EEA4 application -urgent help

HI,
I am norway citizen who have sponsored my brother under european treaty.This has been granted in november 2005.He has been residing here while my application to sponsor him made(his asylum was refused).He have his old utility bill dated march-november 2005.However he only started to work in March 2006 which left him with P60 from 2006 to present.Can he include utility bill dated november 2005 and P60 there after to make his Permanent residency or does he have to wait until next P60.I am well confused as I have met 2 lawyers and they both give me opposite answer.Please help me with this question.The law acquire the stay in UK more than 5 years.If the date is counted from the date I have made application under family member of european family it would be 5 and half year now.looking forward.

Normally it's very difficult to sponsor extended family member (i.e. brother, sister)

Do you mind sharing with the forum how you managed to do that? I understood your brother is not EU citizen.

In what way was your brother dependant on you?

Did he have any family members left back in his home country. Was the country considered as dangerous by UKBA?

What was his age when his application was lodged?

Back to your question. Are you sure your brother needs to show he exercised Treaty Rights? Normally they want to see that EU sponsor exercised Treaty Rights.

If he doesn't have P60 he can submit letter from employer confirming employment.

Does he not need to show he is still dependant on you? In which case his employment might weaken his application.

To be honest I would strongly advise to see a reputable immigration advisor.[/i]

HI,
I did consult lawyer prior making application but no use as they advice me it is going to be difficult and wanted to charge me more money.So I decided to do it by myself.Here what happened.
My brother is an asylum seeker in 1999.His asylum was rejected in 2004.At the very point I decided to come to UK.
First I looked for a job.I waited 6 months to apply just to make sure I can give enough evidence.I had tenancy agreement under my name(i did not include his name).All utility bill under my name.I called Home office under european section.I explain to them my brother situation and that my intention to come here is not really to sponsor my brother but to earn more money and better education for kids.Their reply was fantastic.If the application and all required documents included there will be no reason they will refuse it :?
They did not give me list of documents that I should include at all.
So I included many documents,Only few I still remember thou.
1 tenancy agreement
6 pay slip and 1 P60
6 months bank statement
utility bill
letter from employer
birth certificate of me and my brother
Letter from council authority where we born in Sri Lanka confirming our sibling status
My brother's asylum letter.
My brother's first entry letter from immigration in Heathrow
AND
a letter explaning why I have decided to sponsor him which include
1)since his asylum has been cancelled he can't work thus he can't provide himself.
2)Sri Lanka has broken the negotiation at that very time thus fearing of return home still exist.(This is where they decided Sri Lanka dangerous)
Our parents are still in sri lanka which I did tell HO.They are old and my sister were trying to sponsor them to swiss which mean he will not have anyone there in future.
Although I am married my surname is still my maiden name which obviously the same as my brother.It is just norway rule that we can keep our maiden after marriage I decided to do so.
HO asked me to provide my son and daughters passport and birth certificate.
*although I was working the money I earn will not be enough to support my kids and him.Frankly I don't know how and why they actually decide to grant it.I have told everything I did.I did heard rumour that the law is going to be changed in 2006 thus I decided to apply in 2005 where initially I wanted to do it in 2006.Maybe it is timing. :D

One of the utility bill(gas bill)was under my brother name in the same address and I have inlcuded that as well.Sorry

Life in the UK test only applies for applications under UK law, and therefore not needed for PR applications.
