Elderly relative dependent under compassionate circumstances

Post by daredevil84 » Fri Jul 29, 2011 8:44 pm

Hello vinny.
I have an indefinite leave to remain in the uk as does my husband. I have a son who is 26 years old and has always lived with us and who we support financially. He came to the uk at 22 years of age under a student visa and is still on a student visa currently. I want to make an application under the elderly relative dependent for my son as i read on the ukba website that under compassionate circumstances it can be allowed. My country of origin is mauritius and my son has no one else who can support him there financially and has no accommodation there. We are his only family. Is it a realistic aim to do the application? what do they mean by ''exceptional compassionate circumstances''?? please help me

i read the articles and it ask more questions than it answers? what's your personal take on it? do you know a good lawyer who would relish such a case and be inspired by it instead of saying it is very difficult?

Who is supporting his ' student visa' status? if its you then you have grounds for applying for him as a dependant. You need to demonstrate that you have no other family to support him back home nor any resources like property.
You will have to show that he lives with you and you pay for all his needs.
this much should be good for your case.

Worth a try as you have no other choice at the present, involving a lawyer is going to cost you more with probably no difference in the end result.
