageup » Tue Apr 09, 2013 10:48 am

I have full family support, otherwise I would have killed my self by now. I have been detained for 6 weeks in immigration centre, this was when I was going for sign on. Before getting married. Without family support, you cannot deal with ukba, I mean financial, and emotional support.

Please guide me.

Any idea, what is happening with Pakistani passport, people are saying there is a problem with the machine which make Pakistani passport. Something to do with machine error. Please share your view with Pakistani paddort issues.

Second, how does the durable patner application work, I applied last year April 2012, but it refused, because my marriage needs to be registers under English law... Please share your views.

I am going through so much stress. Please advise me.

Finally, do not trust your solictor too much. Trust me.

pageup... its not likely that everybody in this forum will know EVERYTHING...

If somebody does know what you need to know Im sure they will see your post and help...

M wifes embassy said 10 WORKING days... - this is two weeks. they also said she needs to collect it - they wont post it... are you sure this isnt the issue with yours?

the best advice RE: ur passport is CALL THE EMBASSY... the will know more than anybody else here...

well solicitors shouldnt be trusted...

looking back at my wifes applications they suddenly werent taking on legal aid cases when we got refusal, so offered us more time on a private fee paying basis...

It also looks clear that solicitor held her application for two months before sending it to UKBA... why was this...? - to increase refusal chances and therefore more money?

Also, I made application last year 20/04/12. It was refused nearly its one year, can this be considered also for durable patner, I know law say 2 years, but is there any way in my case this can be considered.

Please advise.

pageup...

not everyone is online reading the threads at the same time... double posting the same message within 5 mins wont help get a response faster...

how long have you been a couple? how did you try to prove durable relationship?

First thing tomorrow call embassy and chase up your passport. tel no will be online - but will prob cost a fortune ( they are usually 09 numbers - go to the job centre and tell them your calling a potential employer ;) - but note they record the calls... :P )

i think your best course is to get your passport... get married. and then fix it that way... - it appears the easiest and simpliest route.

Court hearing. eea 2 application.

Post by pageup » Wed May 08, 2013 9:09 pm

First of all thank you to every one for reading my mail, and please advise me now for my new hearing on 10 june 2013. regarding for the refusal for my resident card.

as you are aware my court hearing was adjourned on 21 Feb 2013. barrister cost me £ 700. for this hearing. Because my Islamic marriage us not yet registers under English law. On the advise of my barrister we adjourn the hearing, but on the day judge said if I get married under English law then I should not be in court. Then she said let say this process to take 6 week.

the hearing on 8 April 2013, this hearing was adjourned. barriaster cost me £ 500. simple he said to the judge my client is waiting for his passport copy to be sent to registary for him to get married. though ukba did sent the copy to registary but this is now experied,

now, i am waiting for my new passport to come from pakistain emabssy, expected arrival date is 24-05-13.

new hearing is on 10 june 2013.

my question is what i should do, should i give my solictor £ 500 again to adjourned the hearing, ( he has alrealdy asked me to pay £ 500 for this hearing!

or should i tell him to proceed with the hearing on the durable patner route.

my marriage is geniune, every thing is accepted by ukba, but they refused my application simply i onld done the islamic marriage and my marriage is not yet registered under english.

my intention is to get married under english law as soon as i get my new passport, so if before 10 june i have any date for my registartion, will this make a difference to my case on 10 june, if i do go on procede my case instead of just adjouring the hearing.

my wife working, paying tax. we living together. though no child, this is because i cannot work legally. we got every thing to prrove my marriage geniune. bills, photos, religion, same. every thing geuine. only problem my marriage is not registered under english law.

do advise me what i should do for 10 june hearing please.

i hope i am making sense.

human right background;;

came to uk when i was not even 14. now i am 25. will be eleven year next month in uk.

i have been to school, college, univeristy of uk. spent child hood here, adulthood here. have got each and single document of this country, bank card, medical card, national insurance number, driving license. strong family connection, no criminal record, still nothing has worked for me yet,

last year got married to my cousin who is french national, marriage done under islamic law, she is working paying taxes, marriage is geniune, but the issue accroding to my barrister it is not legal marriage under english law..,

what i can do now?

i am a gradudate of a univeristy, but working for £ 2 per hour, ILLELEGALLY, simply i am visa less, is there any way i can persuade my solictor to get me atleast work permission? how does the work permission process start?/

MY family supporting me.

judicial review refused. applicaton refused many times by ukba. but i know my previous immigration history do not count when i make eu application.

please advise.

what are the chances for me to get visa now being married to eu national.

please advise.

You need to understand that posting non stop wont help you either in here. if some one is trying to help you dont just bombard them with same questions.

according to me you just need to put your head down and wait untill your passport is sorted , then go the marriage bureu get the marriage intent certificate sorted where they will ask you and your wife your basic details, how and where and when this relation ship started, job details etc of eea national exercising treaty rights. following that you will be given a marriage date with a gap of 14 days and then you can turn up in the registry with your wife and other family members who can attend and go through the standard procedures and tie the knot.

following that you should send your eea 2 application with your , wife passports or ids, wife job salary slips , and bank statements, utility bills , proof of a genuine relationship which could be photos and other stuff and send it away to ukba and here we go you will recieve your COA in 2 weeks and most probably you will be allowed to work full time and everything will be sorted from there.

calm down , read this ten times before posting any similar question again as you can see you been posting non stop bhai sahab,

Thanks
