EEA4 enquiry no 5 years of continous treaty right

Current status: resident card by EEA2, expires Jan 2016

I really need some help please, I am a daughter of 2 Irish parents. I am not Irish as I have never lived in Ireland. I have lived in UK for 15 years now, for 11 years I had no visa. I got "arrested" in 2010 when travelling to Belfast for a wedding as my Hong Kong passport had no visa. Anyway after I was release I applied for EEA2 as a dependent of my parents who just opened a business in UK. I was 20 then.

My parents business was doing very badly so they closed it down in 2012, since then they have been in and out of employment, my dad tried to apply for job seeker but was not grated because he was not a tax payer for the times he was in Ireland? I wasnt really sure why it wasn't granted.

My main concern is that I am hoping to apply for EEA4 in DECE 2015 but how long can my parents be out of employment? they are both working now but my dad isnt getting payslips, however my mum is so I am planning to use her. But i think she has a gap of 9 months where she was working for a restaurant that was not providing her payslip and has closed down now.

Really desperately need some help!

Firstly, you dont need to have lived or born in Ireland, to secure Irish citizenship.

Did your parent hold Irish Citizenship before your birth.

Provided you can show continuous treaty rights for 5 years, you will succeed with an EEA 4 application.

Sometime absences from the job market does not automatically mean that your parents lost their worker status.

It may well be the case, that there lawful residence has not been broken.

If that is the case, then you will secure PR.

No i never lived in Ireland because i lived with my aunt in belfast for 10 years and she never bothered to help me apply for a visa so i was actually in the uk for 10 year illegally. Only when my parents moved to uk did i get my resident card.

My mum had a gap of no work from may 2012- nov 2012, she was able to get a doctor's note stating she was not fit to work during that period though. Is that valid?

You don't need to have been born or lived in Ireland top get citizenship - being born of Irish born parents or grandparents entitles you. That's how both me and my daughter have citizenship - through my Irish born mother...
