Hi, thank you for the information. How does one state the policy is discriminatory and unlawful in legal terms for the purpose of a skeleton argument in an appeal.

@lulubaby, congratulations. I had every hope that this time you were going to be successful. I think we all could feel this.

So, are they basically saying that your zambrano status starts from 2020 when your LTR expired?

I'm sure this can be challenged but for now you have stepped on the right track and we are thankful to God for that. One step at a time love and you will get there. No more 30 monthly renewals and hefty fees.

If your case is similar to Akinsaya's, you can let her barristers do the work. You just need to keep your claim active.

I think you only have 2000 words or characters? You should keep your points simple. Don't worry about getting it perfect. The judges are not expecting a lot from you. By the time your claim is heard, there will be new updates on the Akinsaya case, anyway. Akinsaya may be settled soon, and you could benefit if she wins. All of the action will be around the Akinsaya case, as long as it keeps going.

The problem as I see it is, the Court of Appeal seems to agree with the Home Office. The "win" for Zambrano carers, as it was reported earlier this year, was not a win. The Court of Appeal basically gave the Home Office hints on how it could deny Zambrano carers like Akinsaya. The Court of Appeal essentially told the Home Office how to rewrite its policy. Even Mostyn's decision gives the Home Office space to rewrite the rules. The Courts can only interpret what has been decided by Parliament and "rule makers".

At the end of the day, there is almost certainly someone with a very similar background to you, who was given settlement. It seems like Akinsaya's legal team are going to have to make this argument for everyone, if they choose to. But I could be wrong. All you can do is briefly mention the fact that people with a similar background to you are approved

(The majority of Zambrano carers are rejected. It seems a significant percentage of people on this forum are approved. You may want to consider how that could be.)

Did you get limited leave to remain under Appendix FM and then get a derivative residence card? Or, did you get a residence card and then get limited leave to remain under Appendix FM?

Some people would say it doesn't matter, but I get the impression some judges feel a Zambrano right can not "arise" if you already had limited leave to remain under Appendix FM.

I put some quotes in earlier posts from the judges. You can also use ones that make sense to you.

I came here illegally 2018 in 2019 I was granted Visa 2 1/2 years 10 years route But at the end of 2019 my partner had an accident at work which he still suffering today And cannot work because of this. Applied for Zambrano June 2021 because we could not afford Visa fees as there is no income homing i apart from universal credit that my partner gets. I also applied for my extension Visa in April 2022 Still awaiting decision in both application or British three year old daughter was born here. I am the prime care of our daughter because my partner is not well enough to look after her

I didn’t even bother opening the envelope because I concluded it was my supporting documents. I will check when I get back. I am not at home.

It sounds like you are dealing with a lot.It also sounds like you have a good chance of being considered a Zambrano carer. You may want to contact your MP. They may contact the Home Office and ask them to make a decision sooner.

So, limited leave to remain under Appendix FM in 2019 and Zambrano in June 2021.

Ideally, you should keep your Zambrano application going until Akinsaya's claim is finally decided. If you get refused on your EU Settlement you can apply for administrative review for 80 or to the First Tier Tribunal for 80. Or you could apply to both. You have 14 days to apply to the First Tier Tribunal.

I can't tell if you have recourse to public funds or if you are restricted from public funds. There are charities that can help you apply to get a restriction lifted for no recourse to public funds.

It sounds like you are dealing with a lot.It also sounds like you have a good chance of being considered a Zambrano carer. You may want to contact your MP. They may contact the Home Office and ask them to make a decision sooner.

So, limited leave to remain under Appendix FM in 2019 and Zambrano in June 2021.

Ideally, you should keep your Zambrano application going until Akinsaya's claim is finally decided. If you get refused on your EU Settlement you can apply for administrative review for 80 or to the First Tier Tribunal for 80. Or you could apply to both. You have 14 days to apply to the First Tier Tribunal.

I can't tell if you have recourse to public funds or if you are restricted from public funds. There are charities that can help you apply to get a restriction lifted for no recourse to public funds.

You should do a complete timeline like this

Dear XXX MP,

I write to request your help with two outstanding applications with the Home Office. The first application is for settlement under Appendix EU. The second application is to extend my leave to remain under Appendix FM.

My British partner was injured in 20XX and can not work. I am the sole carer of our 3 year old child. We struggle financially.

I would like your help to accomplish either (or both) of the following:
1.) A faster decision on my outstanding Zambrano application under Appendix EU
2.) The removal of no recourse to public funds on my Appendix FM visa

My immigration history is as follows:
January 2018 - I arrive on a 3 month visitor's visa
April 2018 - My visa expires. I am an overstayer.
January 2019 - I apply for limited leave to remain under the 10 year route. I am granted limited leave to remain for 2.5 years
February 2019 - I give birth to my son in the UK

You should do a complete timeline like this

Dear XXX MP,

I write to request your help with two outstanding applications with the Home Office. The first application is for settlement under Appendix EU. The second application is to extend my leave to remain under Appendix FM.

My British partner was injured in 20XX and can not work. I am the sole carer of our 3 year old child. We struggle financially.

I would like your help to accomplish either (or both) of the following:
1.) A faster decision on my outstanding Zambrano application under Appendix EU
2.) The removal of no recourse to public funds on my Appendix FM visa

My immigration history is as follows:
January 2018 - I arrive on a 3 month visitor's visa
April 2018 - My visa expires. I am an overstayer.
January 2019 - I apply for limited leave to remain under the 10 year route. I am granted limited leave to remain for 2.5 years
February 2019 - I give birth to my son in the UK

If your case is similar to Akinsaya's, you can let her barristers do the work. You just need to keep your claim active.
I am a partner to the British citizen And we have three old girl British citizen. I came here illegally 2018 in 2019 I was granted Visa 2 1/2 years 10 years route But at the end of 2019 my partner had an accident at work which he still suffering today And cannot work because of this. Applied for Zambrano June 2021 because we could not afford Visa fees as there is no income homing i apart from universal credit that my partner gets. I also applied for my extension Visa in April 2022 Still awaiting decision in both application or British three year old daughter was born here. I am the prime care of our daughter because my partner is not well enough to look after her
It sounds like you are dealing with a lot.It also sounds like you have a good chance of being considered a Zambrano carer. You may want to contact your MP. They may contact the Home Office and ask them to make a decision sooner.

So, limited leave to remain under Appendix FM in 2019 and Zambrano in June 2021.

Ideally, you should keep your Zambrano application going until Akinsaya's claim is finally decided. If you get refused on your EU Settlement you can apply for administrative review for 80 or to the First Tier Tribunal for 80. Or you could apply to both. You have 14 days to apply to the First Tier Tribunal.

I can't tell if you have recourse to public funds or if you are restricted from public funds. There are charities that can help you apply to get a restriction lifted for no recourse to public funds.
