I joined my husband in the UK two years ago ie in nov 2009. And I am currently on FLR. He got his ILR last year ie dec 2010.
Under the following provision I feel I am eligible as according to my understanding I have lived in the UK as the spouse of a person currently settled here:
However my confusion lies in the wording of the first statement. Does it mean that I need to be living for two years in the UK as the spouse of a person who has been a permanent resident for atleast two years himself? Or who is just currently a permanent resident? ie do I need to wait till dec 2012 which is when he will be a permanent resident for two years. Or am i already eligible as I have lived in the UK as his spouse on the relevant visa for two years.You should use application form SET(M) if you:
· currently have temporary permission to remain in the UK as the husband, wife, civil partner or unmarried/same-sex partner of a British citizen or a person settled here;
· have lived here for 2 years in this category; and
· are still planning to live together (and are still married or in a civil partnership, if applicable).
Any help in clearing my confusion would be highly appreciated.
