Hi everyone,

I need some advices for applying under ZAMBRANO. I am having leave and remain under 5 years route as a parent of British child, it has been granted in November 2019, and my visa will expire on 14th June this year. Could I apply under Zambrano EU settlement scheme as I know it's free? I have lived in the UK since October 2015 legally until now. If I apply as Zambrano, can I get settle status? Or it will be pre-settle? Hope someone know and give me advices. I greatly appreciate that. :) :) :D

As for me I will suggest since you still have time till your visa expires in June, quickly put in a Zambrano application before an out come in May as promise by the HO. Call for the form or print it out immediately. You got nothing to loose. Thanks

I would be grateful if you can guide me wht we should do… previously asylum seekers…finally got 2.5 after further submissions based on british child. The child became citizen in oct/nov 2017. Recently got second LTR extension ending in april 2024. When this akinsanya case came we got the EUSS forms by email but didnt apply as wasnt sure wht the outcome would be.

Should we apply for Zambrano application now or carry on wd LTR process?

Congratulations mubashir1981 - what did you say to the home office when you complained? So the parents of the child were not British at all? Is the baby classed as British now?

Strange, why HO is asking again for Originals. May be HO is trying to decide individually by case to case. But HO will never let anybody know why, where and when ,what to do.

What is classed Pre-Settlement status in Zambrano terms? Is that when you have been in the UK for less than five years?

Then would 5 years+ mean Settled status in Zambrano terms?

If you have been in UK for 5 years and British child is less than 5 years old? is that Pre-Settlement status in Zambrano terms?

From my understanding the Zambrano is a derived right. From the time your british child was born, that right was conferred on you. However, you still have to make a formal application which you can show to employers, landlords etc that you have a right a to enter or remain in the UK.
If the above explanation is correct, therefore, if your BC is >= 5 years on the date a decision is made and has been with you from birth (subject to evidence), then you should get settlement status. On the other hand, if BC is less than 5 at the date a decision is made, you should get pre-settlement status.

However, this does not seem to be the way HO is applying the logic. Apparently, HO's cut-off point is the date the application is received. Let's say, suppose your BC is 4.5 years at time of application and a decision is arrived at 12 months later when the BC is already 5+, HO grants you pre-settled status for 5 years and not settlement status, which in my opinion is wrong. However, some people re-apply with supporting evidence requesting settled status.

The above explanation is my personal interpretations and not sure what the correct interpretation is. I will leave the gurus in the house to through more light on this.

I know this is not the answer you were looking for, but guess it does gives you some perspective.

Can some please advise on the following questions:

When a Zambrano application is submitted to the HO, how long does it take them to respond to say they have got your application? Is it a week, a month? a couple of months? Not a decision but to say they have your application?

Once the HO hopefully make a decision on 16th May 2022, do they let you submit NEW applications? What time window do they give you (couple of weeks? a month?).

If you have british child before 31st Dec 2020 and have been with that child from birth, but the british child is less than 5 years old on 16th May 2022 (assuming HO make decision on 16th May 2022), would your application get approved? Just trying to work out what HO would approve

Hi Every one,

Application for my new born baby who born in back in may 2021 is refused 2day. me and my wife hold pre settle status. refusal says you are unable to apply on this basis my child born after dec 2020 and do not fulfill requirement for being dependent on zambrano.

Any advice please. should i go for appeal.

Hi Mate, when you say you hold pre-settle status - have you been granted that or you applied for that and they have rejected you?

They are basically asking you to put in a FLR FP application for your child. Considering your child wasn't born by the Exit day they are not protected by the withdrawal agreement and Appendix 16 (6) of the 2016 EEA reg. You have two options. If you don't have an urgent need to take your child abroad you can wait till you get settled status and register your child as British Citizen afterwards or you apply for an FLR FP - Leave to Remain if urgent and pay necessary fee.

We applied after 31st of June 2021 we receive the documents back fingerprint letter two months ago Done the fingerprints four weeks ago. today Home Office contacting us wanted email address and telephone number this happen to anyone else? Is it a good sign

If British child is less than 5 years , Pre-Settlement status in Zambrano terms.
If the British child is 5 yrs or more than 5 years old then you will get Settle status.
if you applied as zambrano carer and ur child was under 5 years but the decision comes when ur british child is over five years then HO should give you Settle status or you can apply Settle status strait way after getting the pre settle status.

They do that. Just call them and do so. If you don't already have COA. They will issue you.

Hi everyone!

I’m super thrilled to say that I have just checked online and my status have been confirmed for Settled Status. It was a long battle HO initially withdrew permission to appeal after Akinsanya’s but then went ahead to re-instate their withdrawal but the upper tribunal refuse HO’s permission on 25th of March and received further communication from HO that grant of leave have been requested no further communication until today I received a journal from universal credit that status status have been confirmed, so I checked my immigration account and saw my face on their confirmed for Settled status. I’m screaming!!!! My whole body is shaking. 2 years journey finally come to end.
I want to specially thank everyone on here particularly Snooky, I had no idea I could appeal the HO’s refusal until I stumbled across this platform and wouldn’t have done it without this platform. Thanks and I wish everyone else waiting best of luck ❤️
