i just explained to you in the previous 2 MESSAGES,please go back and read what i advised u and all the advises the members of this forum already gave u in this thread,it looks like u did not read what i wrote..
its simple and clear:
1-don't go to the hearing.
2-don't pay anymore the solicitor.
3-apply for eea2 (residence card)if u did not so already.
4-stop worrying and just wait for the reply from the ukba(it could take up to 6 moths)so no need to panic or worry..just chill out.

Its my silictor who always put me in dobut. He say by not going to court it will have negative efect on my case. Obviously I do nit even want to pay £5 to him, but what can I do when I know I am stuck..

I forgot to tell every one, I am working illelegaly, I know I am not allowed to work, but still doing it to earn some thing, I am working for £2 per hour.

I want to get some kind of answer, confirmation from the judge for my peace of mind.. Instead of waiting for 4 months.

I hope am making sense.

I am.prsying home office say do not come to court,but lets see.

As I said in my last post, I am working illelegaly, therefore I think I will go to court and ask the judge to confirm I get the visa, then I think I will be safe when I get some thing from the court on 28 June. Appeal allowed paper.


Court day will cost £700, but family say, its better to pay £700, and win from court, then wait 4 months to get reply from ukba, mean while if ukba catch mw from work, its more stressful, and all the bail process...

I already have been to detention centre for 6 weeks when I was single, before getting marred. I wad going for sign on.

Second option, I ask my local MP, to write to ukba to give some reply by 28 June, I wrote to ukba request letter to conclude my case soon, lets see what happens, as I know cour hearing will cost £ 700.

Please tell me whether my strategy is right or wrong.

My main aim is to get some sort of confirmation from ukba thatwill getvis visa soon...

Is my strategy right.

your strategy is so wrong and clearly u are just wasting our time,so many members advised u already to send a new eea2 application for residence card and wait,then u will get the COA that will allow u to work LEGALLY ..but u are adamant to throw your money by the window...u took your decision already to go to court,i don't see why u are still posting here the same questions..!!
u need to know that whoever advised u in here,gave u the right strategy , but u don't seem to take the advises given.
please go and give £700 AWAY to the solicitor for the hearing,this way is done and dusted.
sorry if i have been harsh with u,but if u were in my shoes , u will feel frustration .

Feeling very stressed. Just waiting for ukba reply, my solictor say, ukba might say give us some time to decided the application, in this case there will be no hearing. No need to pay money.to solictor. Very stressed out.. Trust me. Your advise is always welcomed.thanks

Go to the hearing, and explained your position the Judge.

In light of your recent marriage registration, the judge is bound or entitled to allow your appeal under Regulation 17(1), if he or she is satisfied you are a family member of a qualified EEA national.

i agree with the above statement,but don't u agree that,he can just save £700 not paying the solicitor,apply for eea2 then if something goes wrong,he can then ask the solicitor to intervene..!!

he will get a COA and could start working legally right away, and i don't see why he should go and ask the judge and explain his situation,knowing that the last judge in his last hearing asked him to not comeback if he gets married under british law and gets a marriage certificate..meaning he can apply for residence card straight away,why the delay and the headache and hardship,i don't understand..

the OP can save money that he can't afford to spend,he could apply for eea2 and wait,he is just going to waste his time and money in my view if doing otherwise, and if things go south,he can still appeal .

Trust me, I do not want to pay even £5, but I have no choice. I am working illelwgaly, ukba can come any time... At work, ... Therefore I want some kind of confirmation asap from ukba or court that my application is successful and I am allowed to work I hope am making sense.

U till 26 ,June, no reply from ukba, 27 June left, lets see, what happens. 28 June hearing,..

Last question, what is section 17.. Some one mentioned earlier please do reply.

no u are not making sense,i don't know if u understood or understand the process,it would have been faster for u if u did apply for ee2 (residence card) and get the COA (certificate of application)valid for 6 month which will allow u to work,this certificate you would get it after 2-3-4 weeks or more,check the timeline for eea2 application in this forum,u will see in average of how long it's gonna take..and then u will be allowed to work straight away..

by waiting u are delaying,the judge is going to confirm your right for the residence card,that's all,and you will have to proceed anyway to apply then for it..!!not forgetting the £700 that u will pay for in the process..!!
do i make some sense to u or not??u have been advised to do so by many,long time ago,and i wasn't the only one and u would have been now working legally and just waiting for the residence card.

u have been wasting your time and energy and money asking the same questions over and over again,we advised u to do the right thing but since u got your marriage certificate u did not act accordingly and now u have to waste £700..and u never know when the ukba decides to allow your appeal.

what i meant by ukba allows your appeal,is that the judge is going to ask the ukba to proceed with ur case then u have to either get the confirmation from the judge to apply straight away or u have to wait for the ukba to contact you,i'm not sure 100% but i thought i've read something like that,when someone appeals a decision against the ukba,if the judge allows the appeal,then u have to wait for the ukba to contact you to reapply..not sure,i hope someone from the forum will confirm this.
if this is how it works then,i'm afraid u are in for a wait...u never know then when the ukba will write to u,it could take weeks before they do so.
i hope i'm wrong for your sake,but i'm afraid that u wasted so much time and so much money for nothing.

PS:u had a choice,u did not want to take a chance even after so many who advised u to apply for RC and not to go for the hearing.

Hello.

Some of the questions mismatched. Me and my wife answers. 3 question in total. My feeling 65% in my favour. My barrister say it all depends on judge how she looks it. My reply and wife reply..

Ukba barrister say my marrige sham marriage. Because of the mismatch answers UKba barrister ask about dates which both of us said don,t know.

Though some answered were matched me and wife.... . .

Please do reply....

My barrster say this kind of thing happen in all cases.. ... Lets see.please advise

It all depends on judge now. Please guide

I am really confuse regarding what you would like people to tell you :?
You have been directed with the same advice and yet you decide to go ahead and pay the barrister. Fair enough! i think for members to be able to give you your view on what happen you should at least give more details regarding the question and the answers you and your wife mismatch. Mind you body language also count and considering the way you handle your threads on this forum i am really worry for you!
The sad think is that you paid the barrister because you thought you were going to get right to work straight away and it end up exactly the way ukforever warn you about :cry:

Some of the answers were spot on same answers. Me and wife.

But some of the aanswers were not exactly same but 40% same... Lets see know.

Body language was normal in my view,


My narrate genuine. Marrge under English law
wife working .

But today hearing will play a big role.

What is the next step if my appeal refused. ... Pleae advise.

To be honest, I did what my solictoe suggested.

I was at Hatton cross. York house..

I am back to work as illelelegal working. No right to work.

Please advise on my work situation

Also, do advise me on the hearing. My barrister say he is satisfied with out responses front of judge. But I am concerned with little mistakes I an my wife did.
