Am i eligible for Tier 1 General

Post by psw2009 » Tue Oct 06, 2009 10:08 am

Hi guys,

I want to explain my question in after following steps.

1. i went to uk on student visa on 07-08-06
2. I completed my MBA degree on 19-06-09
3. I was doing dissertation from 29-06-08 to 19-06-09 i was kept extending the presentation date because i was not able to finish difficult topic because of the changing condition in economy of uk.
4. During my dissertation period i was getting the advice from suppervisor but there was no need to attend the classes in other words it was non-term time.
5. During my dissertation i did full time internship as well from 28-07-08 to 31-08-09 as Assistant Accountant.
6. I got my psw visa on 26-08-09
7. now i have appointment for Tier 1 General (i have enough points to apply for tier 1 general if i count salary of both jobs part time job as sales assistant and full time paid internship as assistant accountant)
8. During my internship i was on student visa but college and company did a internship agreement which is singed by the HR director.
9. My college can also provide me letter saying that my internship was part of my MBA degree and i got credits for that and i was doing the internship during non-term time.

based on the above points am i eligible?

You can not show this proof for previous earning, as the proof of previous earning should be dated after the period claimed. You need to get a fresh letter from them about the salary you have received, or your payslips, etc. This proof must correlate with your bank statements. Please refer to guidance what proof is most suitable to you.

9. My college can also provide me letter saying that my internship was part of my MBA degree and i got credits for that and i was doing the internship during non-term time. You do not need that. You would need proof from college for the money you received for your full time assistant accountant job.

based on the above points am i eligible?

Based on highlighted text, I think you can.

if they ask you this you can tell them that this job was part of your course and show your letter to them

hmmm!! sorry, I forgot to see this aspect:

Quote from Guidance:
115. We will not consider earnings made during a time when the applicant was in breach of the United Kingdom’s immigration laws.
For example: Earnings made from United Kingdom employment will only be considered if the applicant had leave to enter or remain in the United Kingdom at the time they were earned, and in a category which permitted the applicant to take that employment.

I do not know if you come under this clause or not? As far as I understand, students can take upto 20 hours per week of part time employement. Your case feels like a risky one.

By the way, you said you got your PSW visa on 26-08-09, why would you want to change it to Tier 1 now? I mean you could wait a bit more and when you become eligible, only then apply if you want.
