Thank you! No, I did not send business bank statements for EEA. He uses personal account to pay NI, taxes and receive payments from clients.

Hello all,
Am new to this. This is my story;
Came here 02/2008 on student visa
Got married to an eu national 10/2009
Only granted RC in 2011
Expires 2016
About going through a divorce but she did not work for a year and three month and was claiming income support.she is currently about to take up employment at the moment.we both have a son who is 2.
I work and support my son by paying money every month into her account from mine.
I really don't know whether to apply for retainer right of residence through access right or PR upon the completion of the 5years given for RC
Also have a British child that support as well
Please I need help with proper advise on the appropriate step to follow.

RC received : 10-05-2014 (dated 02-05-2014)

Supporting documents

(I) Covering Letter : Explaining the following issues;
-My wife has personal bank account (not business account) as it is not mandatory by HMRC for self employed person.
-Nearly all her business transactions are on cash basis, hence need for Accountant is not required.
-Her business have been advertised online, yelp.co.uk and yell.com.

(II) Valid Evidence of Identity
-My original passport and,
-Wife's original passport

(III) Evidence of Excercising Treaty Right via Self Employment: Documents include;
-Evidence of NI contributions
-Personal bank statements
-HMRC self assessment forms
-Emails from HMRC
-Invoices/Receipts
-Business Cards
-Flyers

(IV) Evidence of Relationship
-Original marriage certificate (Married in the UK)
-Joint bills

(V) Evidence of living in the UK
-Wife's voters card
_Wife's bills (which are not joint)
-My bank statements (not needed though)

(VI) Recommendation letter from customers ( I added one but I will advice you add atleast two).

I never engaged the services of Solicitor, I gathered all these information and documents required for self employment application from this forum. Then, I have valid visa till ending of the year.

All I can say is, Alhamdulillah, I give thanks to Almighty Allah and wonderful members from this forum. You have been so helpful and Its my pleasure to give back to this forum.

Not my case...but I'm very curious about this scenario.

Also could someone clarify me the volume of proof that's sent ? Exemplo: Bank statements containing how much weeks/months/years ? I'm considering to use this route, but I just have 3 months in UK and my NINO has been issued only last week and I'm still need to create records on HMRC, etc..

Hello every one

My case is similar to majority of you difference is my eea wife has been working as self employed for 5 years

Everyone talks about sending envoices and bank statements ... How many years?someone said he sent 5 years of statements you guys mean full ones?

If I send invoices for 5 years each week one envoices so 5\52 ? Monthly bank statements 12/5?

Or shall I send the bank statements showing only money coming in from customer and nic payments ?

Invoices just send few each year?

I'm really confused

Or just send last Year bank statements with full 5 years self assessment statements?

Please help

Hi Suchalife,

It depends on what you're applying for,

For EEA4 people normally send all 5 years of proof of exercising treaty rights for self-employed activity.

In my case when I was applying for RoR, I sent all documentation regarding exercising treaty rights for the period of divorce proceedings, but for the years prior divorce I only sent 4-5 for each year - bank statements, invoices, utility bills.

My ex was cooperating with me so I had all paperwork needed,

for PR application in of the years my ex-wife gave only Tax Return, but for the rest of the years I've got Tax Returns and invoice books with bank statements.
Do you think it can be the reason for not granting PR?

Hey, I posted my timeline in another post, but what I wrote along with it is relevant to this post:

(....) I didn't include a letter from an accountant because I do my own accounting. I also didn't include any self assessment forms because I have yet to make one (mine's do next year). I did, however, include the letters HMRC sent me with my UTRn and my NIN, and also a couple of print outs of emails I got when I registered for online self assessment.

Other then that: personal bank account statements for 3 months, invoices that match the money going into the account, and a letter from my biggest client where I get most of my income from, stating that I work with them on a freelance basis and on an ongoing work relationship. I also included a printout of my portfolio (I'm a designer) just to tick the box with the whole "advertisement material" thing stating that I use it to get work. I sent a cover letter along with the application explaining everything regarding my business and why I wasn't including things like HMRC Self Assessments or NIN Contributions (I still haven't gotten a bill for NIN Contribution, I believe It's in april) and summarising what supporting documents I did include and why.

My EEA3 application as a self-employed person was successful. As evidence of self-employment I sent:

printouts of tax returns and submission confirmations for every year
all self-assessment statements of accounts (SA300) I had for the period
bank statements showing payment of NICs (pay by direct debit), 3-4 per year
3 letters from HMRC regarding NICs (the ones they send every year to notify of new DD amounts)
VAT registration certificate and printouts of all VAT returns for the period
copies of invoices sent to customers (3-4 per year)
business bank statements (3-4 per year)
receipts/invoices for goods and services purchased for the business (3-4 per year)
printouts and URLs of websites I advertise on
proof of professional indemnity insurance for every year
relevant degree certificate
proof of membership in relevant professional association for every year

Probably excessive but as my profits were quite low in the last couple of years I felt I'd better send as much evidence as I can.

is there any limit on self employment i mean minimum income. our self employment income is 55 per week.
