I just want to ask the expert here pls.... my cousin's son born here in the UK while she still in WP. the baby was born here Dec 2006 after 3 months she brought the baby back to her country. recenlty she obtained her ILR and she wants to get her son's back to UK to be with her.

is the son eligible for British citizen eventhough he was only born here and live all his life outside the country? If he is, can she apply for the son British passport in her country and what requirements she needs to submit?

No the baby would not be eligible for Citizenship as she did not have ILR before the child was born. She would be able to apply for the child as a dependedent of someone settled in the UK I thinks using the blow
Form SET(F)
Form SET(F) is for settlement applications by family members. You can use form SET(F) if you are:

â– a child aged under 18 of a parent, parents or relative who is a permanent resident of the United Kingdom and currently living here;
â– the adopted child aged under 18 of a parent or parents who are permanent resident of the United Kingdom and currently living here; or
â– the parent, grandparent or other dependant relative aged 18 or over of a person who is a permanent resident of the United Kingdom and currently living here.
(If you are the husband, wife, civil partner or unmarried/same-sex partner of the permanent resident, you should use form SET(M) - see above.)

You should read Completing application form SET(F).

Please check the guideline for registering a child for british citizenship:

Kindly go to page 8- child born in the UK. I am sure that by being born here and by virtue that the parent/s are now immigration free, the child can be registered as british citizen (section1.3)- with regards to the child staying in the home country after birth, I do not see any clause about this - but what is best is to ask Home Office themselves so that no issues would arise after you've submitted your fees and application form.

I do hope that your cousin managed to register the birth at her council at the time so that the child has a black and white record that he was born here and that it's easier to present the case- I am not saying that without it she cannot prove it- I am just saying that it might just help her ease the presentation of the case.

She needs to get the child to UK and apply for ILR. Yes the child is eligible for citizenship as the parent is now ILR holder. But still need to go to the same process as applying for citizenship. Pay a fee of £400 I think, if the child was born with parent already holding ILR then its free.

It is your cousin's discretion if she wants to go through the ILR route for her child. But as mentioned, the baby could go through straight to registration and save herself the fees- simply because he is "entitled" to be registered being born in UK. But Parvus1202 is right, get her son here in UK first.

Parvus, that advice you are giving is wrong. Child does not need to get to the UK, nor have ILR, to be registered as British.
