Timeline

As of today, I have not received a decision on my application.

I accept applications by Zambrano carers are more complicated than EU citizen applications, in part because they are paper based.

I also understand enquiries are required on occasions.

Your need to make further enquiries and the derived EU status of Zambrano carers are factors that do not account for the difference in service standards between EU citizens and Zambrano carers.

Specifically, if EU citizens can receive a response within a 5 day target, Zambrano carers should receive receive a response within weeks.

The length of time for EU settlement paper applications makes it difficult or impossible to find work because employers fear being fined for employing people not entitled to work. This can and does lead to significant hardship for many families.

Applicants are prevented from travelling abroad for significant periods and this can lead to hardship particularly as requesting the return of a passport in emergency leads to the application being 'withdrawn'. I feel this restricts both my freedom of movement but also that of my British citizen partner.

All applicants have a right to be treated in a fair, considerate and timely manner which the Home Office is clearly failing to do at present. Why is it taking up to six months to complete applications that take minutes to process? What steps are being taken to improve the standards of service? Is it acceptable to use minimum standards as targets?

I intend to complain to my Member Of Parliament - and eventually, the Parliamentary Ombudsman, should I not receive a decision forthwith.

Timeline for Derivative Residence (Zambrano):-

1. Application made December 2018.
2. Biometric January 2019
3. Refused July 2019

Did not appeal the refusal.

Here is my timeline for EU Settlement Scheme Zambrano:-

1. Application posted about 14th June 2019
2. Application received 17th June 2019
3. Biometrics enrolment letter received 27th June 2019
4. Biometric enrolled 29th June 2019
5. COA received 9th July 2019
4. Notification of decision (Settled Status) by phone 22nd January 2020

Now waiting to receive BRP Settled Status and supporting documents.

The Parliamentary Ombudsman (PHSO) today said that they spoke to their contacts at the Home Office late last week and/or early this week.

PHSO do not know why the Home Office is taking so long.

The Home Office had mentioned "necessary checks" but so many people should not have to wait for over six months after receiving their COA.

The PHSO can make a ruling after everyone receives their decision. The PHSO can ask for an apology, compensation, and more if the Home Office does not provide a good reason for the delay.

The more complaints the PHSO receives about the ridiculously long delays by the Home Office, the more likely they are to contact the Home Office.

Hi everyone
I have a question I Hope I will find the answer from here again
Quick background history
Been an asylum seeker for the last 4 years I applied for my derivative right through the EU SETTLEMENT SCHEME in August and still waiting for final decision
Now my sponsor who is my daughter but a French National was born in the uk I applied on her behalf for the scheme last year and she got pre-settled status and this because at the time we applied she was 4yrs this year in October she turns 5 which means she would be considered to have continuous residency so I assume she will qualify for settled status


As her mum given given that she has pre-settled at the moment I will surely be granted same but after she turns 5yrs will be able to apply for settled status too or will it be a matter of renewing my status every 5 yrs

Hi

You will be granted pre-settle status for your current application. After your daughter turned 5 in October both of you will be eligible to apply for settled status under the EUSS. Then that will be the end of the journey because you will have 9 years after 12 months on a settled status to apply for British nationality if you choose to.

There is no such category. The user likely means they currently hold discretionary leave to remain which is leave to remain granted under the UK immigration rules.

Quick background history
Been an asylum seeker for the last 4 years I applied for my derivative right through the EU SETTLEMENT SCHEME in August and still waiting for final decision

Hi

You will be granted pre-settle status for your current application. After your daughter turned 5 in October both of you will be eligible to apply for settled status under the EU Settlement Scheme. Then that will be the end of the journey because you will have 9 years after 12 months on a settled status to apply for British nationality if you choose to.

I hope this clarifies your case.

Yeah six months gone but I have received two emails from the Home Office.

One from the post decision casework unit acknowledging promulgation and implementation of the Judge's decision on the 15th of November after the Courts ruling on 31st October 2019.

Time line

Zambrano renewal february 16th 2019
Zambrano refused June 10th 2019
Appealled logged on 15th of June 2019
Appeal heard and allowed on 31st October 2019
Acceptance of promulgation 16th December 2019

Will keep you update when my Zambrano is Re-issued

Second letter is also yesterday from eu settlment scheme saying due to them been overwhelm they a Sorry that the have not been concluded my application. But they are asking for little bit of time so I shouldnt proceed to the Court. Already done PAP

Time line

Zambrano DR EU Settlement application 15th June 2019
Biometric 23rd June 2019
COA received 7th July 2019
PAP done 15th October 2019
PAP response from HO 25th 2019
Home Office seeking more time letter 16th December 2019

The good news is, I am not worried again because by virtue of the courts decision to allow my appeal and Home Office failure to appeal against the Judges decision,

I still have my Zambrano RESTORED and no more

Thats great hope u get settle status soon. I have learnt alot from skelton of argument u sent to me. My passports gone for renewal and will get it next week. This time i have draft a covering letter for my drf1 application should i send this or not i meant would this make any difference to HO or they gona stick to there policy to apply first under uk law.

Yes mubashir, at times Home Office caseworkers need more information as a cover to help them make an infom decision on cases.

Just use what i gave you and the new ruling of Patel vs SSHD and Shah. All will be well. Now Home Office should decide cases on case by case study.

Get your passport, bang in your application with good covering letter and just wait for the decision.

Home Office will not refuse parents who themselves have no status and their only right is to derive from their British child. The new Patel case makes it clear.

A ‘person with a Zambrano right to reside’ is defined in Annex 1 to Appendix EU as a person:

• who has satisfied the Secretary of State, including (where applicable) by the required evidence of family relationship, that, by the specified date, they are (and for the relevant period have been), or (as the case may be) for the relevant period were, resident for a continuous qualifying period in the UK as a person with a derivative right to reside by virtue of regulation 16(1) of the Immigration (European Economic Area) EEA
Regulations 2016 (‘the EEA Regulations’), by satisfying the criteria in either:

o paragraph (5) of that regulation

o paragraph (6) of that regulation where that person’s primary carer is, or (as the case may be) was, entitled to a derivative right to reside in the UK under paragraph (5), regardless (where the person was previously granted limited leave to enter or remain under Part 1 of Appendix EU as a person with a Zambrano right to reside and was under the age of 18 at the date of application for that leave) of whether, in respect of the criterion in regulation 16(6)(a) of the EEA Regulations, they are, or (as the case may be) were, under the age of 18 years

In addition, the person must be without leave to enter or remain in the UK granted under another part of the Immigration Rules.

In Annex 1 to Appendix EU, a ‘person who had a derivative or Zambrano right to reside’ is defined – including as a qualifying category under condition 3 of rule EU11 or condition 1 of rule EU14, or for the purposes of meeting condition 3 of rule EU12 or condition 2 of rule EU14 – as a person who both:

• was a person with a derivative right to reside or, as the case may be, a person with a Zambrano right to reside, immediately before they became, as the case may be, a relevant EEA citizen, a family member of a relevant EEA citizen, a person with a derivative right to reside, a person with a Zambrano right to reside or a family member of a qualifying British citizen

• has since remained, to the date of application, in any (or any combination) of those categories or as a family member who has retained the right of residence by virtue of a relationship with a relevant EEA citizen or with a qualifying British citizen
