I have been following this forum for the past 3 years, but this is literally my first post on here.

Application received:28 June 2019
Biometrics letter received: 06th July 2019
Biometrics Enrolled: 08th July 2019
COA recieved 12th July dated 09th July 2019.

Hello,

I’m a non EU citizen, primary carer of a British child. I seem to be reading that this scheme is not for those who currently hold a 2.5 year brp on a 10 year route. Is this a hard a fast rule written anywhere or is it worth to try to go ahead and apply. I’m extremely anxious about having to pay for renewal of my visa late this year as I have absolutely no money for that right now.

I strongly advice you to give it a try as you have nothing to lose. If you call them and they tell you that you're not eligible, that will be a different ball game rather than relying on unfounded and confusing writeups flying all over the internet from individuals and money-grabbing lawyers who are not a staff of the Home Office.

Many of us are in the same shoes as you and we gave it a try, we completed the form, we have done biometrics and we have got a COA and now we are patiently waiting for their decision.

I need quick reply from everyone please. I requested home office to send me Zambrano application form. But they refused me by saying as below :

Thank you for your question about how to apply for the EU Settlement Scheme

From the information you have provide, we understand that you would like to apply for the EU Settlement Scheme under the ‘Zambrano’ provisions.

We must point out that an applicant applying to the scheme under the ‘Zambrano’ route is deemed ineligible if they:

· currently hold, or have previously held, Leave to Remain under Appendix FM to the Immigration Rules or any other Article 8 European Convention on Human Rights (ECHR) claim
· have never made an application under Appendix FM to the Immigration Rules or any other Article 8 ECHR claim, where that avenue is available
· have been refused under Appendix FM or Article 8 ECHR but their circumstances have changed since the decision was made – for example, the applicant applied on the basis of their relationship with a British spouse, but the couple now have a British child

The EU Settlement Scheme supports applicants who have no other legal means of maintaining their residence in the UK as the primary carer of a British Citizen.

The form itself states:

“A person with a Zambrano right to reside is a person…..without leave to enter or remain in the UK, granted under another part of the Immigration Rules” (Page 1)

If you have been granted leave to enter or remain in the UK under another route, then the form goes on to state:

“…you are ineligible to apply on this form, as a Zambrano right to reside only applies if a person has no other means to remain lawfully in the UK” (Section 7 (Page 24)).

We can confirm that those wishing to apply for the scheme based on a derivative right to reside in the UK under the ‘Zambrano’ route, must apply using a paper application form.

Paper applications are only available depending on an applicant’s individual circumstances, and after we are sure a person is eligible.

For us to assess whether you meet the criteria to apply using a paper application, please resubmit your query via the online enquiry form at https://eu-settled-status-enquiries.ser ... v.uk/start, clearly stating whether you have ever been granted leave to enter or remain in the UK.

If you are ineligible to apply to the scheme via the ‘Zambrano’ route due to having previously held leave to enter or remain in the UK, then we advise you contact 0300 123 2241 for further guidance and help with your individual circumstances.

If you have never held valid leave to enter or remain in the UK, then please also provide us with the following information relating to yourself:
· Full Name (as shown on identity document)
· Address
· Date of Birth
· Nationality
· Telephone number
· Postal address
· Email address
· Details of your representative (name, email, phone number if applicable)
· Reference number of any previous residence document issued to you

Alternatively, please gather the details above and contact the EU Settlement Scheme with the required information on 0300 123 7379. Our opening times are Monday to Friday (8am to 8pm); Saturday and Sunday (9:30am to 4:30pm).

Would someone advise me please how to get Zambrano application from home office. I am spouse of British citizen and have to minor British citizen kids too. I have no status and would like to regularise my status under Zambrano policy.

You need to get a lawyer.
If they think you are not eligible that’s it is..
You can only get the form from them and not anywhere else...

You will still need to provide them with the information they requested for.
The part that says if you had no leave to remain or enter.... they still need to advice you on what they think it’s best for you...

Been thinking, the simple answer is that, firstly u can’t make an application under EU settlement scheme without a prior eligible leave.
Biometric card is a requirement to start with.

You need to make a derivative residence application as the main or shared carer of a British child.... the issue here is that u must be someone who can only derive leave from either a British child or a disabled adult...etc

You are a spouse of a British citizen, hence could be ineligible depending on their relationship.

Can u please help me with the doccument you provide for evidence (not the five years evidence) I'm a bit confused
Or if you provide exactly the same doccuments as if you were application for the derivative Residence residence card

This week is gone and no one has heard anything after we received COA on the 16th.
Hopefully by nextweek or week after there should be something to talk about..

Amen and Thank you. We still praying and hoping that we all receive the good news very soon.

I usually listen to immigration lawyers on radio and people keep asking if they have heard anything about the Zambrano settlement for their clients, but also say not yet.
So let's all keep our Hope's up and believe the very soon we shall all receive it in God's name🙏

I got a zambrono derivative residence card back in 2014 July, due to apply for renewal and the new rule came so was advised to apply for settlement scheme under zambrono instead of renewing. I am currently the sole parent of my british citizen daughter who has renewed her british passport last year March.
Application sent: 15/07/2019
Biometric requirement letter and passport of mine and my daughter received from home office : 25/07/2019
I just received them today as 30/07/2019 from my lawyer and going to do my biometric tomorrow. ( biometric was not required when I did my first application back in 2013)
Fingers crossed. Or some advice of % if successful for my application would be appreciated :D

We are from Zimbabwe and l have 2 and half years brp spouse visa. I have 2 British children my husband has got indefinite leave. We are applied for zambrano. Any advice please with my situation..

My wife just got a call from home office that her paper application for zambrano she is ineligible as she has visa for 2 n half yrs but she is getting settlement under the other route. She got asked to send her brp card asap for scanning. The settlement will be proven by logging on ya ACC, it won't come as brp card..

First person to break our awaiting silence.
Does it mean she will be granted a settlement regardless of her 2 and half as a parent of a British citizen child/children ?

Why was she asked to send her BRP again ?
Did she not send it when she made the paper application for verification of identity?
Or did she use her passport instead ?

How long ago did she apply ?
Sorry for so many questions is just that we have been waiting ?

Hopefully decisions will soon start arriving as a new Caseworker Guidance for Zambrano applicants under the EU scheme has just been published (1/08/2019)
