EEA2 New Application

Post by avrapi » Wed Apr 23, 2014 9:55 am

Hi All,

I am Albanian and have been married to EEA national for more than 3 years. We divorced in 2011, but my 5 years visa will expiry in May and after contacting home office, I have been told I need to apply with EEA2 application. There is new part to this application in case, if you have been divorced... We also have child, who is 9 now and both my ex-wife and my daughter live permanently in UK. The question I have-which supporting documents will I need and will " EEA family member" will be my wife or my daughter in the application? Tried to call to homeoffice again, but it is just impossible to get through....Can't find relevant info online.

Appreciate any advice..

Forms are very simple.
Your ex wife is your EEA national family family as per your case.
You are require to set the relevant documents explained in regulation 10(5).
But you have to give the full details of your child in the EEA2 form.

Thanks a lot for your reply... Do you have any link, when I can find this regulation? I looked online, but it is really confusing///  Not sure, If I need to proof that my ex lives here 5 years or that we have been together more than 3 years...My work or her work? It would nice, if there would be the list of what exactly they need. In my previous experience I was asked for more doc, which delayed my application, want to make sure I got everything right this time.

If you are applying PR then you have to show 5 years time spend under EU regulations.
i.e 3 years your ex wife treaty rights or PR confirmation.
And 2 years your treaty rights after divorce.
For more information you can read EEA4 guidance notes which are available for reading on the home office web site.
