EEA 2 Surinder Singh questions before applying

Hey guys,

A bit of background information.

I am from the UK my common law partner is from North America, we have been living together since Jan 2008. We moved to Ireland August 2010, my partner was originally on a working holiday visa.

I started my own business in November 2010, when her original visa expired we applied and received eu fam4 card. This was after submitting 12 months worth of bank statements, invoices, and a tax clearance cert.

My business failed mid 2012, from then I was dependent upon my partners income until gaining employment in the beginning of 2014 were upon I worked two different jobs, one was part time until I found full time employment, which covered April until December 10th.

During my time in Ireland in I had no heath insurance, never even visited a gp. We arrived in UK (July) after being in Canada for 5 and a half months, then 2 weeks in Dublin followed a further 2 weeks in Turkey as there was no boarder control between Ireland and UK.

Upon arriving at the UK board and requesting a 1a stamp for my partner and stating Surinder Singh, I was told the as a UK national it was not possible. Almost one hour later after shouting match with UKBA were upon I was told that they know the law, We managed to get a eea stamp, but only after the chief immigration officer heard the commotion and intervened. She told us to apply to the home office asap.

We are going to apply this week for the eea 2 residents card, my question is will there be any issues? I have exercised my rights being self employed and then later on employed. But also I was supported by my partner, opinions please.

Are you still a common law partner or are you now married.

You were fortunate to receive the Code 1A as a common law partner, If that was the case.

Unfortunately Regulation 9 does not cover Common Law partner of British National, but EU law does, but Tribunal has ruled that it does.

Thanks for the reply Obie,

So as an extended family member the chances are slim, when did they implement this?

Returning to Ireland and working getting married fixes this? guess getting married in the UK would not work.
