Hello all,
I have plea here for help, no one seems to help me,Is it that no one knows any way forward or the questions are not necessary?

Ans: Keep writing to the HO until they respond.

This is the protocol - If it takes up to eight weeks after the submission of an application to be able to chase the Home Office for a certificate of application, this does not seem to be in compliance with the clear wording of the Directive which requires “immediate” issuance following an application, or that of Regulation 17(3) of the Immigration (EEA) Regulations which also states that the certificate of application shall be issued immediately.

Hi, thanks Snooky and IST for your valuable and competent advise. I had a look again at my BRP under EU Settlement which is issued on July 2019, and I could not see any expiration date on that! There is a hope for me now. If I can retune to the UK, then in case of refusal I have the opportunity to apply again with right of appeal. I think it is better to take the risk.

Welcome brother, hope all external family are cool.

Remember at the back of your euss BRC, it is still Zambrano meaning as far as we are in the EU, you're not subject to immigration control and HO cant do that

Hi Snooky,

I seriously think there is something wrong with this online application form.

For example Section two of the form asked the below question and i then clicked "No" as my answer. However, i keep getting the message i posted earlier in the post. when i then fill out the M column which ask for the time of the Removal, only did it move to the next stage which i found strange as the column is not relevant to me.

L. Are removal directions currently set for you? * No Yes
M. Time of removal

N. Date of removal

O. Are you currently serving a criminal sentence? * No Yes
P. If yes, what date is your sentence due to end?

Q. What category prisoner are you? A B C D

Getting to Section 3 which asked about the refusal letter information and date. whenever I typed in all the information as requested and click on next page, it won't move to the next page. I've been on this application since Sunday and this is wasting my time.

Can I use the PDF form instead of the online?
if the yes, can you please confirm this is the right form; Form IAFT5?

Many thanks for your help

I’m in the process of applying for DRF, based on my British child( citizenship granted last July). I have a few questions, if you can kindly reply.

1. I’ve been advised by one of the members above that I could apply for both drf and eu settlement Zambrano at the same time. I have both forms which I’m filling now. In terms of the IDs, where should I send them since I intend to post both forms at the same time.

Ans: Good

2. I have a very important trip in April next year. With the current Covid situation and their usual tricks to delay applicants, I don’t expect them to give a decision so soon. I wanted to know if at what point do they send back the documents after scanning and if they send them back before my trip, can I travel while the applications are pending?

Ans: EUSS department doesn't hold on to your passport. The only enemy is EEA Zambrano Drf1 Department. They will only get you your passport only if your case is done.

3. I’m stuck on the section where they ask the reasons why the British person has to leave the UK if I were to leave. I have a valid LTR until 10th of June. I was previously granted under fm 10 year route. My circumstances haven’t changed since and a renewal should be granted without any issue. Any idea what I should write in that section?

Ans: I have written a lot of legal stuff about the right you have under regulation 16. You can argue against HO inserted Regulation 16(7A) which is not an EEA regulation and because your are a person subject to immigration rules under section 13(2) of the 1971 immigration act. Under EU you dont need to be an unstable leave holder.

4. My daughter has been granted British citizenship last July, so I am a Zambrano carer at that point, right? I have lived in the UK since 2008, partly on a student visa, and then I was refused extension in 2011. I overstayer until 2018 when I was granted ltr . Never been in relationship with British / EEA person. Should my EU settlement application eventually succeed, I will only be qualified for a pre settlement right? I do not otherwise seem to qualify for settlement under any other category for Zambrano carers. Kindly share your opinions on this.

Ans: Your right start from when your child became British.

Lastly, you advised me last year when I posted here. I was preparing my daughter’s British citizenship application at that time and I was very depressed about it all. I’m still finding it very hard to navigate through the whole thing. I would really appreciate your help as this is all very difficult to me and I cannot afford to pay a solicitor at the moment

Ans. Cant get your last question
Dear Snooky,

Thank you for your answers to my questions.

You can do the pdf, but online application is faster for submission and easy.

Start all over again then make sure mandatory * questions are answered

Also give them a call if theres a problem with the online application to help you

I hope you all are well and keeping up with the good fight. My drf application was returned after 3months as invalid due to no ID documents. I have resubmitted the application providing originals of all requested documents. Its been over a week since I resubmitted my application, but the money has not been taken out of my account.
Has anyone had a similar experience in the past or what do you reckon I do?
Your advice as usual will be much appreciated.
Thanks

Hello everyone, hope you're all doing well and keeping safe!

Please can you advise on when HO usually send acknowledgement for Zambrano application under EU settlement scheme?
For my drf 1 application, I received an cknowledgement/biometric letter in 2nd week after they received the application. I'm just worried especially as all identity documents I submitted were copies ( though I referred them to my drf 1 application).

Thanks

I don’t think your application will be valid as you needed to be send the original identity documents (copies are not acceptable).

Thanks IST. I thought since the documents are in home office anyway that it would be fine. I will call them on Monday.

Hello

Please can you advise on when HO usually send acknowledgement for Zambrano application under EU settlement scheme?

Ans: It takes two weeks or more for them to issue with a letter of acknowledgement for biometric purposes but at time delay and oversight can happen especially as they are working from home.

With the EUSS it doesn't matter if you add photocopies of passport or documents as long as those documents are with the HO or somewhere at the HO, it makes your application a valid application.

Ans: Normally Drf1 delays acknowledgement of application. HO is very unpredictable and work like a snake.

Good luck

Always appeal, if you were honest in your application, you have the money and you are a Zambrano carer.

When you complete the form, ask for expedition.
Thank you
Just checking up on you. How are you?. Hope you are ok. How far have you gone?. Have you received that court letter about you being a legal guardian or something?.
Hi , I didn’t go through with the appeal . I applied for DFR1 and waiting on the outcome for that application.
Hope you are ok. How is your application going

Thank you
Just checking up on you. How are you?. Hope you are ok. How far have you gone?. Have you received that court letter about you being a legal guardian or something?.
Hi , I didn’t go through with the appeal . I applied for DFR1 and waiting on the outcome for that application.
Hope you are ok. How is your application going
