Hello every one

My case is similar to majority of you difference is my eea wife has been working as self employed for 5 years

Everyone talks about sending envoices and bank statements ... How many years?someone said he sent 5 years of statements you guys mean full ones?

If I send invoices for 5 years each week one envoices so 5\52 ? Monthly bank statements 12/5?

Or shall I send the bank statements showing only money coming in from customer and nic payments ?

Invoices just send few each year?

I'm really confused

Or just send last Year bank statements with full 5 years self assessment statements?

Please help

Hi Suchalife,

It depends on what you're applying for,

For EEA4 people normally send all 5 years of proof of exercising treaty rights for self-employed activity.

In my case when I was applying for RoR, I sent all documentation regarding exercising treaty rights for the period of divorce proceedings, but for the years prior divorce I only sent 4-5 for each year - bank statements, invoices, utility bills.

My ex was cooperating with me so I had all paperwork needed,

for PR application in of the years my ex-wife gave only Tax Return, but for the rest of the years I've got Tax Returns and invoice books with bank statements.
Do you think it can be the reason for not granting PR?

Hey, I posted my timeline in another post, but what I wrote along with it is relevant to this post:

(....) I didn't include a letter from an accountant because I do my own accounting. I also didn't include any self assessment forms because I have yet to make one (mine's do next year). I did, however, include the letters HMRC sent me with my UTRn and my NIN, and also a couple of print outs of emails I got when I registered for online self assessment.

Other then that: personal bank account statements for 3 months, invoices that match the money going into the account, and a letter from my biggest client where I get most of my income from, stating that I work with them on a freelance basis and on an ongoing work relationship. I also included a printout of my portfolio (I'm a designer) just to tick the box with the whole "advertisement material" thing stating that I use it to get work. I sent a cover letter along with the application explaining everything regarding my business and why I wasn't including things like HMRC Self Assessments or NIN Contributions (I still haven't gotten a bill for NIN Contribution, I believe It's in april) and summarising what supporting documents I did include and why.

My EEA3 application as a self-employed person was successful. As evidence of self-employment I sent:

printouts of tax returns and submission confirmations for every year
all self-assessment statements of accounts (SA300) I had for the period
bank statements showing payment of NICs (pay by direct debit), 3-4 per year
3 letters from HMRC regarding NICs (the ones they send every year to notify of new DD amounts)
VAT registration certificate and printouts of all VAT returns for the period
copies of invoices sent to customers (3-4 per year)
business bank statements (3-4 per year)
receipts/invoices for goods and services purchased for the business (3-4 per year)
printouts and URLs of websites I advertise on
proof of professional indemnity insurance for every year
relevant degree certificate
proof of membership in relevant professional association for every year

Probably excessive but as my profits were quite low in the last couple of years I felt I'd better send as much evidence as I can.

Hi, I have no idea, couldn't find any conclusive information on it. Mine was quite a bit higher than £55 per week though.

SUCCESSFUL EEA2 Residence Card; A8 national, self-employed, unmarried couple | what we did

Our application was dependent on the A8 national who is self-employed.
We are in an un-married durable relationship for several years.

Timeline:
Mid-October 2014: Application sent.
End of October (a week after applying): Letter confirming the arrival of our application.
Mid-November (almost a month after applying): Received COA (with no work permission).
Early February 2015: Received Residence Card together with our application.
Total of almost 4 month.

Our approach divides into proving 3 main points:
1) A8 national exercising treaty rights in the UK as self-employed (including evidence that we will not need support from the government).
2) Durable relationship for more than 2 years.
3) Build our case as a professional serious couple.


Details:

1) In order to prove that the A8 national is exercising treaty rights in the UK as self-employed we supplied the following documents:
- HO official letters (such as NINO number and tax reference).
- CV.
- Letters from employers; as much as we could gather. Indicating our work, professionalism, employer’s intention to hire in the near future.
- Invoices and contracts as well as documents for future works.
- Self-evaluation document stating income; sums, date, employer and linking to bank documents proving money deposit.
- Bank statements.
- Document showing our joint budget: Our savings, current income, monthly expenses. Also we’ve stated our expected income for next year (all of this to show that we can support ourselves).
- Letter from guarantor: Letter from family guarantying support in case we will need help (include guarantor bank statement to show s/he has the ability to support).

2) To prove our relationship is genuine and durable for at least 2 years we supplied the following documents:
- Joint bank accounts (including past documents).
- Joint lease agreements (past and present), including letter from landlord.
- Joint utility bills - past and present (also non-joint bills are effective, given they are on the same address in the same period of time).
- Joint comprehensive medical insurance (IMPORTANT). Our was through in WPA.
- Letters addressed to both of us (from bank, commercials, personal letters, purchased goods).
- Supporting letters: Letters from acquaintances, family and friends, detailing their relationship with us. We attached 10 letters in total, half from the groom side and half from the bride side. We’ve tried to gather people that have impressive job titles (government employees, PhDs, lawyers, directors, etc.). In the letters we’ve asked everyone to state how they see our relationship, when did they first got to know the other half and other detail that will show our relationship is durable.
Attach passport scan of writer when possible.
- Joint vacations: Scans of passport stamp and dates from join vacations abroad (also where passport haven’t been stamped).
- Photo album: Prints of joint photos since we’ve known each other (also photos with family). Organize photos by date. Mark names of photographed people.
Send all the photos you have. Don’t stop in twenty. Sending 400 photos is legitimate and will help your cause.

3) To build are case as a serious professional couple we supplied the following documents:
- Details of our accommodation: pictures of where we live including floor plans to show our life quality.
- Academic education certificates, CV and professional publications of the EEA2 applicant.
- International travels of EEA2 applicant in the past 10 years.
- English exams (IELTS). Not required for every country, but helpful to show ability of integration in the English society.


Additional information:

- Cover letter from EU national, stating what we prove in this application (exercising of treaty rights, X years of relationship).
An introduction for her/him and her/his work. Feeling about the relationship. Introduction of the EEA2 applicant and her/his work.
- Request of your passport back: we’ve asked for our passports back and received them in less than 10 days. You can do so in the following link:

- Right to work: As to what we understand - married EEA2 applicant will receive COA with right to work, whereas unmarried EEA2 applicant will not.
- Be organized, clear and check your spelling. Appear professional.


Most important - don’t get too frustrated.
This process is time consuming, but if you are working and in a durable relationship you are eligible.

a few questions I'm trying to figure out lately regarding self employment / taxes / comprehensive health insurance:

1) If you apply for permanent residence on the basis that your eu partner is self employed and didn't have to pay taxes for a year because of low earnings - does that affect your case?

2) Do you suggest adding a comprehensive health insurance due to self employment in general, or in case of low earnings?


we are not really interested in health insurance - but a friend suggested to do so because her application (eea2, self employed) failed and after she added a comprehensive health insurance to her application it was successful.

HO introduces minimum earnings threshold in order to qualify an EEA citizen as a self-employed. My earnings now, however, are variable. My parents' application for RC is still pending.

I start teaching at university in 2 weeks (as a teaching assistant). In conjunction with this, I will have a contract (for at least 3 months) and that will exceed that threshhold. I also continue to be self-employed.

I am aware that my parents' application will be determined by 02 December (6 months since June application). I want to collect latest evidence of being over this threshold - university contract, evidence of latest self-employment - and to forward it to HO. I also want to demonstrate that I transfer money into my parents' account for their expenses.

Many would suggest wait and see if this will be required. I am conscious of the potential additional expenses if HO makes a decision to discard my self-employment and to class me as non-qualified EEA citizen. I want to prevent a possibility.

Can you please share your thoughts on what would be optimal to do in our situation?
