EEA4 Polish Comprehensive Sickness Insurance

Hi all!

We have recently been refused PR due to lack of Comprehensive Sickness Insurance while being self sufficient and student.
My question is if we appeal and show Comprehensive Sickness Insurance purchased in Poland will that be ok or does it have to be csi purchased in the UK?

Also how long does usually appeal take?

I appreciate any advice.

You never applied EEA1registration certificate as student ? If you did then read here

Polish insurance : it has to be international one or EHIC ( European health card ) issued by polish authorities
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021

Thanks for your reply. I have been a student in 2006-2007 however I applied for RC as worker amd receieved it in 2008.I ve worked from 2006 to 2009 and then had maternity till 06.2010 After that sellf sufficient on my non EEA Husbands income till 09.2012 them a sudent and from 04.2013 self employed.

If you were a student and If you applied (although not mandatory) for a Registration Certificate as a student without insurance you would have been covered but you are not because you applied as worker

maternity leave were you still employed then or after you left the job ? I believe the way UKBA look at it is that you are either exercising treaty rights or you are not. Voluntary unemployment ( not maternity leave) to be a full-time mother is regarded by UKBA as not exercising treaty rights - unless the person exercises treaty rights as self-sufficient

If EEA nationals want to exericise treaty rights as self-sufficient they are supposed to live without reliance on public funds.
Also, to be self-sufficient they should also have comprehensive sickness insurance (CSI) for themselves and all family members - without relying on the UK's NHS ( even if the non-EEA spouse works and pays tax and national insurance.)


you may ask polish health authorities to issue you a letter. If you do get one let us know how you manage one because you are not alone in this forum . i've seen 5/6 people asking about the same question.

For the period in receipt of Maternity Allowance it was form job center not the SMP from employer, thereafter i wasn't working till April 2013.

Does the 5 years towards PR can count from the day i started employment in the UK or 5 year past from the date i applied for PR?

We are planing on appealing and making fresh application.

Also the caseworker said i wasn't self sufficient on my non EEA partners income as there weren't enough transaction which we gonna fight about as we read on UKBA website that EEA person can be self sufficient on non EEA income, for that they want prove of income which we provided they don't say anything about requirement of transaction.
