Thanks for your reply, do you delete by filling another application with the same email address? I filled another FLR FP online form but it showed FLR M again when I was on the IHS payment page. Is it because I’m applying on the basis on the relationship with my partner? Because I’m confused at this point.

I think it’s a new thing when you pick the option of been married. I used that same link you posted like I already did before but it still showed FLR M as the visa type I’m applying for. I will add a cover letter to let them know what I am really applying for just to let them know.

I don't think so as they are a different route.

You I think is selecting wrong answers to the questions that are being asked as a parent of a British child.

Go over your answers especially from the beginning and choose the correct category

Couldn’t sort it out but explained it to them in a cover letter.

Hello all, it's a very difficult day for me. The HO called my lawyer that I got 2 application with them, I should say which one to be considered. I was on a 3 man phone call with them. I had no choice than to say the one I have spent my money for. It's like they are going to withdraw my EUSS.
So stressfull 😭😭😭😭😭

Is your lawyer not aware of the binding consent order signed at the high Court. He should be on top of his game.

There is no reason to withdraw any application, as Home Office said it will not be necessary.

Obie, I'm not quite surprise though following the refusal I shared on here. Tina I believe you have made the right choice that will pay off in the long run. Hang in there and hold tight.

I am not questioning choices. My point is she is entitled to have both application and should not be compelled to withdraw one application.

The Home Office have told the court that Zambrano applicant can have multiple applications. So there is reason for them to put her in that position.

I quite agree with you Obie. In the consent order they agreed applications will not be refused until the full review of their guidance. What I'm saying and Snooky has always mentioned on here in a nutshell is that HO believes they are above the law.

What do you do with a lawless department that does not follow law, you fight them back.

A friend of mine got a court order banning the deportation of a man to Jamaica, he has no option but to fight back for his return.

They sent me a COA too in February after a refusal. This is just funny 😏

Hi all,look at what HO has written to me as if I was the one who called them to withdraw the application meanwhile,they gave me 2 options to choose which one to be considered. Now their letter to me was as if I called and requested the withdrawal myself. Terrible people.

It is my clear reading of the judgment that a claim for a Zambrano derivative right of residence is not extinguished by the existence of a current limited right to remain and work awarded under national law. By contrast, I accept the implication in the judgment that if a person had been granted under national law indefinite leave to remain (with recourse to public funds) then that would, at any rate in theory, be a knock-out blow to a claim for a Zambrano derivative right of residence. This is because the rights claimed would be congruent with the rights already granted. I say "at any rate in theory" because it would be completely pointless to make a Zambrano claim in such circumstances.

Another updates, I contacted the hackney law centre on my case of the withdrawal of my zambrano, the lady I spoke with ,said I made a right decision for telling them that they should consider my leave to remain application. She said the reason being that, since I was already inthat routes, even if they (hclc) loose the case with the ho in December, I will still be on a safer side of my continues stay rather than me not having any leave and will be difficult for me where all the leave I first had, will be cancelled and i will start from a fresh.

Onthe other hand,
If they win,it will still be good for me because ho will give some time for those who were refused because of their wrong descision, to submit their application a fresh.
So she said i should not panic that i made a wrong descision and ho is doing everything possible to win the case but they are still fighting. She said they might be adjoining the case until end of 2022 who knows (she said).
That i should put and eye on it.

I served 7years in total instead of 10years because I showed my financial responsibilities to the HO ending about £18,600+/year. So it was reduce after my first submission.

I applied on 30th June and received a letter last Tuesday 17th to say it's not a COA but I have made application and to send all documents needed (I already did which was sent recorded mail) so it told me zilch really.

I’m still awaiting to hear from court after HO appealed the judge’s decision to allow my appeal. I want to ask some questions please if anyone can help.
It will be 10 years since I’ve been living here by February next year, I want to ask if I can apply for indefinite leave based on 10 long year route.
One of the years was as a student and aftet that I’ve been a family member of EU (Spouse) we’re still married legally but not together. My 5 years expired in 2019 and I’ve applied for EU settlement since then.
I’m I eligible to apply for 10 years long route please ?

This is not the correct place to ask about ILR. Please start a topic in the ilr sub forum to ask your questions. long residence ilr requires 10 years of legal stay, IE visas for the whole 10 years. Simply living in the UK is not sufficient.
