WP Employer obligations re: change of contract or employment

Post by md1962 » Thu Jul 19, 2007 7:52 pm

Hi

What are the legal obligations for employers with regard to notifying then Home Office:

1/ If there is a change of contract for an employee on a work permit - e.g. employer moves from a straight salary to a lower basic with a pay for performance bonus?

2/ On termination of employment for the worker on work permit?

I understand that if there is a change of contract or employment then the employer is the party who communicates to HO and not the employee.

However I read somewhere on these boards that most employers don't notify HO when terminating employment for a WP employee - and that they aren't legally obliged to do so.

Apologies if this is already answered somewhere - I searched several times to try to find it.

Thanx
Mike

Employers must notify the Home Office if there is a material change int he conditions of the permit. In the case where the salary is lowered then it is a case of asking permission, and they should do this before the conditions change.

They are supposed to notify the Home Office if someone leaves their employment, but at the moment there are no penalties if they don't.
