Anyone who was refused on the same grounds as Akinsaya before the Court of Appeal, should be refused now.

If you compare the refusal reasons, they are arbitrary. There is no consistency.

But the Home Office does not really matter at this point. It is clear they are making decisions based on factors they are not willing to admit publicly.

What matters now are the judges. The Courts need to be asked directly, whether or not they support the Home Office's policy of refusing thousands of Zambrano carers for having limited leave to remain under Appendix FM, while accepting others with limited leave to remain under Appendix FM.

The Courts represent the UK. They are the bellwether to show us where the country is heading. Zambrano carers are lucky, in that regard. They get to see, first hand, the country's true beliefs.

If the Courts see nothing wrong with the decision making process, it is their prerogative. But it questions why one would dedicate their best years to a country that is run like a banana republic?

The policy is clearly discriminatory; and, therefore, unlawful.

I would not trust any decision by the Home Office. Just as easily as they can randomly grant residence, they can randomly take it away.

I was really trembling because I saw a mighty envelope from HO and ignored it and concluded it was the information they requested which I also sent to them by post. Then I checked my email just to fulfil all righteousness, what did I see *OFFICIAL SENSITIVE *, European Caseworker Decision Service. I melted....

Hi, thank you for the information. How does one state the policy is discriminatory and unlawful in legal terms for the purpose of a skeleton argument in an appeal.

So, are they basically saying that your zambrano status starts from 2020 when your LTR expired?

I'm sure this can be challenged but for now you have stepped on the right track and we are thankful to God for that. One step at a time love and you will get there. No more 30 monthly renewals and hefty fees.

I came here illegally 2018 in 2019 I was granted Visa 2 1/2 years 10 years route But at the end of 2019 my partner had an accident at work which he still suffering today And cannot work because of this. Applied for Zambrano June 2021 because we could not afford Visa fees as there is no income homing i apart from universal credit that my partner gets. I also applied for my extension Visa in April 2022 Still awaiting decision in both application or British three year old daughter was born here. I am the prime care of our daughter because my partner is not well enough to look after her

It sounds like you are dealing with a lot.It also sounds like you have a good chance of being considered a Zambrano carer. You may want to contact your MP. They may contact the Home Office and ask them to make a decision sooner.

So, limited leave to remain under Appendix FM in 2019 and Zambrano in June 2021.

Ideally, you should keep your Zambrano application going until Akinsaya's claim is finally decided. If you get refused on your EU Settlement you can apply for administrative review for 80 or to the First Tier Tribunal for 80. Or you could apply to both. You have 14 days to apply to the First Tier Tribunal.

I can't tell if you have recourse to public funds or if you are restricted from public funds. There are charities that can help you apply to get a restriction lifted for no recourse to public funds.
