Biometrics given! - had to travel to another city in the beautiful weather! :-)

Residence Documentation expired in October. It was a vignette on an A4 piece of paper called Immigration Status Document, as my wife requested her passport back. At the time, they did not issue biometric cards.

Just to update everyone, I got a reply to my complaint to the Home Office Public Enquiries email. This was quite quick, I sent it on 8th April and received the following reply today (which came from the EU Resolution Centre):

"Your email and concerns have been noted and are currently being investigated. Please be assured that we are looking in to the situation and we will be in contact as soon as possible".

It will be interesting to see if anything substantial comes out of their 'investigation'.

Suridner singh under old or new route? Which is better?

Hello!
We are applying for a residency card for my husband under Surinder Singh. We have spent the last month completing and getting all the evidence for the EEA (FM) paper form, but found out yesterday about the EU settlement scheme application form.

This is my husband's first application (he entered on an EU Article 10 residency card).

We rang the EU SS resolution centre today and they advised using their form, not the old form as the old form is being phased out. However we are nervous to use this new path as we will have to wait for the form, and we don't know how successful this new process is.

Should we use the old path or the new EU settlement scheme path?
Has anyone had a positive outcome with the EU settlement scheme for first time application for BRP?

Which EEA countries did you move to ?
How long did you stay and live there ?
Did you have employment there?
Were you moved your life centre to that country?
Why you move back to the UK now
Does your husband asked for UK visas before return back here?
Do you have children born there?
Do you speak EU country language?

all kind questions will help you to get possible UK Residence Card. if all questions were fulfilled and if the Home Office accept that you were comply with Surinder Singh case at that time you husband will be granted UK residence Card.

If you go down the EEA (FM) route, you will still need to apply to the new EU Settlement Scheme at a later date (that is if the UK leaves the EU).

For both routes, you basically have to meet the same conditions (EEA Regulations 2016) except you do not have to prove that you (the British spouse) are exercising treaty rights in the UK. For the EEA (FM), you will need to prove that you are exercising treaty rights in the UK after the first 3 month of residence.

The EEA (FM) route will not be phased out, as long as the UK remains a member of the EU.

You can apply for both at the same time or wait to get COA on your first application and then submit your second application, HO must process both application.
you can send your documents with first application and on second application just add the note that you have pending application with Home Office and they can verity your documents with the department that holding your documents.
I done the same.
I applied for eea pr first and then I applied for setteled status, Both application are pending but processing, got my COA on eea application 6 weeks ago but heard nothing from settled status application as I applied on paper application( same with lots of people who applied on paper application and heard noting so far)

Well done, it looks like you are the first, and only one to receive anything yet.
We're hoping ours will be coming soon too as our application was received 2nd May.

As for complaints:
I wrote an email to my MP Saturday, and had an email reply today from his caseworker/assistant.
He asked me to download, print, sign and send a consent form allowing them to enquire on my behalf to the HO and UKVI.
Printed, signed and sent already, so hoping for a speedy response.

I had written in my email "I am writing for ourselves, and on behalf of what could amount to thousands of others across the UK", but from the response today I feel we may just get a personal investigation into only our application rather than a complete shake-up of the system that will help others too.

I want to feel like they have taken notice of my email, or am I mistaken and this is just a standard response?

Update on timeline.

First contact made to request form: 30th March (Details given 31st March after callback)
Application form received: 26th April
Application form completed and returned: 26th April (Special Delivery)
Application form received by Home Office: 29th April
Biometrics letter received: 11th June (Letter dated 5th June) including return of passports and previous residence cards - other documents not yet returned.
Biometrics given: 11th June
Indefinite Leave to Remain (Settled Status) granted 13th June (told by phone)
BRC to be received within 10 days (told by phone)

My wife missed 2 calls from the Home Office, yesterday and today. The caller said that she was responding to my complaint and asked her to call back. I called back today and asked for the person who had left the message. The call handler said that they had never heard of that person :-) She asked for my wife's reference number so she could check on the system. I told her it was a Surinder Singh application, because it is on a different computer system - not the system the EU Resolution Centre staff mainly access. She went off to check on the other system. She came back and said that my wife has been granted ILR and will receive her Biometric Residence Card within 10 days.

She has not yet received a Certificate of Application or a letter confirming the granting of ILR status, but I will update if any of these are received and when the card arrives.

I hope everyone on this forum will receive their status as soon as possible.

Hi could you please tell us how you made the complaint. I have made 52 calls to the resolution centre and each time they give vague info. emailed Mp haven't yet got a response.

I applied over a month ago and I was told all documents are uploaded on the system.

Can you please tell me how you raised the complaint with the resolution centre.

Hi these are 2 different emails. Did you use noth to complain? Also what did you detail in your complaint? Did you provide all your details including application number or is that not necessary?

EU Settlement Scheme - you do not have to prove exercising of treaty rights in UK

1. I summarised my wife's case;
- when she requested the form
- when she received the form
- when the form was received by the home office

2. How the delays had affected my wife;
- unable to travel, visit family

3. The actions by the Home Office (or lack of);
- no Certificate of Application
- no contact at all
- no specific information on how long the process will take

4. My general feelings on the situation
- spouses of British Citizens not be treated the same as spouses of EU Nationals (in terms of the application and processing of applications)

5. Mentioned that I had now got my MP involved

6. Due to the above issues and delays caused by application form not being ready when scheme opened I requested that the case was escalated

7. I provided my wife's name and application reference (case number)

Congratulations!! I'm admin on a Surinder Singh Facebook group, where dozens of us have applied for EU Settlement Scheme since 27th of April. About 8 of us have received our biometrics enrolment letters, but no one has heard news of actually getting the status yet! I've shared your post with the group :-)

Hi everyone,

I know surinder Singh applications are discussed here however someone please advise on chen/ zombrano cases ( non EEA national carer of a EEA/British citizen)


can someone help put my mind to ease 
I hold a biometric residence card in 2018 which states family member of a EU national.
However the residence card does not lead to settlement as it's under derivative rights as I am the primary carer to a EU child as my EEA spouse left and divorced me 9 years ago after living with me for 5 years in UK.

I had to appeal against the home office decision as they refused my application. The courts and tribunals decided the case in my favour as the primary carer of an EEA child in education in UK and I was issued a BRC in 2018

My biometric residence card expired in 2023 
I am a non EEA national.

I've now applied to the EU settlement scheme.
I'm petrified that I will be refused as I dont qualify can someone please advise me on this I'll be very grateful 🤗

Congratulations!
I called them again yesterday (my application was received by HO on 1st of May) and they advised me that I will receive biometrics letter this week.
We will see if that will happen.

I recieved my passport back, and also my biometrics letter yesterday.

Fingers crossed on how long the whole process takes now.

Hi all, another update.

My wife received her Biometric Residence Card today.

Biometrics given - 11th June
Letter confirming Settled Status - dated 12th June
Biometric Residence Card received - 17th June

So, less than a week from giving biometrics to receiving the card.

No Certificate of Application received.
