Employer cancelled the visa now changed his mind.... Help!!!

Post by King_Khan » Mon Apr 25, 2011 12:32 pm

My employer had written to home office to cancel my work permit visa 7 months ago, a month ago home office had asked for our passports which we sent. We just received our passports with letter asking us to leave the country before july. When i spoke to my employer about this he said he made a mistake by sending that cancellation letter to home office. He is now willing to do whatever needed to stop our visa cancellation.

My question here is, is there any possibility to stop our visa cancellation rither by writing to home office or going to court?

All responses are much appreciated.

Thanks

im pretty sure that you have no choice but to apply as a tier 2 migrant.

your employer REQUESTED UKBA to cancel your work permit and they duly obliged. Once its cancelled, well, its cancelled!

see if you satisfy tier 2 criteria. and APPLY while you are in UK as it is much more straight forward then to apply from home country

Presumably you haven't been working for this employer for at least the past 7 months, so UKBA were well within their rights curtailing your leave to remain. If you still have leave to remain, see if your employer can sponsor you for Tier 2, but they will need to notify UKBA as soon as you stop working for them.

Your letters from UKBA will tell you if you have a right of appeal.

Well, actually I have never stopped working for my employer. I was not told by my employer that he has sent out the request to home office, so I have been working without any break and am being paid as before.

If i apply for Tier2 again, what happens to my indefinite visa that i was going to get at the end of my work permit visa. Will I still be able to apply for that after a year when i will complete spending 5yrs here or will that be counted again from zero...??

Thanks for your responses
