The Home Office argument revolves around two points. The EEA Regulations and the "Zambrano Jurisprudence." So, it's one point down, one to go.

Hopefully, you all got something from the posts. This forum is becoming a bit too negative for me so I will have to close the account. I just picked this up a couple of days ago, after a long time, and thought I would add my analysis. If you remember from last time, I am NOT one to just say my conclusions... I develop them, hence the references.

In closing, I will say that I think Zambrano carers will succeed at the Supreme Court, if it gets that far. Hopefully, all decisions will be put on hold and people will be able to live their lives normally in the interim period. Take care of yourselves.
Please don't close the forum. I believe majority of us are benefiting from your detailed analyses on the Zambrano jurisprudence. I personally wouldn't have applied to the EUSS if not for the information provided by members like yourself, Snooky and others. I can testify that I used all the information posted here to support my friend to get her settled status, the battle of which started in 2019. We did this against the numerous advice of many Radio and facebook lawyers who thought anyone with limited leave to remain under Appendix FM was not entitled to get a status under the EUSS. Many thanks for your posts. We appreciate them.

There's no news yet. Just waiting but I have been told that there's the possibility that the SSHD might delay decision-making on Zambrano applications as AKinsanya has now raised another judicial review based on the new policy/guidance of the SSHD.

The grounds are that the policy is irrational and discriminatory. A date of the hearing has not been decided yet but I'm told that it might be September/October.
Oh God! Will this ever come to an end?.

After reading the link below posted by a member, (to be free) I have been trying to second guess the home office, especially on the section where it discussed those who had Zambrano rights before getting a ltr then didn’t have another ltr after 31st December 2020.

This is unfair on us who do not have any leave at least to take our kids on holidays.
I understand it’s not fair as all Zambrano are Zambrano wether they old leave or not. But those with valid LTR can at least travel while waiting. But what about us? Been waiting for 3 years???? I’m sick of this!
I hope they will only put decisions on hold for those with LTR. And give decision for those without leave!
I can’t wait any longer! I’m tired! My mental health has been affected! My kids can’t go anywhere! Dad died they couldn’t even go to his funeral! Been stuck into this country for 7 years! Last travel was 2015! I’m really sick of this!

Exactly, being stuck in the UK without the ability to travel.
To be honest I was even expecting that they will definitely give you your positive decision as soon as they started giving others this year.
You never had any leave at all. What is their excuse?.
I phoned a friend of a lady I met during that period my child and I were sent to Birmingham during that asylum period and gave her all the information I got from this forum. I was always giving her feedbacks just like Snooky and the rest were giving us on this forum, asking her to hang on. Meanwhile her lawyer told her it will never work out. She too had never had any leave at all, overstayer too but the father of her baby also has something to do with EU but the baby has a British passport.
She applied for Zambrano, last year HO asked her to apply for that Ibrahim one. She did. She already lost hope, she doesn’t have my number but I always call to check up on her. I kept getting info here and encouraging her. I called her some days ago and she told me she has been looking for how to reach me. She told me that last month HO gave her Settled status.

I just rang the Eu settlement. I was crying explaining my frustration to them. I told them that I am going to write a letter to leave for my relatives and that if anything ever happened to me it’s going to be on the home office.
I also wrote to my MP.
I have been patient for so long! I can’t take it no more!

I am new to this forum but I have been following this forum and reading people stories. Would like to put mine out here maybe it can encourage some that are discourage. I applied on the 30th of may for the Su settlement as a primary carer of a British citizen. I went in to put my biometric on the 10th of June, on my way home on that same day I got a call from someone from the home office requesting a clear picture of my biometric resident permit. I send it on that same day, on the 26th of June I receive an email for proof of my resident from 2017-2019. I send it to them on that same day, I send all the bank statements. On the 4th of July I got my settlement status. I was on 10 years route. This was my 2nd time to renew, I renewed my 2.5y last December and it’s still valid. I am a single mum to a British citizen who is 6yrs. Just to encourage anyone not to loose hope, when you pray God listen to his kids. God is good🙏🏿

Wow congratulations. I tap into this testimony because I am also on my 2nd time renew 10 year route and single mother to a 6 year British child, I pray that the God that did yours will do mine too.

Thanks ,No I didn’t have a derivative card. That was the first time I applied anything under Eu settlement.

You won the lottery. Most of us here are parents to British children. Have been on .2.5 years expired and in for extension. Applied for EU settlement scheme June 2021. Confused, angry and feeling helpless. We have prayed...

There's no news yet. Just waiting but I have been told that there's the possibility that the SSHD might delay decision-making on Zambrano applications as AKinsanya has now raised another judicial review based on the new policy/guidance of the SSHD.

The grounds are that the policy is irrational and discriminatory. A date of the hearing has not been decided yet but I'm told that it might be September/October.
When will this end????
This is unfair on us who do not have any leave at least to take our kids on holidays.
I understand it’s not fair as all Zambrano are Zambrano wether they old leave or not. But those with valid LTR can at least travel while waiting. But what about us? Been waiting for 3 years???? I’m sick of this!
I hope they will only put decisions on hold for those with LTR. And give decision for those without leave!
I can’t wait any longer! I’m tired! My mental health has been affected! My kids can’t go anywhere! Dad died they couldn’t even go to his funeral! Been stuck into this country for 7 years! Last travel was 2015! I’m really sick of this!
Exactly, being stuck in the UK without the ability to travel.
To be honest I was even expecting that they will definitely give you your positive decision as soon as they started giving others this year.
You never had any leave at all. What is their excuse?.
I phoned a friend of a lady I met during that period my child and I were sent to Birmingham during that asylum period and gave her all the information I got from this forum. I was always giving her feedbacks just like Snooky and the rest were giving us on this forum, asking her to hang on. Meanwhile her lawyer told her it will never work out. She too had never had any leave at all, overstayer too but the father of her baby also has something to do with EU but the baby has a British passport.
She applied for Zambrano, last year HO asked her to apply for that Ibrahim one. She did. She already lost hope, she doesn’t have my number but I always call to check up on her. I kept getting info here and encouraging her. I called her some days ago and she told me she has been looking for how to reach me. She told me that last month HO gave her Settled status.

I just rang the Eu settlement. I was crying explaining my frustration to them. I told them that I am going to write a letter to leave for my relatives and that if anything ever happened to me it’s going to be on the home office.
I also wrote to my MP.
I have been patient for so long! I can’t take it no more!

It sounds good to be true lot of us waiting from last year June. In my case called them 8 times including today in last 6 weeks for CAO and Drot just received good news today.
Congratulations 👏 Good luck.
I can't believe they not giving me CAO and I am struggling to get Job not having CAO or Share Code.
So frustrating 😫

Am new to this forum . I applied for student finance but they put my application on hold saying they cannot use my COA . Student finance are saying they are going to wait till I get my status . Any advice please 🙏 how did you get approved for finance with COA?

@Jo2022 The student finance agent seems to be clueless. You're still entitled to student finance with your COA. Please see page 153 of this forum, where this issue was discussed in full detail. Send the following link to student finance, it might help:

U might have started an online EUSS application some months ago and abandoned it, from may be realising it's the wrong form. I remember some people applied their zambrano online before they were told to use paper application form. It's an automated email when your application has not Ben completed or left inactive for a while. These applications have a timescale to be deleted.
