My colleague at work has just graduated with first class in social work at 54 years, after being undocumented for years then God made it happen, already she has been offered a job with one of the local authorities. You will study at God's time and it will be the best

I had to turn down the offer to study MHN when after presenting COA I was still being asked to pay international students fees. I believe I will study in the near future by the grace of God

When I heard that one University stopped a year two students that the case similar to mine that was then I decided enough is enough . I will definitely go to this Uni at appointment time and It will surely come to past

Many thanks for your message @Premo85. No I didn't have any leave to remain. I've been given both options for appeal & administrative review.
Do the AR first although frankly there has not be any changes in outcome for those who have been lucky to have had their AR concluded. Timescale is like months, almost as long as appeal waiting time.
So you jumped the hurdle of meeting the their definition of a Zambrano carer but failed at the compulsion bit?
You said there is no alternative carer so why sis they say the child will not be compelled to leave the UK?
I know of cases where the HO has said the child,is 16+ and they can make decisions who they would like to live with or care for them. Is your similar?

Many thanks for your message @Nyamebeye. In my case, my dependents are disabled adults so the burden of proof & compulsion threshold is higher. I will try the AR with further inputs from Doctors & specialists. Looking like I have a long journey ahead. The Lord is our strength 🙏🏾

It's been quiet here for a while. Want to share something Interesting :
This afternoon, I received our supporting documents by post. While going through the pack, I saw a drafted letter of refusal dated in July for my husband's application.
I can't believe they had already decided his application and drafted a refusal in July and sat on it until Oct 2020. He received his refusal letter on 4th Oct via email and the actual letter was dated 3rd Oct same as mine. So interestingly, there were 3 letters in the pack, my granted settled status, my husband's refused drafted and original letter 😂😂😂.
This has clearly exposed them. I think most of the delays are deliberate.

Before I had my status, I had gone to my MP to intervene. They responded to my MPs enquiries that they granted me my status on the same day I applied in Feb 22. I told MP it was not true so she went back to them. Today, they wrote to MP to apologise for incorrect information and the confusion this may have caused, and went on to say I've now been granted settled status.
I'm lost for words.

I have been a silent reader here. Need advise on below
I received an email asking for further information requesting details on primary career.
I live in the uk with kids and partner lives abroad
They are asking for school letter and gp letters.
However gp always send message no letters.
On the email it says we need these to decide if we can access for settles status of presettled status.
My child is few months away from turning 5.
Any advise? On what to sent and what does it look?

Request a letter from the GP practice to confirm your child is registered and that you bring the child to all medical appointment. Usually they put when the child was registered, address etc.
The GP surgery may charge you for that letter. In your request state exactly what information you like to have in the letter.

Also get similar letter from previous nusery (if you can) and current school.
Any documents short of 5 yrs will mean them granting pre settled status.

If your child will be 5 next month, it would have been advisable to wait but knowing home office just send the information you have now and let them decide. It will be easier to progress from having pre-settled status to settled so secure that first.

I have received my decision today and unfortunately it was refused. Basically what they said that is that I had a FLR Appendix FM and that I was granted derivate residence in March 2014 (5yrs) but my daughter became a BC on 12/02/15 so as such, from that date until 17 /01/22 when I applied for EUSS I didn't meet the definition of a Zambrano carer.

So I wanted to know if those years from their definition 12/02/15 to 21/09/2019, I couldn't have been a Zambrano carer?.

Before becoming ZC, I held a 5yrs EEA family as I was married to a French national and it was a messy divorce so he refused to provided docs to show that he was exercising EEA treaty when I was applying to ILR.
So the HO granted me the derivative rights back in 2014.
When that expired in 2019, I had to apply to FLR as I was being pestered at work received a dismissal letter and then was granted 2.5 years which expired in June 22.

I have already started the AR process and wants to appeal as well simultaneously.

I need advise especially about including the info abt my previous EEA family member status

First of all, sorry to hear of your application refusal.
Your timeline seem a bit confusing. So a bit more clarification will help. So, after your divorce, were you granted retained rights? You mentioned derivative right. However you state your child became BC on 12/02/15, how were you granted derivative right in 2014 if your child wasn't British then?

Assuming you held derivative rights for 5 years, then you could argue those 5 years as the period you were relying on for the settled status.
If it was retained rights instead, then that caveat they apply to anyone with LTR have been applied to you too As they have been saying (although very deceitfully), once you have LTR, you don't qualify as Zambrano carer.
I think if they assessed your application well and did not just dish out refusal template, what they could have done was to have granted you pre settled status for the 4.5 yrs you didn't have LTR. Because you were a Zambrano carer (by their definition) at that time.

Thank you for your reply and your sympathy

After divorcing, i wasn't granted retained rights and i battled with the HO ,for 6 years ,before i was granted the derivative right in 2014 (appeal in person with my then solicitor) and i remember that at that time, i had to provide her documents, school letters, GP, dentist etc. So i was even thinking that how could they grant me Zambrano right and then deny me that by basically saying that i didn't complete the full 5 years because my daughter became British after? It doesn't make any sense at all. i thought the same as you as to be at least considered for pre settled status for the remaining years.
Furthermore, it doesn't say anywhere that having derivative residence before your child becomes a British citizen excludes their carer from being considered as Zambrano carer
i am nearly done with the AR ( i have talked about the 4,5 years remaining ) and i will do the appeal over the weekend.

hello everyone,

Just to let you know that l have been granted PRE- SETTLED STATUS 2 weeks ago (been ill- covid again) and also received the BRP --- now the question is Do l need a visa to travel with my british children , l just need a break from all this immigration issues and travel for a bit before focusing on this thing called life?

Just to let you know that l have been granted PRE- SETTLED STATUS 2 weeks ago (been ill- covid again) and also received the BRP --- now the question is Do l need a visa to travel with my british children , l just need a break from all this immigration issues and travel for a bit before focusing on this thing called life?
Pre settled status is only relevant to the UK. If you travel to a country where you would normally require a visa, then you still have to apply for a visa. Your UK status doesn't change that.

You will need to apply for visa, according to the country you are entering
I know that with some national passports; visas might not be needed but still check their requirements
