My online prove your immigration still showing your application was refused and I’ve called the Resolution centre severally but nothing. My Euss appeal was allowed but HO now appealing the decision, my application is not the same as Akinsanya’s coz I have no leave.
I have asked my employer to do right to work check but I’m worried. We haven’t heard anything back yet

When it come checks on Right to Reside, Right to Rent and Right to Work, results should have comes within 24 hours but you know HO already, they always claim that the are overwhelmed with the request by lots of people so it could take at time even 2 - 3 months.
Your COA is enough and your appeal court papers are evidential that you still have the same Right before HO appealed.
Read your CoA and you will find it on the paper.
Your Employer has no right to ask you stop work as you applied before 31. 12. 2020 so you do not require permission from the HO to be here. You are still protected be Reg 16

Your employer is wrong as your CoA only expires when either given leave or absorbs your court process and there's nothing to be done.
I do not think that is right. The COA should be renewed every 6 months. That is how long it is valid for. Priory to its expiry, its holder must seek a renewal, which should have been issued automatically, especially if an appeal is pending.
That COA use to be issued during the transition and the 6 months window to apply.
At present there is no automatic right of residence per se.
That is not really my argument in relation to the COA. Under employer checking service policy, a COA is usually valid for six months and is sibject to renewal after that.

I think you will need to send a preaction protocol and threaten Home Office with Judicial review if they refuse to adhere to their undertaking before the High court, to continue confirming the rights to work for people like you until the reconsideration is completed.
Draw their attention to their legally binding undertaking and the fact your appeal was allowed and they are the ones seeking to challenge it. Make clear to them your employment is at risk, and you will most certainly seek damages for any penny lost. Make clear to them that they must desist forthwith from their unlawful act or you will approach the courts and they will lose.

Following the call, I instructed the employer to do another check, which came positive, all clear.
In line with all the other threads, HO does not issue another COA, but do believe that you could urge them together with some backing from your MP to issue you a bespoke letter.

Ho usually take maximum 7 days to reply when it comes to confirm your right to work. It happened a lot to me when I had the 6 months COA .

Obie all EEA COA have 6 months validity which is different from the EUSS one. There is no expiry date and its say that one should keep and use that COA until their case is decided or until appeal right exhausted. So with that COA even if it’s 2 years old an employer doesn’t have a right to stop the employee.

Yes because they don’t renew the EUSS COA as you can continue use it until you get a decision. And HO clearly say that. People need to understand that EUSS COA is different from EEA COA.
If it was EEA COA they would have renewed it without any problem every 6 months. I have been issue a COA every 6 months from 2016 to 2019 when I was dealing with my EEA permanent residence card. And I didn’t have any issue with HO at that time

ECS check is 7 days, I know that from my former employer
