You may have to file a preaction protocol if the delay continues.

It should not take more than 3 months for a reply.

My EUSS appeal was allowed and I gave called the court 3 times to check it the HO appealed but they didn’t, last day for them to appeal was yesterday. I checked my application online but still showing the same as Your application as been refused. I’m worried that if a right to work check is carried out it may come negative. How long did it take for your card to arrive after determination was promulgated please
My card was received 2weeks and 4days after the promulgation was given. If 28days is passed i see no reason why they are delaying your leave further as the Akinsanya case doesn't seems to be applicable to you because as it is you are currently without a leave to remain. Both Snooky's and Obie's advice are valid. I guess they want to be chased and in chasing them don't forget your 80quid refund I want to believe you were also awarded a fee.

The attached letter to the determination mentioned they have 14 days to sought appeal not 28 days. 14 days has now passed, the court clerk gave me the home office determinations team email to chase them my barrister gave me two separate emails too, allowed appeal team and refesed case management team. I’m still looking for the post decision caseworker teams contact. I’m about to copy all of them in the email. I got a very good job offer and I really hope HO doesn’t mess it up for me. I will be so sad

😭😢 just after my previous message an email came from court which was notice of appeal, so HO is challenging FtT decision to allow my appeal at Upper Tribunal. This is so very daunting and stressful, I don’t know what to do.
I need any advice on how I can confirm right to work or any documents I can rely on

Application for permission does not mean that permission will be granted.

Even if permission is granted, it does not mean an Error of law will be found or the matter will be set aside.

HO trying to challenge the fTT decision means nothing. That cannot stop you. Did you receive a COA when you apply for EUSS? if so you should show that to your employer as this COA doesn’t have a limited date and also still valid until your appeal rights are exhausted. Because HO is appealing against the decision, your COA continue to be valid.

Hi

If after three months since your appeal was heard and HO never appeal the decision of the Ftt, then you will have to write to the PDCU. Meaning Post Decision Casework Unit to ask them to implement immediately the Promulgation Of the judges determination.
3 months!!! Oh my goodness… can I work in the meantime do you know 😢

Hi

Chill, HO is appealing all the EEA Zambarano that have been granted or allowed by the ftt. Don't worry yourself too much as Obie is saying stay focus because when IAFT4 is issued and it doesn't mean the appeal will be granted and even if IA65 is served for not panic because the intention to appeal could be thrown out if the ftt judge followed the Reg properly. In this case I think and believe Reg 16 was followed and applied rationally.

I think that is wrong. The Home Office has made an undertaking before the Admin court that people in your situation will be permitted to work pending the decision in the Court of appeal . That consent order and undertaking is legally binding.

Write and ask for COA permitting you to work. If they insist on not giving you one, send the Consent order before the court and threaten JR, and follow it on.

Who do I write to request this please, I’ve been searching and calling just to find a solution to being able to prove my right to work.

Paragraph G of the consent order is what is applicable to your case, as you matter has not been finally determined.

Pursuant to the directions of Upper Tribunal Judge xxxxxxxxx issued on 17 May 2021, the respondent, if so advised, was directed to file and serve supplementary grounds of defence in
response to the applicant’s grounds of renewal, by no later than 14 days after judgment was handed down in Akinsanya. The written judgment was handed down by the High Court on 9 June 2021 and on 22 June 2021, the respondent filed an application seeking a stay in these proceedings at the Upper Tribunal, pending her appeal against the decision in Akinsanya to the Court of Appeal. For the reasons given in his decision of Xxxxxx, Upper Tribunal Judge Xxxxxxx refused the respondent’s application for a stay.
The renewed permission hearing in this case has now been listed. I am just wondering, what’s the HO supplementary grounds of defence?????? 🤷🏽‍♀️🤷🏽‍♀️🤷🏽‍♀️ It’s just ridiculous and a waste of time for all of us waiting.

Write and ask for COA permitting you to work. If they insist on not giving you one, send the Consent order before the court and threaten JR, and follow it on.
Who do I write to request this please, I’ve been searching and calling just to find a solution to being able to prove my right to work.
Where can I find this undertaking before the Admin court please

Hi All,

I have received notification from the FTt this morning about the Home Office requesting permission to appeal the FTt decision to the Upper tribunal.

Not what i want but will keep you posted about whether they are grated permission to appeal to the Upper tribubal.

Im also interested to know if the Home Office got permission to appeal the Akinsanya judgement to the court of Appeal.

@Lulubaby have the home office confirmed if they got permission to appeal to the Court of Appeal?

Did you have leave to remain before?

Application is pending before Court of Appeal, but no grant of permission yet.

I am confident that Home Office will not win.

Yes i have leave to remain and just recently extended it.

How long does it take the court of appeal to decide whether or not to grant permission?
