At this stage they are looking to see whether you qualify for Settled or pre-settled status. So it’s a very positive letter.
Even if HO should not be trusted 100% but your time has come. I am an optimistic person, this letter says all. You are going to receive a good news from them 🙏🏽🙏🏽

I think what's it's saying is that if you cannot provide evidence that u have for 5 continuous years to qualify for settled status, they will consider the application based on how many years u are claiming as a person with zambrano rights.

Because the guidance fr settled status is that u are able to combine any period spent on other EU rights with the zambrano rights to make 5 years for settled status. If u don't have any, then it's only based on zambrano period which are if less than 5 is pre settled.

Hope it makes sense.

When I applied for mine, that' was the case. I was 1 year short on zambrano so they granted me pre settled. Now I am due settled so have applied.

Based on HO request, make sure at least 5 years documentation are sent and has been arranged in order. It could be 6 months periodic information in each year.

Make sure dates are following each other and GPS or School Letters specifically states dates (From and To)

Below a paragraph written by Hackney law centre after the court of appeal judgement. So I believe that the court of appeal judgement supersede J Mostyn ones.


“The Court of Appeal found that, in setting the EUSS Rules, the Home Secretary had misinterpreted the Zambrano provisions under UK law, which did not expressly or impliedly exclude those with existing leave to remain from Zambrano rights. However, the Court found that the Home Secretary had correctly interpreted the scope of the Zambrano right under EU law, which only arises where the carer has no domestic (or other EU) right to reside.”

Every law of precedent supersedes other but one thing about High Court and Appeal Court ruling is that these points the judges used can be referenced within anyone's Skeleton Argument.

Rulings from the top courts are use to make cases and that's why the judges also quote from there to make cases to pin down lawyers

They didn’t send me a COA until I emailed the HO lawyer and got emailed a COA.
I then called EU resolution centre and they updated the prove your status link and I could then see my COA online.
At one point I also had a problem getting a share code, the HO lawyer notified EU resolution centre and they called me to sort it out.

@Lulubaby congrats in advance and try to add as much evidence as possible. If you recall, I was asked to provide additional evidence twice before being refused under the guidance that I have previously applied under through the Parent Route. With the new guidance, the burden of proof is on you to show if you are refused, it will compel you and your child to leave the country. If possible try and get letters from close family and friends to push your point. All the best 🙏🏾
That was the first thing that came to my mind as soon as I read the letter, it sounded familiar. I immediately remembered how they asked me for further evidence, only to refuse my application. You’ve explained that there is a difference between this letter and the one we received last time, asking for additional evidence - with this one the burden of proof is on me to prove. I am already making calls and getting all ready.

Be careful though as many letters from families could suggest to them that there are families who can step in should u leave the UK.
I will give you an example: When my derivative residence application was refused, I appealed. Right at the beginning of the hearing, the HOPO said to my lawyer that he was surprised of the refusal letter, meaning I should not have been refused, however said he was there to do his job so we carried on with the hearing. In my cross examination, I was asked if I had any family members in the UK, I said I had a cousin. That was it. Surprisingly, in the HOPO s closing statement, he argued that my cousin could look after my child. My lawyer intervene saying that it was unacceptable for him to assume that my cousin could do so without knowing what her circumstances were. The judge agreed and I won my appeal

It is easy for the home office to turn things round to suit them so just bear that in mind. Sometimes less is more.
