I have been refused . just received any email just now, my case is similar to Akisanya's case, I had a derivative resident card from 2015 to 2020
And Leave to Remain from 2015 renewals till now

Sorry for your refusal, just follow the trend as usual and file for appeal . Go all through this thread, you will see how to go about it for if you are waiting on people who could help onthis forum, you will be waisting your appeal time. Just try your luck and put on an appeal. Nyamebeye and whyworry could help you if you are stuck somewhere.

Finally got my settled status today.
To help this is my timeline. I did not have limited leave to remain at any point.
I am a joint primary carer with my husband who is on the 10 year parent route based on this same British Child of ours.

Jan 2018-Applied for derivative residence after registering my child upon reaching 10yrs in 2016.
Application refused. Appealed and won, Home Office appealed to Upper Tribunal. I won again there.
July 2019- Derivative granted
Nov 2019- applied for EUSS pre settled
Feb 2020-pre settled granted
Feb 2022-applied for settled
Oct 2022- settled status granted

To say I am relieved is an understatement. We thank God and everyone here who help us to remain sane.

Just to add that my husband who has limited leave applied together with me this time for settled status. He has not received a decision yet. I only received a decision today. We await to see what they will come up with.

Please if anyone have experience on this kindly guide me.

I still have pending appeal and my COA is still valid

I made application to one of the university and I was offered admission and my students finance application was successful . But University that offered me admission is refusing to accept my students finance and that they wanted to charge me “overseas fee” because base on my LTR because they couldn’t believe my student was successful

Now the Uni is still insisting on charging me overseas fees despite all my efforts .
I have already started the university but I got stuck.

Any suggestions please

University' s have their own policy of determine student fee status. One could be eligible for student finance and be offered the loan, however Universities can still classed them as overseas and vice versa.
You need to request from the University how they established your overseas fees status (full assessment criteria used). That's what I will do if I found myself in this situation.

Being eligible for student finance alone will not be enough to be classed as home student.

When I did my Masters in 2012, the University classed me as home student but then NHS bursaries refused to offer me bursary so my plan was to pay for the fee myself. It was £5000 each year for 2 years. On my first day at the university, I got an email to say I have now been offered the NHS bursary. I could not believe it.
In my case, the uni put me forward for the bursary this time.
Don't give up. Ask for their fee status criteria.

My husband's settled status application has been unsuccessful. Same refusal reasons they give to anyone with limited leave to remain. We kind of expected that having read here of their pattern.

He still has his 2.5yrs which was being renewed alongside the Zambrano EUSS so we can carry on living our lives. He did not allow the LTR to expire.
We shall appeal the Zambrano but really this is to buy time while the Akinsanya battle is concluded.

His decision letter was dated yesterday same as mine but they chose to send it to him today.
Joint primary carers, one granted one refused. Home office will never cease to amaze me 🤦‍♀️🤦‍♀️ Hahaha.

I submitted my appeal on August 15th still no any acknowledgment despite I submitted twice ( email Aug 15th and September 15th).

Thanks Nyamebeye, They assessed my fees base on my LTR “ Overseas fees” as they said they won’t enrol me with pending application ( EUSS)

Despite it is their website they stated would allow COA to enrol . If it wasn’t stated in their website I wouldn’t have go ahead,

I still don’t know the next step to take because of the Uni that was the reason I made Zambrano application as I still got one renewal left to complete 10 yrs .

My appeal was pre-pandemic. Honestly I can't remember how long it took for acknowledgement/ the initial response. I will say abt a month. The longer time was rather waiting for a hearing date but even that it was between 4-6 months. With the pandemic, everything changed with correspondence taking forever.
Pls contact HMCT to check that your appeal has been received. They will take you through security on the phone and check for you. Then at least you have that peace of mind.

@Whyworry - This is a copy of the letter which I sent to the University when they had initially refused me admission as a home student. They later reversed their decision:
Good afternoon Admissions,

Thank you for your email and I hope you're well.

I have been speaking with Student Finance England this afternoon and they advised me that I am eligible for a loan.

I made a valid application to the EU before the deadline of 01 June 2021 and I was granted a certificate of application (COA), which permits me to study in the UK.

Please note that at this point my leave has not been refused or decided by the Home Office. Please see the two links below:

Please note that I applied for the right to remain as a Zambrano Carer under the EU because I have been the primary carer of a British child since 2013 for over 5 years. I applied before the deadline, so that this right could be protected.

I have attached a document from the Home Office which further clarifies the issue.

Based on the above points which I have raised, I hope the University can review their decision, as I have a valid certificate of application.
