Hi guys, the Home Office and their incompetence really makes me laugh. I have finally received their standard copy and paste email but the funny thing is that my leave to remain as a parent expired last year on 04/10/2021, so I currently don't hold any leave. Their email does not make sense!!

"You applied to the EU Settlement Scheme (EUSS) as a ‘person with a Zambrano right to reside’.

The definition of a ‘person with a Zambrano right to reside’ provides, at paragraph (b), that the person must be without leave to enter or remain in the UK, unless this was granted under Appendix EU (see Annex 1 to Appendix EU).

You currently hold leave to enter or remain in the UK under Family/Private Life until 04 October 2021.

The effect of paragraph (b) is that a person who held UK immigration leave (other than under Appendix EU to the Immigration Rules) could not meet the Appendix EU definition of a ‘person with a Zambrano right to reside’.

However, in the case of R (Akinsanya) v Secretary of State for the Home Department [2021] EWHC 1535 (Admin), the High Court ruled that paragraph (b), and the parts of the guidance – EU Settlement Scheme: person with a Zambrano right to reside – addressing that provision, were unlawful and ordered the Secretary of State for the Home Department (SSHD) to reconsider the relevant provisions of Appendix EU.

As a result of the High Court’s decision, the SSHD agreed, by way of a consent order dated 17 June 2021, that she will not determine applications made under Appendix EU on the basis that a person is or was a ‘person with a Zambrano right to reside’, where their case is affected by the decision in Akinsanya, until after she has completed her reconsideration of Appendix EU.

Given that you currently hold leave to remain in the UK 04 October 2021, your application is directly affected by the decision in Akinsanya.

The Court of Appeal dismissed the SSHD’s appeal on 25 January 2022 and the SSHD is considering the implications of the judgment. In the meantime, your application cannot yet be decided. A decision will be made as soon as possible once the SSHD has completed her reconsideration of Appendix EU, as required by the consent order.

The SSHD does not consider that any detriment arises as a result of the hold on your application. In accordance with the consent order, as you made a valid EUSS Zambrano application by 30 June 2021, your certificate of application can be relied upon to confirm that your rights to work, study and (in England) rent a place to live are protected until the final determination of your EUSS Zambrano application (including the outcome of any appeal). As noted above, you also hold leave to enter or remain in the UK until 04 October 2021"

🤣 whomever that case worker is didn't notice that 4th October 2021 has long gone. When they sent mine, they said my leave is expiring in May 2022 while my leave already expired in September 2021 though I put in application for renewal. Confused.ho.caseworker is just what is happening there. God will help us all. One day it will all be a testimony.

As funny as there emails might sound. The sole basis they still sent you that is because during your qualifying period you have held a leave to remain. I would assume you applied for settled status? So they will tell you that in trying to figure out if in the 5 years you held a leave then you are affected by the Akinsaya case. I will share a correspondence i received from them last year for you to understand better.

The SSHD has been granted permission by the Court of Appeal to appeal against the High Court’s decision. The Court of Appeal hearing is due to be held on 7 or 8 December 2021.

In the meantime, as a result of the High Court’s decision, the SSHD agreed, by way of a Consent Order dated 17 June 2021, that she will not determine applications made under Appendix EU on the basis that a person is or was a ‘person with a Zambrano right to reside’, where their case is affected by the decision in Akinsanya, until after she has completed her reconsideration of Appendix EU. Any reconsideration of Appendix EU by the SSHD will not take place until after the appeal proceedings have been concluded and the outcome of the SSHD’s appeal is known.

As you held leave to remain in the UK (other than under Appendix EU) at the end of the transition period on 31 December 2020 and during the continuous qualifying period on which you are relying in your EUSS application, the SSHD considers that your application may be affected by the decision in Akinsanya and therefore cannot yet be decided.

The SSHD does not consider that any detriment arises as a result of the hold on your application. That was the response i received following my email to their Director. For the highlighted reason no one understands what angle they will be taking in the forthcoming changes in Appendix EU. They are also refusing few people where the other parent (carer) has a settled status in light of the Velaj case which is due to be heard at the appeal court sometime in June, but that is arguable in court as its not in accordance with Paragraph 16 (8&9) of the EEA reg nor appendix EU. We are waiting to see what happens on the 25th April.

For those who might have been refused based on the afore mentioned reason you need include the following in your argument. The words “both primary carers” have been added to reg 16 (5) to reflect the effect of reg 16 (9) and the words in italics in (8) (b)(ii) were deleted by operation of the Immigration (EEA) (amendment) Regulations 2018 SI2018/801. Prior to that amendment, the appellant would not have been entitled to a derivative right of residence as his wife is an exempt person.
13. The explanatory memorandum to SI 2018/801 provides:
Paragraph 10 of the Schedule to these Regulations amends the 2016 Regulations so as to give effect to the judgment of the CJEU in the case of C—133/15 Chavez-Vilchez and others. It does so by amending regulation 16(8)(b) of the 2016 Regulations to allow a person to be recognised as a "primary carer" if they are the sole carer or if they share equally the care with another person, regardless of whether that person is an "exempt person" within the meaning of regulation 16(7)(c).

Your application has been carefully considered but from the information and
evidence provided or otherwise available you do not meet the requirements of
the scheme. I am sorry to inform you that your application has therefore been
refused.
The remainder of this letter details the reasons your application has been
refused, what you can do next and the help available from us.
In making this decision, we have complied with our duty under section 55 of the
Borders, Citizenship and Immigration Act 2009 to have regard to the need to
safeguard and promote the welfare of any children who may be affected by the
decision, namely xxxxx xxxxxx xxxxx xxxxx. This duty cannot on its
own satisfy the eligibility requirements of the EU Settlement Scheme for a
person with a Zambrano right to reside, but in assessing your application, the
child’s best interests have been a primary consideration.
Reasons why your application has been refused
We have considered whether you meet the requirements for settled status (also
known as indefinite leave to enter or remain) or pre-settled status (also known
as limited leave to enter or remain) under the EU Settlement Scheme.
Unfortunately, based on the information and evidence provided or otherwise
available, and for the reasons set out in this letter, you do not meet the
requirements.

To qualify under the scheme you need to meet the requirements that are set out
in Appendix EU to the Immigration Rules. You can find out more about the

You have applied to the EU Settlement Scheme as the primary carer of a British
Citizen living in the UK. Your application has been refused because the
information available to us does not show that you are a ‘person with a
Zambrano right to reside’ on this basis.
To qualify for settled or pre-settled status as a ‘person with a Zambrano right to
reside’, you must have a right to reside in the UK because you meet the
relevant requirements in the Immigration (European Economic Area)
Regulations 2016 (‘the EEA Regulations’). As you state that you are the primary
carer of a British citizen, it is regulation 16(5) that is relevant in your
circumstances. However, we are not satisfied that you meet the requirements of
regulation 16(5) because:
You have not demonstrated that xxxxx xxxxx xxxxx xxxxxx would be
unable to remain in the UK if you left the UK for an indefinite period because it
is apparent that there is a an alternative carer that could care for xxxxx xxxxxx xxxxx xxxxxx in your absence. In your application form, you state
that xxxx xxxxx xxxxx xxxxx father xxxxx xxxxx also resides
with yourself and xxxx xxxxx xxxxxx. xxxxxx xxxx and is settled in the UK. As xxxxx xxxxx xxxxx xxxxx father has ILR and resides with your sponsor,
xxxxx xxxxx xxxxx xxxxxx would not be required to leave the UK if
you left the UK for an indefinite period.
As there is an alternative carer available for your sponsor, and your sponsor
would be able to remain in the UK if you left for an indefinite period, you do not
meet the requirements to be issued under Zambrano. As a result, your
application falls for refusal on this occasion.

It is considered that the information available does not show that you meet the
eligibility requirements for settled status set out in rule EU11 of Appendix EU to
the Immigration Rules or those for pre-settled status which are set out in rule
EU14 of that Appendix. Therefore, you have been refused settled status and
pre-settled status under rule EU6.
We are currently working remotely due to COVID-19 and only have access to
electronic copies of the documents you submitted in support of your application.
We are therefore unable to return your supporting documents at this time.
However, steps will be taken to return your documents as soon as possible. In
the meantime, please ensure that you keep us up to date with any change of
address to ensure that documents are returned to the correct location. We

Blessed Child hahaha you're absolutely right my dear, our HO Caseworkers seem to be a bit confused, as our leave has already expired. It seems some of them are not even bothering to check our records/ case files properly 😂😂😂. In deed God will definitely help us all, hopefully we are now near the finishing line.

Lagosbos, wow thanks a lot for the detailed information you have provided. I can now see the angle that they are taking in regards to those that had leave as a parent/ family, even though it has now expired. It's certainly an eye opener.... The Velaj case is an interesting one especially for those who have partners with settled status, they must pay close attention to it and also make a note of the legal argument you have pointed out. Netqueen, did you have to apply for a BRC replacement? I recall that your BRC also ran out on June 30, 2021. I have been advised to apply for a replacement as I won't be sent one automatically because I had a valid card at the time I made my application.

So does it mean they didn’t send any BRC nor stamped anything in ur passport lagosbos? So how do u travel and show ur status coming from outside the country ?

I was issued a BRC under EEA reg last year for a short period between mid-May and the end of June, during which I reapplied for settled status. Even after settled status they still complicate it! Why can't they just make it easy and post you whatever it is they give people with settled status?

I know right, it feels like the battle is never ending. I was able to apply for a BRC replacement for free last Wednesday and I got an email today requesting that I use the IDV App for ID verification and uploading few documents (proof address, expired BRC and consent form), which is good as I was already dreading booking an appointment at one of the biometric enrolment centers. I am now expecting a new BRC to be delivered to me at some point. All the best!
