Hello all
From what I've read about this, I understand that I must demonstrate centre of life has been in the EU country where I've lived.
I have a home in the UK which I own on a mortgage where I live with my four grown up children.
Would I have to sell the house to prove 'centre of life' elsewhere?

My predicament is that however much I want to be with my non-EU partner, I cannot kick my children out of their home!
The EU route is the only choice open to me as I don't earn enough to meet the £18,600 threshold, and my partner was repatriated last year, so she has a poor record for any kind of application.
Please be kind.. I cannot get a grasp on the legalities, maybe why we are in this pickle!!

Why did you not apply for her before she was repatriated.

We did, but it was refused, we spent over a thousand on legal advice, following this we arranged a flight home for her, and she decided not to take it.

The legal firm we'd used wanted another thousand before they would even discuss an appeal or our next option, we lost faith with them at this point feeling they were just milking us for cash.

I guess we have to accept its not going to happen!

There's no argument, we've done everything wrong along the way and there seems no way back.

As you have any children from another marriage . Exceptional 1 would have been engaged.

I am surprised that the lawyers did not explore that.

If you have a house in which others live the reason for having such a house is clearly partly for their benefit. In a sense it's not just your house.

Why can you not move your 'centre of life' to a new home (for you) in some EU country;
there is nothing to stop you owning a property portfolio (original house) as an asset you choose to 'rent' to other people (even if they happen to be family members).
If you see what I mean.

Why not draw up some 'rental agreement' for the 'tenants' living in your current house;
Or put it in some sort of trust;
Or transfer ownership to them - surely many ways & means here.

Maybe a rental agreement, this would be the only option as I still have a mortgage.
