Eligibility for ILR, while working in home country.

Hi,

I've Tier-1 (General) visa and I've been in this country for more than 2 years now. After 1 extension my visa is valid until Aug-2012 and I'd be eligile for ILR after that.
If I go back to my home country and start working there in my own field, would I be eligible for ILR when it is due in Aug-2012 OR it is must that I stay in this country during this period. Cause I read somewhere that one would be eligible for Citizenship even working in his home country.

Any quick&authentic response would be highly appreciated.

According to current rules if you are legally residing in the country for 5 year then you are eligible to apply for ILR. If you economic migrant then it adds that you need to be economically active during this period. If you are out side the country for more than 3 months continuous then the ILR clock gets reset. But if you are working outside UK becoz of business needs and you are being paid in UK and you have P60 then you can still apply for ILR after 5 years.

But as you are aware the rules are changing and after 2011 July the time to get ILR will be increased to 8 years.

wot!!! this means currently, I am under HSMP I will get extension till Nov 2012. Will I be eligible for ILR or what do I have to do then :shock:
