EEE4 Application - Separated with wife - Please help

I would like some advice about my current situation.

I am congolese (RDC), and I am 36 years old.

I am currently separated from my wife, which is British Citizen, born in Belgium as a British Citizen (Mother British, Father from Cameroon), and she lived her entire life in Belgium, and just came in UK at the same time as me (She never lived before in UK). We are still married, but separated. We met each other in Belgium 4 years prior moving to UK.

I have lived almost my entire life in Belgium (25 Years), came in Belgium from Congo when I was 5 years old, and lived in Belgium until 2004. I was Belgium resident for all this time, and never apply for Belgium citizenship, because I didn't see the reason to, having no paper problems, and could travel as I wishes through Europe and the world. I didn't renew my Belgium residency because I became UK resident and was happely married with my wife.

My Wife and I are separated since the 27/03/2009.

I am about to apply for a PR, and tried to contact her to provide me the information require, but she refuses to cooperate. She is in uk, and she is still exercising her Treaty Right.

I know my PR will be rejected as I can't prove that she is still exercising her Treaty Right and give the HM the necessary documents.

I am getting ready to go for an appeal, and would like to know what are my chances. I have read many posts with similar cases like mine, but there is no clear answer to my question.

Also, if anyone out there and similar cases and won their appeal, I would like to ask them if they could recommend me a good and "honest" solicitor. There is many out there who claim to be able to handle this type of case, but I have already spend £2000 on one just to found out she didn't have a clue about EU Immigration Laws. So please, any good solicitor recommendation will be helpful.

Visa and Marriage History

Visa EEA Family Permit 1 Year (From 22/11/2004 to 22/11/2005). Visa issue by UK Embassy in Belgium.

Visa EEA Family Permit 5 Years (From 16/03/2006 to 16/03/2011). Visa issue by Home.

Marriage Date: 06/11/2004 in Uk

From 22/11/2004 to 27/03/2009 we have lived together, same address, had a joint bank account together for more than 4 years (I have all original statements), also have orginial council tax on our both names up to 27/03/2009. Have a scan copy of her current passport (which I will include in my application, although I know they will not accept it as a proof). We have No children.

Can anyone out there can give me some advice?
